Hi, I’m currently working under a thai local company but I want to inquire about forming my own company and procedure of it. Also, if I form my company can I transfer my current work permit and annual visa to that company? Please advice. Thanks!

TLDR : Answer Summary
An individual working for a Thai local company inquires about the possibility of forming their own company and transferring their current work permit and annual visa to the new company. The responses indicate that starting a new company is a separate process unrelated to the visa. Furthermore, it is confirmed that the work permit and visa are tied to the current employer, and one cannot simply transfer them to a new company. Instead, new applications will be required for both the work permit and visa.

As setting up your own company is not visa related I close commenting. For more information, find a good lawyer or account office.

No, you can not. The Work Permit and Visa or Extension of Stay you have are with papers from the company. If you like to change employer or start your own company, you start new again.

first you need to decide the name of the company and the logo for the stamp if you want to put immediately your name in the company not you but the thais (2 partner) must show financial evidence so my suggestion is to set up the company under 3 thai names and then move the shares to you ...you will be the ceo ...in the MOu of the company you write that the Ceo can be changed only with the agreement of all the share holders ..you must have a place where to register the company and a renting contract after registration you need to submit the requests for the social number of 4 thai workers and register VAT ..get a preapproval of the work permit .get a non B visa get the final work permit

Piece of cake you can do it without going out from the country

You have to set up a company, find Thai partners for that, hire minimum 4 Thai staff, have a bank guarantee of minimum 2 million Thb. Best to seek help from a lawyer or account office for all the details.

Yes I know I will have to cancel my current work permit at MOL and apply for the new one under my company. But what’s the procedure if I want to have my own company and get work permit + visa under that.
