Can I apply for a 90-day Non-O visa for being the father of a Thai child if my Non-B visa is about to expire?

Follow up to my post from 2 September. A few months ago Tod advised me "You could go to a Thai consulate in a nearby country and get a 90 day Non-O visa based on being the father of a thai child by using the birth certificate, the mothers i/d and house book and showing 400K baht in a thai bank account in your name only (or the equivalent in an account in your country)". Would it be possible to do this when my original 90-day Non-Imm 'B' is ready to expire on 24 Sept? I am not yet legally married to my child's mother but we all live together. If this is possible, what about Section 4 of the Supporting Documents section on the e-visa application for Vientiane Thai Consulate where it states: "Financial evidence showing monthly income of no less than 40,000 THB or having the current balance of 400,000 THB (e.g., bank statements for the last three months, sponsor letter)"? I would be able to show 400,000THB when I submit the e-visa application, but not in my bank for the last three months of bank statements. Has anyone had recent success in getting a 90-day Non-Imm O visa for a Thai child dependant, and did they have to show 400,000THB in their bank for 3 months up to the date they applied, or just in their account at the time they applied, particularly related to Vientiane Thai Consulate? Many thanks!

TLDR : Answer Summary
The user is seeking clarification on applying for a 90-day Non-O visa based on being the father of a Thai child, following the advice to visit a nearby Thai consulate before their current Non-B visa expires on 24 Sept. The main concern is about the financial documentation requirements, specifically if the 400,000 THB must have been in the bank for the last three months or just at the time of application, especially given that the user is not legally married to the child's mother. Various comments suggest that having the full amount at the time of application appears to suffice, as illustrated by a recent account of someone being approved despite not having the required balance for the full three months.

I got a report today that someone went to the Thai consulate in Savannakhet showed 3 months worth of bank statements but only had deposited the 400k a few days before he went for the visa.

He was approved, so while it appears they do require a 3-month bank statement they do not necessarily require the 400k to be in the bank for those three months

That's good info. Thank you for sharing. Savannakhet could be an option but Vientiane is much more convenient. Please let me know if you hear of a similar case at Vientiane. ๐Ÿ™

The current 90 day non b isn't a problem, it cancels even you stamp out of the country.

Now whether you can get the 90 day non-o based on thai child with a 3 month bank statement where it shows the 400k hasn't been in the account the whole three months is anyone's guess.

Seeing as they only issue single entry non o up there (for any reason), and before they went online you only need to show 400k in your account when you applied, it might work

OR

It might not and you'd be out the 2000 baht application fee. Good thing is, at both Vientiane and Savannakhet you have to go in person to the consulate to pay, so it'd give you a chance to ask them when you're there, and if it wouldn't work you could just not pay and let the app cancel....

can I use my bank account in my home country, rather than a Thai bank account? I think you may have told me I can do that before...

yes at Embassies and Consulates

The initial non o visa would give you 90 days, which would be enough time to season your money, but being not married to your girlfriend means you need to get custody rights granted through family court first and that takes a while.

do you mean for the year extension or for the initial 90 days visa?

Thanks. So no issue for the initial Non-O regarding marital status or guardianship rights?

I think the bar is higher regarding the guardian rights for the Non-O and extension set by Immigration compared with a Non-O issued by an Embassy

@Graham *****
yes, I got the initial 90 days without proof of custody rights.
