What should I do about my DTV visa situation in Thailand after a conviction related to a nominee business?

Hello.

So im in a bit of a difficult situation. I have been convicted for the business with a nominee, including land. I am on a DTV because before my arrest I never made it to a work permit; the business was quite young.

So in a few months I need to leave for the 6 months dtv run. I have asked immigration if i can travel; they said yes, but they are not sure if I can come back. I have to sell the land, so it's important I come back.

I asked different lawyers and agents what they advise; some say that I can come back without any trouble. I am probably not blacklisted, but the immigration officer at the airport will see a red flag and can refuse entry.

The other offer I've got was via a visa agent to extend my visa i Thailand. I know you can extend your visa in Thailand once per year, so it does not seem to sketchy, but i can't have any fake stamps in my passport thinking it's an official stamp.

Please, do you have any advice or experience through people you might know had the same? Did you hear about this extension service in the country before.

The place where I live, they almost do no extensions for the dtv..

And please, no judgement comments; this case is not black and white unfortunately, but a big part of getting screwed and some naivety from my side.
Summary so far
The original poster (OP) is facing difficulties due to a conviction related to a nominee business while on a DTV visa. They need to leave Thailand soon but are unsure if they can return without being flagged by immigration. Various commenters recommend seeking formal legal assistance instead of relying on agents, as well as exploring options to extend the DTV visa within Thailand instead of leaving. Concerns about whether the OP is on a blacklist or needs to provide documents when re-entering are discussed, highlighting the complex nature of visa regulations and immigration enforcement in Thailand.

Since the market is flooded now with land, houses, condos, the market has tanked massively. considering you only have 6 months to sell… i can offer you 500k baht for it.

Anonieme deelnemer no course means your purpose of visit does not match your visa, so it would be impossible to do an in country extension at the moment, and when you do a border bounce IO might check and see a red flag as you stated yourself.

Anonymer Teilnehmer i dont have any business in thailand and would never ever go down that route. money is better kept and invested and earned in the western world… my partner = my girlfriend 🤣 i work remotely for european companies, same as most people on DTV workcation. completely legit.

your dtv is based on what exactly? softpower? do you visit the gym or whatever you stated in your application?? workcation? do you still fulfill the workcation requirements? or did you leave your old job to build a business here?

why do you have a thai partner? You also have a company on DTV? like me? That would mean you also don't have a reason to have a dtv as you just stated?

you wont get a DTV extension if you cant proof all documents again and actually have a business in thailand… i wonder why they have not canceled your visa yet in that situation.

Anonymer Teilnehmer and your DTV is on softpower then i guess. Because workcation is obviously not for local business. For an extension you will need the same documents again as for your application. But freshly dated. Plus some additional documents for residence proof. depending on the immigration office.
Dany ********

Anonymer Teilnehmer so currently you have no reason to even have a dtv. extension is then impossible in a legal way. and re-entry is up to the officer. maybe flagged for a re-check on entry.

Yes i know the dtv is not for working here or doing business , i was in the process of getting the business visa and work permit and got arrested before that was finished. I have to say again. I was not working illigal on my dtv and i was also not charged for that or convicted.

Get a lawyer. In any case even if you can't come back on a dtv, you can come as a tourist and extend so you'll have 60 days. Try to sell the land within that time. You can at least get an agent to advertise for you, etc.

First, how do you still have a valid DTV? You violated the terms of the visa by setting up a business Thailand and working inside the country when the thing plainly says, "Work not allowed."

Second, where are you finding these lawyers and agents saying you should have no problem getting back in? Get yourself to a high-level firm in Bangkok. He can be a bit insufferable in some of his YouTube videos, but I suggest that Benjamin Hart dude. I believe his firm is called Integrity Legal. Don't go messing around with some guy in a moldy office stuffed between a massage shop on one side and a manicure/pedicure on the other. You need serious legal help if, at the very least, you don't lose out on the land because you got booted.

IMO, you have a serious problem on your hands, and I wish you luck.

A. Nony Mous i don't know how. I was advised i could do this and followed this lawyer. During my interviews and at court, no one ever mentioned that I did not have a work permit. And to be clear, I did not work. My case is already finished, and i have my sentence, so I don't understand how i can be in more trouble unless i don't follow the court order?

Anonymous participant If you were not prosecuted for working without a work permit, you are clear of that. I would keep clear of that lawyer who's been giving you advice about the work permit and business visa being in process. The official track does not work like that. We don't need to go into it here but there's a straightforward process for obtaining a B visa and a work permit through official channels.

Try to extend your DTV first. If it fails, then buy fast track or VIP or whatever they call it for entry at the airport. You could also use a land border with a company that organises those trips. But whatever you do, don't do that on your own.

I extended my DTV (workcation) by myself and found the process to be very straightforward. Some of my friends who also remote workers extended their visas without any kind of hassles. I don't know the situation for people on Soft Power.

As you have an ongoing case in Thailand, I'm not sure leaving the country is a good idea. It may be perceived as if you are trying to escape the Thai law.

After all, how do they know you will really come back? It will be your words against a scenario that they have already seen too many times. And at this precise moment... As a convict, your words are considered the words of a liar.

Avoid making your situation worse. Extend in the country.

I wasn’t in your situation but I always have a lawyer everywhere I move. I can recommend juslaw & consult as lawyers in general. I would also like to know a bit more what happened you said in some comments you were with some other investors and bought land? Was it a business you planned? Like a hotel or something? And they let you stay and let you sell? That’s quite fair and far from the headlines that at a minimum deported the convicted and made them pay a fine.

Anonieme deelnemer 967 no we were not together in business, but we were all linked to the same nominee. So they arrested a group of people, including me. I own a small plot of land and one house. I think because we were with a lot, they made a deal with us yes. We've been told by police that we would not be deported out of Thailand because of this and they gave us 6 months to close the company and selll the land. I also got a fine and 1.3 years jail on probation.

If you do have a lawyer you have chosen already then I’d ask them to call the investigators to make sure so you’re not considered a flight risk. But if there is no court case and you got time to close down company etc then I guess you’re good to go.

Also I’ve heard from plenty people that renewing inside the country is now possible aslong as you have all the docs again.

Your local Thai Immigration Office was already determined earlier by where you filed your TM.47 Report of 90 Days Continuous Stay inside Thailand, so where is your local Thai Immigration Office??

Anyone who had made Entry into Thailand on a DTV Entry stamp with their DTV E–Visa PDF File Hard Copy Printout can Apply for a DTV Extension of Stay at their local Thai Immigration Office inside Thailand

Also, could also go to your local Thai Immigration Office to see if you could be able to Apply for an in–country Change of Visa Type from DTV to something else ( Non–B ) at your local Thai Immigration Office or not

otherwise, directly contact the Thai Embassy/Thai Consulate that issued your current DTV E–Visa about cancelling your active DTV E–Visa if you are planning on Applying for a different Thai E–Visa within the next 4 years (or until the expiration of your current DTV E–Visa)

At which Thai Embassy/Thai Consulate (where) did you Apply for your current DTV E–Visa?

What category of DTV E–Visa do you have?

This is the first time I’ve heard of this type of situation, I think you have to sort out selling land and getting clean and then you shouldn’t have any more worries . You said you have a few months until you need to leave the country for your six months , so try and get everything done before then. What is your exact situation? Have you been convicted already? Or you’ve just been arrested and the court case hasn’t happened?

What are your fellow business partners doing? If you are currently not under arrest in Thailand then you should be fine to leave and on coming back unless something has changed. They will either refuse entry or let you in, both of which sees you as a free man .

So They allow you to sell

The land and recoup your

Money? That seems very nice of them. I thought they are confiscating land like this and deporting people ?

Anyways without selling it you could hire a lawyer to help you get a land office registered thai usufruct for life or 30 years. This is registered and printed on the Chanote at local land office and really the safest most legal way to have a long term ( but temporary) right to land in Thailand . It still Requires a thai owner for when you die and it cannot be inherited or passed On. This is designed so that all land ends up back to a thai citizen in the end . It’s very smart and I wish my own country did this. I don’t know how this works in this particular situation as you need a thai owner 100% I assume . Not sure a company under scrutiny can sign the usufruct rights .

Usufruct is better than a lease and gives you legal

Rights .

Even if the land is sold

The usufruct cannot be removed without your signature. This would have been the best option for you as a foreigner all along .

You can own a condo or have a lease or a usufruct and that’s it really .

A lot of people have done these nominee setups and had hired thai law firm to make it legal and safe . They agents and firms should be held accountable.

It’s better to just invest in your home country and create a passive income

That allows you to rent here . Or maybe buy a condo.
