Hey group! Our family is wanting to move to Thailand for a year and I’m trying to figure out our best visa options. If my husband enrolls in Muy Thai class and I enroll in a Thai Language class could we use the Toddler Overstay Rule for our daughter or is there a better option? She’s only 3 years old so I’m not quite ready to enroll her in a full time school but I want to do this all legally ofcourse! Thank you for the help!
Answer summary
A family is planning to move to Thailand for a year and is exploring visa options, particularly regarding a DTV Visa for themselves and the potential implications for their 3-year-old daughter. There's confusion over the 'toddler overstay rule,' which does not exist, as children under 15 do not face penalties beyond an overstay stamp. The conversation includes advice on applying for DTV visas based on work and study, and the importance of having a proper visa for the child to avoid future entry issues.

My other option for you is look for EOR services that can help you with a work permit plus visa

I have a 2-year-old who isn't on the DTV Visa but me and my husband are. The last time we entered Thailand they threatened not to let her in because we followed this advice. The officer told us they put a note on my daughter's file that says if we don't have a Visa for her the next time we come to thailand, they may not let her in.

PleasantSeal9672 Did you previously stay almost the full 180 days then re-enter after no more than a few days away so effectively living in Thailand on a DTV?

No, this was not my case. There was no problem with my DTV or my husband's DTV. This is in regards to my 2 year old not having the DTV visa

This looks like pretty bad advice but without knowing the question you asked it's hard to respond accurately. There is no such thing as a toddler overstay rule, kids under 15 simply don't get punished for overstay other than getting an overstay stamp in their passport.

How will you support yourselves in Thailand?

Are you legally married?

then you need to apply for a DTV based on Workation. You can't legally work on an ED visa. If you get the DTV and your husband doesn't work remotely he can be a dependant on your DTV, as can your kid. If he also works remotely he would need is own DTV based on Workation

You only need 1 DTV so apply for either you or your husband and then apply for the other 2 under the DTV as a dependent.

Roxanne Cox the hard part there is the 15k sitting in the bank for 3-6 months to qualify but it IS the goal! I'm a web and graphic designer so the proffesional portfolio part should be easy if we want to go for that route (or just sign up for classes.)

if you will work remotely from Thailand then you need to apply for your own DTV based on Workation. The same applies to your partner if he will work

that's the route I would go. If you are already working remotely. Mine was approved in 1 month and then my husbands and kids a month after. I would include a letter with information about your job because they will ask for one. I had chatgpt make me a letter saying I was a freelance tutor and provided my schedule and payments.
