A buddy of mine is a British passport holder and he has two sons from his Laotian wife who have automatically got a British passport. Both are under 15 and have never done in a visa in Thailand ... does the old rule still apply that’s kids under the age of 15 are not considered overstay or have rules changed.

Can they exit the country with their dad normally or are they considered overstay?

Thanks in advance!

TLDR : Answer Summary
A British passport holder is concerned about his two under-15 sons, who have not obtained visas for Thailand, and whether they can exit the country without consequences. The consensus from the comments is that while the children are technically on overstay, they cannot be fined due to their age. However, it's advisable for them to have valid visas to avoid complications, especially if they plan to stay long-term.

I have a Lao wife too, and our son is only British. His school prefer the kids to have visas/Extensions and he's always piggy-backed on my work extension, as does my wife. I don't think it's a great idea for kids to have overstay stamps, even if they are not fined, especially if they'll be living/studying in Thailand for a long time.

You need to realize that the kids ARE on overstay

BUT

children under 15 can't be fined for overstay and children under 18 can't be banned. That doesn't mean they're NOT on overstay and shouldn't have a visa to be here it means there's no penalty for them to overstay.
