TLDR : Answer Summary
In light of the current situation with border closures, it is possible to apply for extensions under a Non-O spouse visa without needing to leave the country. Expats can report to the immigration office for options such as a 60-day family visitation extension or a one-year extension based on marriage if they meet financial requirements. Immigration procedures differ by location, and a visit to the Phetchaburi Immigration Office is recommended for accurate information regarding the requirements for a one-year extension.
NON-O RETIREMENT VISA RESOURCES / SERVICES
  • Go to the Retirement Visa Section for information on requirements, including age restrictions, financial requirements, and necessary documentation.
  • For immediate assistance, contact Thai Visa Centre directly via LINE at @ThaiVisaCentre or Email them.
  • Explore recent discussions by using the Non-O Retirement Visa tag in the search box at the top of the page.

IF you need extra time to season the 400K THB in a Thai Bank Account, you can apply for a 60 Day Extension of Stay Based on Visiting Thai Family. At *MOST* immigration offices, you will need:

1. Your passport and a copy of:

- Your data ("picture") page

- Your Non-O visa

- Your entry stamp

- Your departure card

2. Your wife PHYSICALLY next to you, and

- Her ID card and a copy of her ID card

- Her housebook, and a copy of the first page

3. Marriage certificate (either the rose border certificate, OR a translated copy from your home country)

4. The application form

5. 2x passport pictures

6. 1,900 THB for the processing fee.

SOME immigration offices may require a copy of the TM30 filed where you live, or the updated marriage certificate from the local Amphur office for 20THB.

You *WILL NOT* need any seasoned money, OR medical insurance for this extension of stay.

You *CAN* get a One Year Extension of Stay Based on Marriage to a Thai National from this extension of stay (see my comment above)

Different immigration offices have different requirements for a one year extension of stay based on marriage to a Thai national. *ALL* immigration offices will require the following:

400K THB in a Thai bank account seasoned for two months or;

40K THB of monthly income in a Thai bank account or;

A letter from your embassy saying you have income of 40K THB a month [note: not all embassies issue this letter]

The marriage to be formalized with the rose border marriage certificate OR a translated copy (if married overseas).

The wife next to you at the immigration office

The wife's housebook (she'll know what this is)

Your passport and a copy of:

- Your data page

- Your visa (if you have one)

- Your most recent entry stamp

- Your departure card that's stapled inside

Pictures of you in every room of the house

A TM30 filed at your local immigration office.

2x Passport pictures

1,900 THB

*SOME* immigration offices require *SOME* the following documents:

- A hand-drawn map to your house (some require this on a special sheet

- A Google Map printout showing where you live.

- Interviews with neighbors

- Visits by immigration officers

- Witnesses brought TO the immigration office

- A property lease (if renting)

- A document saying you're still married (issued at the Amphur office, 20THB).

- Maybe other documents too.

AT *MOST* immigration offices, you can apply for this extension of stay no less than 30 days remaining on your existing stamp.

It looks like Phetchaburi Immigration Office does not have a website. I see a visit to your local office on Friday. Ask for the handout for the "One Year Extension of Stay Based on Marriage to a Thai National".

You *WILL NOT* need medical insurance of any type for this extension of stay.

Take Tod's advice, those are the only options available. I've been on a non O spouse ME for years but for the first time I had to get a 3 month SE and have since applied for my 1 year extension of stay, currently under consideration. Borders are closed so don't waste your money on a ME visa even IF you can get one, just get a SE and do the 1 year extension and you can get a re-entry permit if/when you can get a flight out.

I believe you are confusing two things (as is who ever wrote that nonsense at the embassy :O )

There is a big difference between buying a VISA at a thai consulate in another country and getting an extension of stay from the immigration office inside the country.

You already have a Non-O visa

AND

if you want to use the visa as it's designed you need to exit/re-enter the country every 90 days (what ever that entails now during the covid shit show)

OR if you don't want to do that;

You come in on it, get stamped in for 90 days (the maximum length of time you can get entering on a Non-O visa) and then you apply for an extension of stay.

At this time you have those three options I outlined,

1 - a year extension based on marriage (by meeting the proof of funds)

2 - a 60 day visit family extension (issued once per entry)

OR

3 - a 60 day covid extension (which you can apply for as long as the program continues [until May 29th right now])

I hate to be the bearer of bad news, but that's the options you have. Hate the message not the messenger. ;)

nope, you can't. :/

That visa doesn't work that way.

It lets you stay 90 days per entry, then you either leave and come back OR you apply for an extension of stay;

You have three choices as far as an extension;

-a year extension based on marriage by meeting the proof of funds.

-a 60 day visit thai family extension (that can be issued once per entry)

-a 60 day covid extension (for as long as the program is valid for)

I'm doing option 1
@Craig ********
. Needed to show funds of 400k in my Thai bank account, banked for 2 months prior to the application for an extension of stay. Obviously, need all the other paper work such as marriage certificate and others..... Then after I was granted the one year extension to stay, I no longer have to leave the country and just do my 90 day reporting.

thanks Andy let you know when ready..

and they visit your house ? thanks...

Craig Johnson. The house visits appear to be random, but a friend recently had a house check up, which he says days was fairly informal, although he did say they spent more time interviewing his neighbours. So whatever you do, don't fall out with your neighbours! 🤣

These are what was needed if you have the 400k. I'm sure Todd will correct it if anything is wrong or missing. Especially for number 11

1) Visa Extension Form (TM.7)

2. Passport or Travel Documents

3. Non-Immigrant Visa (this was the 90 day multiple entry I got outside Thailand and allowed me to come in for 90 days and then leave)

4. Marriage Certificate including the 2nd Page (I forget what it's called)

5. Thai wife's ID Card

6. House register of Thai wife

7. Children's Birth Certificate ( Not needed but I go loaded up)

8. Letter from Thai Bank certified money in thai account (Alien's Name) more than

400,000 Baht 2 months before, bank book and ATM slip on date of application

9. Map to Home (I just printed out Google map)

10. Family Photo (silly photos outside residence, on sofa and sat on bed etc.

11. I'm not sure about this one but I think Medical Insurance. I took along my policy copies.

Believe it or not
@Cr***
EVERYONE on a year-long, multi-entry Non-Immigrant Type O visa based on marriage to a thai (who previously used to bounce in and out every 90 days for the duration of their visa to get a new 90day entry stamp) is doing one of the three extension options I outlined.
Bobby ********
Craig Johnson. Meet the financial requirements for longstay visa, or sweat it every two months for a 60-day covid extension. Word of advice: NEVER let an Embassy tell you what may or may not happen at a Thai immigration office. They are two totally (that means totally) different government departments with different ministers and different polices!
Craig *********
@Tod ********
thanks Todd but received this email from thai consulate Melbourne..

Dear Craig,

You can still apply for a Spouse visa. You can do multiple entries or single entry, either of them can extend in Thailand but depends on the local Thai immigration.

if you apply for multiple entries you can report to immigration every 90 days means you don't need to leave the country but then again it depends on the local immigration whether they are allowed or not.

Please see information below for the requirements.

Non-O Spouse ME

The following documents are required in order to make an application for a Non-Immigrant ‘O’ (Spouse) Visa for Multiple Entries:

Sadly
@Cr***
that is totally incorrect information and you only have the 3 extension choices I outlined :/ I hate it when embassies try to tell people what to do once they're INSIDE thailand on visa entries. It never really seems to be good advice :(

Just need to know if Cha am immigration will do it as cannot contact them..?

and here's a pro tip. DO NOT trust an embassy official OUTSIDE the country about anything to do with visas or extension at the immigration office inside the country
