Can a Partner of a Non-B Visa Holder Apply for a Thai Visa Based on Their Children?

Good morning, all.

I have a family member that has recently arrived in Thailand and I want to be sure of what I've told her is so.

All British passports. She has arrived with her partner and two young kids on visa-exempt. They are not married and the kids have the father's surname. The dad has been offered a job in the south, Non-b, etc. She asked if she could piggyback off his non-b as a spouse or get a Non O based on the kids. But, as they are not married and the kids do not have her surname I don't believe it's possible. Can you confirm either way? If this is the case, I suggested they get married here. She does not plan on working here because she needs to take care of the young boys.

Strange story. Family of 4 comes to Thailand without any visa, a job offer comes for dad and the relocation to another country is decided in seconds. Now the question comes, do we need a visa to live in that country. There are different options to get a visa:

man gets the Non Immigrant B visa and Work Permit before he starts to work.

The children can piggy back on the fathers visa, if the father is named and has the birth certificates available as proof in Thailand

OR the children can get a Non Immigrant Ed visa when going to school

The lady can get a Non Immigrant O visa based on having children study in Thailand, if she is the mother of the children and has the documents available for proof in Thailand.

They can get married but that needs a lot of documents and I do not think it is possible to pull that off during the 30 days of the Visa Exempt Entry or even with the 30 day Extension of Stay.

Not much of a strange story. Young family, been traveling for a few years, so the assumption of relocation isn’t so. Come to visit a friend and business owner. Get offered a job as he’s short staffed, nowhere to be in a hurry so he takes it. Like James says, sometimes not having a plan is the plan. Thanks for the advice. I’ve passed it on.

Assuming they might get married in Thailand, they need to check with the district office what documents and if witnesses are required to avoid delays. If one of them is divorced, they will need the Degree Absolute at the Emb for Affirmation of Marital Status plus some District Offices need it.
