What are the current TM30 requirements in Chiang Mai for someone living without a lease in a partner's house?

Current requirements for a TM30 in Chiang Mai - didnt know about ID and Tabien Baan as Ive always been in managed condos before where Im now on a private house. Neither are a problem.

My question though - what if you don't have a lease? I don't have one, Im living with my partner in a house she owns.

Should I fake a lease or would a letter explaining the situation suffice in its place?

For those who are not Thai and have a Thai spouse owning the house where you stay it can be a issue if your Thai spouse happens to be away when you arrive back and need a new TM 30.

Many are unaware that Thailand allows usufructs. This allows the non Thai spouse to be named in the owner house registration book.

Then all one does is bring the house registration with copy,one's passport with appropriate copies of required pages to Immigration to receive a new TM 30,

I don't and unfortunately different amphurs have different requirements to get one.

Just so you know, the yellow house book doesn't convey any ownership it just states there's a foreigner living there.

Some DLT's and banks won't accept it as proof of residence. Honestly it's about as worthless as that foreign thai i/d card is here. ;)

This yellow book information sounds like a solution to always needing a Cert of Res, i.e. Drivers License, buy sell vehicle, etc.

I'll search the internet for "how to obtain yellow book" IF you have any hot links I'd appreciate it.

I am so glad to have read this thread. I had heard about people forming a company so they could have a form of title for a house but this is exactly what I have been hoping to find.

Tod,my wife has her own homes as do all of my in laws. They wouldn't want to live with me should that occur. No,I didn't supply the monies even for the current ones. Some Thais are very successful.

The Usufruct was my wife's and families and their attorneys idea to protect my interests. I had not heard of one before it was suggested to me.

^ What Tod said. Why would you want to stay in your wife's house after divorcing her? Apart from it being a suicidal move (in my case) surely you'd want to move on?

, Any foreigner can get a yellow house book even if they just rent an apartment.

It doesn't confer any ownership rights it only states that a foreigner lives at XYZ address.

You certainly don't need an Usufruct to get a yellow house book with your name in it.

Another point is, even if you have legal right to occupy a piece of property should your marriage go sideways etc. Why on god's green earth would you want to continue to live in and amongst the in-laws and out-laws that comprise your ex-thai significant other's extended family?

Tod,the yellow book. My wife arranged it for a number of reasons. 1. It allows one to live in the house for life. 2. It is easy to do. 3. If my children should inherit the house,presumably they will not " kick dad out" but the Usufruct is structured so they cannot.

4. It's not done to get a TM 30 ,although one can get the TM 30 at Immigration...It's done with non Thais who have Thai spouses who are the ones who obviously own the Thai property. It provides the non Thai spouse a legal right to live in the abode even in the event of a divorce. 5. It is done by many knowledgable individuals who are in the above no. 4 category. 6. If a non Thai is in the above no. 4 category and the marriage is dissolved by divorce she or he will be looking for another abode to live in without a Usufruct . 7. The Usufruct is obviously in effect long before one gets a TM 30. 8. I find it nice to have. If my wife is in Europe and I arrive back here with a new visa she doesn't have to be present to obtain the initial TM 30. I can do it since I am the " house holder".

David Broadfoot I realize that. What if you your self want to do the first one ? That's where the Usufruct comes in handy. You are listed along with the Thai owner in the house registration. If someone stays with you then you can take care of their TM 30 also.

Tony,have you considered a Usufruct ? Allows you legal right to stay in the house. You can save a trip for your wife and do it yourself.

It says (if renting) so if you’re living with someone and not paying rent then you wouldn’t need a lease, or any kind of rental agreement.

Id card and house registration is from your partner, LEase agreement, rental agreement if renting is not needed as you are not renting. To be sure let your partner write a statement that you live on this address.

It wouldn’t be fake but you can just create a lease between you & her. I wouldn’t complicate it by writing a letter. They wouldn’t get it 😂
