My husband has just obtained his working permit from the Chaeng Watthana office in Bangkok.

I would like to apply for my non-immigrant O visa, but I do not have the complete list of papers to provide…

Could you help me complete this list?

Copy of marriage certificate + Thai translation

given you're on a Covid extension now your best option to remain inside Thailand is to try and get another Covid extension for 60 days which will cover you until you can apply for the Non-O. Or fly out and back getting a Non-O before coming back?

You have a lot of critical points in your timeline.

1. You have to have to be on valid stay at least 15days or more at CW to be able to apply for your in-country Non-O.

2. Your husband has to be on 1-year extension when you apply for in-country Non-O. Means May 5th. <- means you don;t have enough days even you get another Covid extension.

What you can do are:

A. You need to try to apply for one more Covid extension just before your current one is over.

B. meanwhile, check with CW if you can apply for your in-country Non-O after he approved his 1-year extension and before his first 90days's up: 20 March - 1 May)

(He is able to apply for 1-year extension with his current stamp is 45ays or less at CW, so March 20)

* you need to have 15days or more with your stamp so that you can apply for in-country Non-O visa. SO even you can get another Covid extension, the last day you can apply is 2 May.

IF A or B is not possible, you cannot apply for in-country Non-O in time. You need to leave.

He needs to apply for Non-B visa first and get tamped for 90days from entry (in case he got it at the Royal Thai Embassy/consulate) or insurance (in case he applied in-country Non-B visa at the local immigration office). Before his first 90days finish, he needs to apply for a 1-year extension of stay based on employment.

You can apply for your in-country Non-O trailing spouse to your husband who is a foreigner and legally working in Thailand only when he gets 1-year extension, not during his first 90days from a Non-B visa.

I believe you need the following documents to get an in-country Non-O Visa Based on Being a Trailing Spouse or a One Year Extension of Stay Based on Being a Trailing Spouse. I believe the documents are similar:

1. The applicant’s passport and a copy of:

a. The data “picture” page.

b. The most recent visa (if applicable).

c. All entry stamps or extension of stay (if applicable) since arrival.

d. The departure card (“TM. 6”) that should be stapled in the passport.

2. The Extension of Stay Application Form (“TM. 7”).

3. A copy of the submitted Notification of Residence of Foreigners form ("TM. 30”).

4. The spouse physically next to the applicant, and:

a. Their original passport and a copy of their data “picture” page, and their extension of stay or visa.

b. If an extension of stay has not been acquired, the same paperwork required for the spouse’s extension of stay.

5. The original, and a front and back copy of the marriage certificate. The certificate may need to be translated using an approved translator from the Ministry of Foreign Affairs.

6. [EDIT]: For employment, the documents from the employer. The employer will be familiar with the documents required.

7. 2x passport sized (4cm by 6cm) photos.
