TLDR : Answer Summary
The user is seeking clarification on whether their children, who are under 14 years old, need a visa to stay in Thailand, particularly in light of their plans to travel to Malaysia. They were informed that children under 14 do not require visas. However, community responses indicate that while children under 15 won't incur fines for overstaying, they still need a visa to stay legally in Thailand. It's recommended that the children obtain ED visas if they are in school, or Non-O visas as dependents, especially considering the potential implications related to overstaying once they reach 15.

Just for your info, a bit of what you were misinformed about is, every foreign child NEEDS a visa/extension to stay in Thailand legally. Just because the penalty is waived (under 15 will not be fined for overstaying or under 18 is not banned for overstaying) doesn't mean they are staying legally.

They wouldn't have a problem leaving and coming back again for now.

I don't think many problems. If you want them to be on a visa again, they must leave Thailand once because they cannot apply for anything at immigration offices during their overstaying.

(Off-topic: Some schools want their students to be in Thailand legally some don't care much)

nope, no issue until they turn 15 but if you're gonna be here you need to be thinking about what you're gonna do then

well you're gonna need to get the children ON visas of some sort here pretty quick because while children under 15 can't be fined for overstay once they hit that age they can and you'll start racking up overstay fines against them. They still can't be banned for overstay until their 18 but they will be fined when they exit the country after they turn 15.

If they're in school get them on ED visas, if they're not get them on Non-O's as dependents of yours because you legally work here.

The trip to Malaysia is well timed because you can't get in country visas issued when you're on an overstay so when you come back from Malaysia get after getting them visas and extensions ๐Ÿ™‚
