Can I report my 90-day visa requirement and extend my NON-IMM Retirement Visa in Bangkok instead of Chonburi?

Hi Guys,

I have a NON-IMM (Retirement )Visa (Multiple Entry) that was issued in November 2017. At the time, as this was my first application, I used the services of an agent here in Bangkok. For some reason, and I was not informed at the time, the agent applied for and had the visa issued at Chonburi Immigration. I now have 2 questions, both related:

1. As I’ve been flying in and out of Thailand on a regular basis I have not faced the need, until now, to do my 90 day reporting. Will I be allowed to do my 90 day reporting at Immigration Division 1 Office, The Government Complex, Chaengwattana Rd or will I be required to report at Chonburi Immigration? (Please note I am the owner of a Condo and I live on Sukhumvit Soi 24). Today I tried to use the online 90 day reporting but unfortunately, without providing any reason, my application was rejected.

2. I am looking to Extend my visa for another year at the end of September, this time on my own, 45 days before the current visa expires. Again, will I be allowed to extend the Visa at the Immigration Division 1 office or will I be forced to travel to Chonburi?

Any help and guidance that can be provided by the group on the above would be very much appreciated.

Okay, you have some good and some crap advice here.:O

It's NOT uncommon for agents to get yearly extensions via the back door from the Chonburi Immigration office.

You do NOT need to file a TM.30 living in bangkok so disregard that information.

When you FIRST 90 day report is due, 89 days after you entered the country last take a TM.28 <- change of address form AND a TM.47 <-90 day report form to the main immigration office at Chaengwattana. You want section A. They do 90 day reports and changes of address. File the change of address and the 90 day report at the same time. That will get you IN the system here in bangkok and let you do your 90 day report. KEEP the recipt from the change of address because they'll wanna see it when you go to get your new yearly extension in bangkok because believe me even though you didn't pay any attention to where your stamps came from the immigration office will.

Once you file the TM.28 change of address you're good to use Chaengwattana for your yearly extension application ,.

The reason I know this works is I was just at Chaengwattana last week with a friend who used a visa agency to get his extension based on retirement and his extension stamp was from Chonburi as well. :O We filed a TM.28, then he filed his 90 day report, then we went over to section L and did his new yearly extension. He did have to give a copy of his lease here in Bangkok but everything else went thru just fine. (y)

Regarding the 90 day reports I believe you have missed then as you likely really do not have a Non Imm O Mulit-Entry Visa

I had a similar situation for 2 years. Living in Bkk but visa obtained in Phitsanulok.

Eventually I had it corrected at Chaeng Watana. It took some time as they did not like me living in a different place than what was declared on the visa application. But they did not charge me any fee for not reporting my TM30 (Bkk does not care but many other provinces do!). For the switch of 90 days report, they were happy to do it with a copy of my lease.

You should explain your situation to immigration at CW. They will sort it out. But don't stay in Chonburi's books.

there shouldn’t be any issue on the previous 90 day reports (I hope) as I always flew out of the country before they were due. It was my understanding that the clock started again when I flew back in.

You may or may not get any grief about previous 90 day reports.. But any action is likely not to be drastic.. The Imm Officers in Bkk can handle the fiasco of your Application be handled in Chonburi as you had no control over that.

Which is not a Multiple Entry 'Retirement Visa' but is a very similar status

I know of a case similar to yours where the fellow's 'Visa' filing was in an office where he did not reside... Turns out the reason for that was the Visa Agent knew an Immigration Officer in that other city that could be bribed

You should post photos of the Visa pages with ID info marked out.. the members will show you what it really says.. And the issue of what you have in stamps in your passport has an important bearing on how your missed 90 day reports will be treated.

my bad, the visa states “multiple entry” and is valid until 20th November 2018. The problem still remains the same I believe as I am required to report after 90 days.

Hi Joe, as per my earlier reply, the visa has retirement stamped across it and the re-entry permit shows multiple entry. I last flew into BKK on June 17th without any problem, I have calculated my 90 day report is due before Sep 14. Now I just need to know where I have to report, Chonburi or BKK.

It does not seem plausible that you were issued a Non Immigrant Multi-Entry O Visa inside Thailand period. You must have a Non Immgrant O Visa with a Multiple Reentry Permit.. not the same as you describe.

The agent first issued a non-imm O visa and from there had a Non-Imm retirement visa issued. It clearly has Retirement stamped across it.

Regarding the online reporting not working. You have to do your first report at the office before you are allowed to use the online reporting in the future.

hmmmm....probably OK to use Bangkok...list your Bangkok address ...TM30 not a problem in Bangkok per reports. It is a problem in Chonburi if not filed timely. Good luck!

As I am living in Bangkok I assume that would be the Division 1 office? Unfortunately, until recently, that is where I had assumed my visa had been issued, I never paid any attention to name of the issuing office on the visa. The agent knew my address was on Soi 24, I’m still baffled as to why she issued the visa in Pattaya.

Mine also was from chonburi (pattaya)

My 1st report was last week which i did at udon thani as we have moved.

I told them i moved up there same day i reported and there was no problem.

Changed address and done 90 day report within 15 min.

Cant see why it would be any different for you

I would say the agent you you used did not give your Bangkok address when he was applying for your visa in chonburi. That's your problem.

I’m guessing the agent must have used a fictitious address in Pattaya. This may cause some problems as I have recorded my BKK address on the landing card each time I’ve flown back into Thailand.
