What should I do after my Non-O visa application was rejected on the eVisa portal?

Hello friends, I prepared everything for my Non-O visa (marriage) based on a handout I received from the ladies who sort the documents at the immigration office in Surathani, Samui. On the day I submitted my application, I spoke to an official who told me that I now have to use the eVisa portal, as the immigration office is no longer responsible... (how visa agents handle that?)

I converted my documents into PDF files and uploaded them to the eVisa portal, made the payment, and waited two weeks. Since my residential address is no longer in Germany but on Koh Samui since a few years already, a current photo and a certificate of residence were requested. A few hours after uploading, I received a rejection notice from the system without further explanation.

Question 1: Is there a contact person who can tell me the reason for the rejection? I selected the embassy in Munich for processing.

Question 2: I found different information on the internet about how long the funds (400k) must remain in my Thai bank account – 2 or 3 months?

Question 3: I will try again next week, but 8 days later I have to extend my current tourist visa by 30 days – is there a minimum validity period for the visa in order to apply? Otherwise, I may have to switch to a visit wife visa here.

1: call the Thailand embassy in Munich for an explanation. The e-visa is available for foreigners who are not in Thailand. It would not be difficult for the Munich embassy to determine that you are in Thailand, not Germany.

2: after receiving your Non-O marriage visa, enter Thailand to activate the first portion of the visa. Shortly after entering Thailand, establish your Thai bank account and fund it with B400k.

thanks for your fb! 1: eVisa ist not suitable for me as im living in Thailand fro many years. 2: I proofed my funds already in the rejected application, so i own a thai bank account.

you have two options:

ONE:

***exit Thailand, re-enter visa-exempt, apply for the "change of visa type" from the visa-exempt entry to the initial 90-days Non-Imm-O Family Visa on Immigration. The fee is 2000 Baht. The visa will get issued “under consideration” for 14 days. That’s why you still need 15 days on your entry stamp if you want to apply for the “change”

You need to show a minimum of 400,000 THB in your Thai bank account when you apply for the “change”

And you need to show a minimum of 400,000 THB having seasoned in your Thai bank account for 2 months to be able to apply for the “1-year Extension of Stay Permit”

TWO:

*** exit Thailand, visit any country anywhere in the World including your home country. Apply for the 90-days single entry Non-Imm-O Family Visa through the e-visa online system of the Thai embassy in this country. For this application you must prove that you physically are inside this country!

Wait in this country until the visa has been approved and issued to your email-box as a .pdf document. Print it and re-enter Thailand. You will get stamped in for 90 days

In most countries, you need to show a minimum of 400,000 THB in your Thai bank account for the last three months, when you apply for the 90-days Non-Imm-O family Visa

And after having entered Thailand on the Non-O visa, you need to show a minimum of 400,000 THB having seasoned in your Thai bank account for 2 months to be able to apply for the “1-year Extension of Stay Permit” on Immigration

Good morning! Last question: If I “change the type of my visa,” is it okay to just have a tourist visa, or is it better to have a “visa to visit my wife”? Does it make a difference? – Next week, I have to extend my current tourist visa anyway (I had an ED visa for several years) and could switch to a visa to visit my wife or simply extend it for 30 days. – Thank you in advance.

having been on an ED visa before actually is BAD for your overall stay history. ED-visa are scrutinized, they make Immigration officials assume that you misused them for a longstay in Thailand. Be prepared to be approached in Thai language on Immigration! If you don't understand and speak Thai, you will have a very bad stance in front of them

as you are in Thailand on a tourist visa, you should get it extended with 30 days, and then apply for the "change of visa type" to the 90-days Non-Imm-O family visa. Because in order to be able to apply for the "change", you need a minimum of 15 days on your stay permit stamp. I do not know if this is possible from out of the 60-days extension of "family visit" as this one is not a touristic entry or touristic visa, and the possibility is not listed as being possible on the Immigration website regarding the "change of visa type". You could however visit and ask your Immigration, but it won't change anything in your situation other than you need to extend anyways, because you need those 15 days left on the stay permit, and you also need 400,000 THB in your Thai bank account on the day you apply for the "change", and you need a rental contract and you need to be TM30 registered to receive any service from the Immigration office

Thank you very much for your time and the detailed guideline - You basical confirmed i did anything correct, bring the documents neccessary and just get lost in translation. Unfortunatelly my wife didnt insist either beacuse no one would tell an office he's wrong! Now i have to apply for interrim visa first, beacuse i do not have 15 days left now...anyways - thank you very much!

*** firstly, you need to understand the difference between a „visa“ and a „stay permit“ and an “extension of the stay permit”.

As long as you mix up these two different things, you will always get “lost in translation” when speaking with Immigration officials, who mostly also do not keep these two different things apart from each other. In their bad English, a visa for them is the same as a stay permit, and this is so terribly and technically wrong

The Immigration official probably told you to exit Thailand and apply for the 90-days single entry Non-Imm-O Family Visa by the E-Visa system of the Thai embassy in the neighbor country, as you CANNOT use the E-visa online system while you are still inside Thailand

*** you should have applied for the “change of visa type” from a tourist entry to an initial “90-days Non-Imm-O marriage to a Thai wife Visa”

Pre-requisite for this application is you have 400,000 THB sitting in your Thai bank account (no “seasoning period” required at this point, yet), and you got a freshly printed from the Amphur “Kor Ror 22 or 2 (whichever applies) that proves your marriage is acknowledged and registered in Thailand and is still active and valid. Without you marriage registered in Thailand you cannot achieve a 1-year stay permit based on being married to a Thai wife!

You need to have a minimum of 15 days left on your “admitted stay entry stamp” to be able to apply for the “change of visa type”

***and as soon as the 400,000 THB have been sitting in your Thai bank account for 2 months, you can apply for the “1-year Extension of Temporary Stay Permit based on being married to a Thai wife” (which is NOT anything you call "marriage visa" but which is a simple "one year stay permit")

***the fee for the “change” is 2000 THB, and the fee for the application to the “extension” is 1900 THB. And I recommend you buy a single re-entry permit for 1000 THB for the extension of the stay permit, the very moment after it got stamped into your passport

That's true. Long time ago, when there was no app for the Kasikorn bank but only 'internet browser access', I asked for this in a rather big branch in Bangkok. They really did not understand what I meant. After looking on their internet page, they called it 'Cyber banking'. When I went back to that branch and said 'Cyber banking', everybody had the 'aha moment' and it was done in 20 minutes, ha ha.

You can't apply for an Evisa when you are in Thailand. And NO, using a VPN won't work. I would suggest going to Vietnam as they have a 5 business day processing time.

You say they asked for a current photo and residence certificate. Are you sure it wasn't worded as "proof of current location"? This is required to prove that you are NOT in Thailand. In our case we uploaded our Airbnb receipt, and then they requested further proof so we had to show our passport stamp (arriving in Vietnam) and our boarding pass from our flight (thank goodness we kept them). Still with that request, the approval came on the 5th business day.

Yes it can be done without an agent as many do, just need to plan properly not simply go to an agent

it means you can't apply on the evisa site from inside Thailand. Also not all immigration offices can do in country visas, I don't know about Koh Samui but if it doesn't it may be worth trying the main office at Surat Thani. Failing that you will need to travel to another country, apply using the evisa site, and remain in that country until the process completes

Evisa is not for applying for visas in Thailand. Evisa is for going to a country outside of Thailand and applying through the Thai embassy in that country. If you were in Thailand when you applied, then you were rejected as you should have been.

The immigration officer lied to, or you misunderstood something.

Yes, last time I had all these documents (TM86) with me when I went to the immigration office. Then an official spoke to me for a minute about the eVisa portal... I was really surprised because I had prepared thoroughly and done a lot of research... I'll try again next week.

I think also you need a TM86 or TM87 form. Not the regular TM7 for a year extension. And indeed NO online application, just go to the imm. where you filed y'r TM30. Don't know if Samui accept 'in-country' non imm. O visa.

All extensions are done using form TM7, regardless of length.

TM86 & TM87 are for transferring to an in country Non O visa from a tourist visa or visa exempt entry respectively.
