Hi!

Has anyone applied for DTV using passive income (dividends/real estate)?

Is that possible or the workcation only requires active work. This is along with the regular savings requirements fulfilled of course
Answer summary
Applicants for the DTV visa must demonstrate active professional engagement, meaning passive income from dividends or real estate is generally not sufficient. Remote work must involve genuine professional activity, such as freelancing or actively managing a business. There are alternatives, such as the Long-Term Resident Work Permit (LTR WP), for those over 50 with sufficient passive income.

If you are over 50 and have enough passive income LTR WP might be the better visa for you.

Passive income from dividends, rental properties or investments alone does not qualify you for the DTV Workcation category.

Workcation applicants must demonstrate genuine professional activity, such as remote employment, freelancing or actively managing a business outside Thailand.

If you own a business or rental property company and are actively involved in its management, you may potentially qualify as a business owner, provided you can demonstrate your professional role and ongoing business activities.

you couldn't own a company and not qualify, you'd be on the payroll...

Owning a company and actively running a business are two different things. Anyone can register a company, but that alone doesn’t prove they’re actually working or earning a regular income. The DTV Workcation category requires evidence of genuine, ongoing professional activity, not simply business ownership. A company registration certificate alone does not establish eligibility, especially without evidence of actual business operations and income.

yeah, i know a little bit. I own two properties and a business in Phuket.

However on this subject I was merely trying to say, if anyone has a proper company, they will be on the payroll and would get a dtv, as they would be drawing a salary or dividends, or both. It really wouldn't matter if that person actually done any work. Im not talking of these tin pot types who have registered a company so it merely exists, i am meaning something with a real turnover.

Tax doesnt come into what visa anyone holds. It would be totally on the individual as, for instance there would be some retirees who earn way more than most working people, they wouldn't need a different visa, and would be taxed the same as a working individual..

It is best to start with an understanding of immigration law as it is applied by countries around the world. The same logic applies to taxation. There is the principle of self-assessment. You self-assess whether you are entitled to the visa or the tax treatment, even if your self-assessment is accepted by an official, it does not change the fact that it is your responsibility to correctly assess your entitlement to your claims. Thailand has a history of not enforcing the law for a long time, until they suddenly start doing so. Note the recent crackdown on property ownership through "nominee" company structures that existed for probably 20 years, the crackdown probably only occurred due to greater computerisation and data sharing of government departments. Note the DTV is issued by the Department of Foreign Affairs but entry to Thailand is decided by immigration officers who have their own rules and procedures.

its good you know so much.

Myself and my wife got ours on owning two companies about 3 days after release. So there certainly wasnt all you are saying back then.....

It likely wont be considered remote work for DTV. Many have been denied using rental income as that's not considered remote work either. But it really depends on the embassy.

Embassy dependent.

As most conditions.

Passive income isn't work. If you actively manage your real estate you can use that
