What should I do about my extended stay and lost passport situation in Thailand?

Hello everyone. So, I recently lost my bag with my passport in it. I needed to get a fresh stamp on Dec 16, but I was without my passport. I filed a police report and planned to start the process a-new.

Unbelievably, I found my bag and my passport was still in it. I can't really find anything but basic descriptions on the embassy site..

So, does anyone know or have any suggestions as to how to navigate this situation? Really stressed that this is going to get me kicked out or pay a ton, or both ๐Ÿ˜“

TLDR : Answer Summary
The poster lost their passport and was concerned about overstaying their visa due to the loss. They later found their passport but were stressed about the possibility of penalties for overstaying. Responses suggest the poster go to the immigration office to pay the overstay fine and request an extension. They should bring their police report and other forms of ID, as well as money for fines and fees. Discussions also warned about the seriousness of overstays in Thailand and the importance of addressing the situation quickly to avoid legal issues.

Great you got your passport back

Dont expect to be granted an extention after overstaying.

Cannot.

When you leave the airport after paying the overstay fine, dont expect to be let back in.

Even if you ask the immigration officer ,'is it ok to come back after paying the fine and doing a border run ? They will look at your passport and say 'yes no problem sir, you will get a 45 day stamp and you can make a visa next time. When you return, Immigration officers will place you in a holding cell and you will be deported.

If you want to go back , I advise you to make a visa 'not a Tourist visa or dont try and go back for at least 4 months.

You are now beyond help from any other authority.

Cannot pay the fine at an immigration office, they will tell you to go to the airport as soon as possible and also advise that if you are stopped by police in between leaving the immigration office and going to the airport you will end up in jail.

It is more likely you will be locked up if you go to the police station asking for a copy of a police report regaurding your stolen bag and passport, which you now have.

I am telling the most realistic scenario of what will happen and am advising what you need to do.

Thai Immigration are cracking down and have been deporting people for less overstay and boasting about overstayers on the news.

Dont expect any special treatment, even if you have been hard done by and have a charming sweet mouth.

Nobody in Thailand and especially at Immigration gives a fร—ร—k about you, except you.

I am telling you this from recent first hand experience.

Im not giving you a hyperthetical idea or mabyes.

Make sure you take all of your belongings to the airport and dont expect immigration to let you back in after a flight to Malaysia and back, even on exit they tell you its ok.

I ended up back in my country 3 deg , jeans flipflops and t shirt freezing destitue, with all my belongings still in a room in Phuket.

Totally fร—ร—ked up.

God speed to you mate.

And dony worry too much, just go straight to the overstay counter at immigration and make sure you have the correct amount of money to pay the fine.

Make sure you go to the police station you filed the lost passport report at, and make them aware you found your passport, as the first thing they do is contact your embassy, and immigration to have that passport voided the same day. If you try to use it for anything you could be arrested for illegal passport, until they get it straightened out. This is serious, and you can end up in jail very easily. I hope you have other official ID to prove it is you. You still must pay the overstay fine first thing. There is no way around that, and it grows by bt500 each day until it tops out at bt20,000. New Years celebrations will have a number of check points all over Thailand starting today.

Just to add what Kool Breeze said about going to the police station. Check if you can get a copy of the report you filed just in case you don't have one already. I don't know if they give you a copy or not. It could be in your favour that you are genuine. To add to what Nigel Rustage said, please don't forget that the police have started with face recognition technology while they patrol at random and I guess they will be more vigilant over the pre and post New Year day celebrations. Just take care till you can make amends on Tuesday.

contact the US embassy emergency services first think today. They will answer even though it is a holiday. They will get your passport situation fixed, or head you in the right direction. Do not for a minute think this is not serious, because it is very serious, especially with the overstay.

Go to immigration on the 3rd January.

Pay the 9000thb overstay fine

Buy the 30 day extension for 1900thb that will be backdated to the 17th.

Dress appropriately

Don't get arrested or stopped by the popo in the meantime as everything will go to ratshit from there on.

Jason, from your profile it appears you're American, which get Visa exempt entries (Not Visas on arrival) which is a good thing for you.

You're on overstay, which is bad. Worse that its going to be a 3 week overstay by the time immigration opens. The good news is you're eligible for a 30 day extension. You'll have to pay probably a 20k baht overstay fine plus the 1900 baht extension, but you shouldn't get in any trouble beyond that.

Good stuff. Leave the bar you're in at 2am sharp. Don't risk it

20k!? What if I just go home instead lol

I figure you're going to have 19 days overstay by the time immigration opens, so that's 9,500 baht fine (I think Garrett is pulling your leg!). Do what he and John have suggested. Attend immigration the moment it opens. Take the police report with you and throw yourself at their mercy. Worse case scenario is 9500 fine and they'll give you the extension. Just one word of warning. Do NOT do anything silly on New Year. If you're arrested for anything, it's curtains. You'll be deported with a 5 year ban.

not going to be getting arrested for anything ๐Ÿ™‚

if they just happen to stop u for anything and ask to see passport then your gonna be arrested. U donโ€™t have to be doing anything wrong to be arrested. The overstay and lack of passport will be the reason they could arrest you.
Garrett ***********
@Jason *********
You're still subject to overstay penalties, 500 baht per day with a maximum of 20k baht.

Is a border run not possible?

With all the advice given here I think you still don't get it. Paying the fine is mandatory no matter what else you want to do to continue living here and even if you don't want to live here, you can't leave Thailand without paying the fine for overstay or face legal action for overstay as pointed out by others

I am getting it, just squirming a bit. There are loopholes for everything else here after all ๐Ÿ˜Š

Gonna pay my fine, get an extension, carry on as planned. Thanks for the advice fellas!

@Jason *********
if your going to immigration the first day it's open after the long weekend, make sure u get there early. Cos it'll be way busier than usual.

@Jason *********
Yeah the loophole is sneaking across the border.

Trying to check in in another country such as Cambodia

Sometimes they don't pay attention to exit stamps. But then you still cannot go back to Thailand.

unfortunately with the law here (or laws anywhere, I guess) when in Rome do as the Romans do. Let me share a little anecdote here. Twice when I returned to Canada from short holidays abroad, I have only a small trolley bag that can be carried as hand luggage in the aircraft. on both occasions I was sent to the RED Customes channel for getting it checked. Needless to say I spent hours in the queue (others had tons of baggage) and even the Customs officer on both occasions asked me why I was sent there. I told them they have to check with the lady who sent me here. Now what do I do! I just had to comply though it was absurd to be sent to RED channel right?

@Jason *********
it seems like you're not understanding that you will have to pay this fine in all cases. 500 baht per day of overstay. You cannot leave the country until you pay. If you show up at a border without the money you'll be put into jail until it's paid. You have to pay this if you apply for an extension, want to do a border run, anything. If you make trouble instead of just paying, then they're likely to ban you from the country as well since you've already broken the law.
Steve ********
@Jason *********
You'll be fined at the airport if you try to leave, and if they get narky, you could get a 5 year ban. Play safe and give yourself up at immigration office
Garrett ***********
@Ja***
Yes, overstaying is a crime. If you don't/can't pay you'll be subject to arrest and detainment in the immigration detention facility until someone pays your fines and buys you a ticket. If you can't afford the fine, contact the US embassy in Bangkok US citizen services, they have emergency repatriation loans available.

what a mess! Thanks for the advice guys, I'll go hit up the embassy first thing Monday ๐Ÿ™

@Jason *********
no point going anywhere near an embassy. You need to go to your local immigration office and have the money with you to pay the fine and the visa extension. It won't be open on Monday, it'll have to be Tuesday
John **********
Looks like you're American so likely on a visa exempt entry not a voa. I'd go to an immigration office, pay the overstay fine and ask them politely for an extension.
Larry ******
My first thought was.....Step 1. Get new passport and continue with process . Step 2. Sell old passport on the black market. Step 3. Profit. But then I realized we are 2 weeks past when you lost your passport and you still have basically done nothing. So.......chok dee kap.
Jim ********
I don't know. But I would say take your police report with your passport to an agency first and explain the situation. Or just wait for the new passport to arrive
