What long-stay visa should I apply for in Thailand after a short visa overstay and with intentions to study Thai?

I am posting in this group hoping for some guidance regarding a previous brief visa overstay in Thailand and my intention to return this year under the correct long-stay visa category. Hopefully the DTV soft power visa Thai language model.

I have had a close personal connection to Thailand since 2010, when I met my late wife of 11 years, Saifon. Over many years I travelled regularly between the United Kingdom and Thailand to spend time with her and her family. Saifon also lived here with me in the UK for seven years, where we built a business and a home together with our two dogs, Lucky and Harry.

After Saifon returned back to stay in Thailand around 4 years ago with lucky and harry who we flew over to be with her. We purchased land and built our home on Koh Larn Island near her family. This property has since been signed over to Saifons mother after her passing. We had just started the process of adding my name to the ownership deeds but saifon became to ill to travel to the city hall building after our first visit to begin the process. Saifons mother has told me we can still add my name to the deeds but I need to be in the country to do so.

Due to work commitments in the UK, I continued travelling back and forth on just tourist visas with extensions with a few visa runs to Cambodia as was allowed at the time and therefore I did not previously apply for a long-stay visa because it wasn’t necessary.

Sadly, Saifon was diagnosed with stage four lung cancer in April and passed away in October 2025. During that period I was caring for her, I unfortunately overstayed my permitted stay by approximately one or two days due to the immigration office being closed over the weekend and national holiday on the Monday when I was extending for a further 30 days. I was still granted the extension minus the few days I overstayed. This was entirely unintentional and occurred during an extremely distressing time. I complied with all required procedures at the time.

I now wish to return to Thailand for a longer period in order to:

• Maintain close ties with my late wife’s family

• Help care for our two dogs, who are currently being looked after by my mother-in-law

• Spend time managing matters relating to our property in Koh Larn

• Enrol in a recognised Thai language school to improve my Thai speaking ability

I believe I meet the financial requirements for the Destination Thailand Visa (DTV) and would like to enrol in a 12 month rolling program in a Thai language school. I would be grateful for any advise on whether this would be the most appropriate visa category in my circumstances, or whether another long-stay visa would be more suitable.

Additionally, I would be very grateful if anyone could advise:

• Whether my previous short overstay may affect my ability to apply for a long-stay visa.

• The correct department or email address to which I should direct this enquiry.

Thank you very much
Answer summary
The post discusses an individual's intent to return to Thailand for a long stay after a brief visa overstay during a distressing time. They seek advice on whether the Destination Thailand Visa (DTV) is suitable for attending a Thai language school or if an ED visa would be better. Various comments clarify that the DTV is not intended for language courses, suggesting that an ED visa is the appropriate option. The post also touches on the potential impact of the prior overstay on future visa applications, which discussions reveal may not affect eligibility for long-stay visas.

You can get a DTV with thai language you have to contact the school you wish to attend to see if the can offer it - not all language schools will in chiang mai i know personally of

"We Learn thai" and "Chaing Mai University Language Institute " i have spoke with them personally and both offer ed visa and DTV with their courses

It will be up to you to contact schools in the area which you want to be to find who is approved for DTV if they are approved and habe DTV holders chances are they have a dedicated staff member who assists with the application process

Andrew Romine good info thanks.

Visiting a language school does not make you elegible for the DTV. However you can look into the Non-ED visa. You live in close vicinity to the government approved EASY ABC Language School in Pattaya. Enroll with them for seminars for Thai, get the correct paperwork, and apply for the Non-ED and the extensions. Google for EASY ABC and contact them

Greg Alexander incorrect you can get DTV with thai language you have to contact the school and see if they are covered

Andrew Romine your reply is the sort of misinformation one can expect from somebody who helped to vote that incompetent POS into office

Andrew Romine read Brandon's reply. You cannot get a DTV when booking a language seminar. Some "soft power" activities are linked to language schools, but this doesnt mean that doing a language school makes you elegible for DTV

Andrew Romine no you cannot . .Read Wannikea Wanblee's reply: "Thai language is not a DTV activity. A few DTV appoved facilities have blended Thai language into another course such as Muay Thai. Do your research." . . . . . . . . . . . . . . .The DTV doesn't cover learning Thai so he would need to either sign up for a suitable soft power activity (Muay Thai, Cooking etc) or have a job that you he perform remotely from Thailand

The overstayed you check out already when the immigration clear this whit a extension, then you not have a overstay, so this not influence in the new visas applying.

Foreigners cannot own land in Thailand. There is an option to build a house and lease the land for 30 years from your mother-in-law, but you will never own the land.

Ian Morrison You can own the home itself but not the land - if the plot is in an area where they allow building and land ownership to be separated. Many couples do it this way and create a usufruct contract regarding the chanote for the land.

The overstay is of no consequence. At your age the only options you have for a longer stay are to get a job in Thailand, get the Thai Privilege (Elite) visa, the DTV or an ED visa. The ED visa is monitored for compliance so they check your attendance at class every 90 days and if you don't attend you won't be able to stay longer. The DTV doesn't cover learning Thai so you would need to either sign up for a suitable soft power activity (Muay Thai, Cooking etc) or have a job that you can perform remotely from Thailand.

thanks for that info. i was assuming taking a thai language course could get me a DTV ?

For a Thai language course you should get an ED visa, the DTV is for things like Thai culture although there are a couple of places offering a blend of culture and language.

yes. Im getting a crash course in these Thai visas available. Each have a few obstacles . I'm considering getting the 6 month METV and getting a 30 extension on each 60 stay? That would give me 9 months .

Taking language classes would require i stay in one place for the duration of the classes.

You’ll need an ED visa for Thai language not a DTV

The overstay is insignificant and a non issue. Thai language is not a DTV activity. A few DTV appoved facilities have blended Thai language into another course such as Muay Thai. Do your research.

Since you plan on staying in one place the whole year for the 12 month language classes the DTV looks best for you.. If you were going to travel around thailand a few months in different locations then go for another visa. I think your required to go twice a week for 2 hour classes for the whole year? Some language schools will do the paperwork for you. it will cost ??

Larry Wheeler Visiting a language school does not make him elegible for the DTV

Greg Alexander yes i agree. the DTV locks you into one area which is fine. i was looking at Thai language courses in Bangkok.

Owen (I have no idea why people use translator for their name when they are asking questions in an English Language group). A very long-winded post to ask a question. Something to keep in mind - a DTV is a tourist visa, it's not considered a long term visa. It is not applicable to language courses - for that you will need an ED visa. You've put together your life story but not once mentioned your age. Have you considered a real longstay visa, such as non-O, LTR or Elite? Having a DTV means you cannot have a bank account in Thailand, which you might find very restrictive. My advice is to look at the others

Stephen Howell (my wife made the facebook account and chose the name for me and I never wanted to change it). I’m 40. I’m open to any visa (except elite, cost to much) that’ll allow me to stay longer than what’s allowed with a tourist visa only but I really do want to go to a language school to improve my Thai speaking skills.

ผมชื่อ โอเว่น คร้าบบบบบบ ED visa is best for language. You can get DTV on a number of other options and still study Thai language, but do keep in mind the restrictions of the DTV
