I'll explain better: he came for the first time with non o retirement in 2020. He has been in Thailand for 7 months doing the extension. Then he went to Italy with his Thai girlfriend and got married and his not o expired. He came back here with another one non o at the end of September 2022.
AND I'll explain better. He's on ONLY a 90 day Non-O visa entry that he got when he entered at the end of Sept.
The REASON he got that Non-O visa controls what extension he can get the first time. IF he got that Non-O visa issued in Italy based on retirement (AND it's noted on the visa sticker) he HAS to take the first year extension based on retirement.
IF there is no notation on the visa sticker in remarks stating why he got it (OR if he got it based on marriage to a thai) he can get a yearly extension based on marriage to a thai the first time.
Otherwise if it says 'retirement' on that visa he has to take the first yearly extension based on retirement and then the second year he can apply for an extension based on marriage
Now to answer your question; if he's married to a thai, then YES he can get the 60 day visit thai family extension on that 90 day Non-O entry (no matter what the reason was he got the Non-O issued for) ๐

Be careful here. As I understand it the first extension MUST be for the reason the visa was issued. So if he's here on a Non-O issued for retirement his first 12 month extension must also be for retirement. The second year he can switch to an extension based on marriage
brought up a great point. IF he got the Non-O visa based on being over 50 (retirement) he's got to take the first yearly extension FOR that reason.
He needs to look on the visa sticker (if he got one) OR on the PDF file if he used the eVisa website to get his visa and see if it says anything in the remarks area.
If it's blank or doesn't have any notation on why the visa was issued, he should have no issues getting a year marriage extension from it, BUT if it says retirement he's stuck and while he can take the 60 day visit thai family extension he would have to get the first year extension based on retirement and THEN the second year he could switch the reason to married to a thai
