Hi

Ive just been told by the owner of the accommodation I've booked that he will not issue a TM30 because it's just 5 days. Is this against Thai Law. I want it to get a residency certificate to open a bank account. Can anyone please advise. Booking.com already taken my money as travel tomorrow.

Thanks
Answer summary
The accommodation owner is legally required to issue a TM30 form for any foreign guest within 24 hours of their arrival, regardless of the length of stay. Many users confirm that not providing a TM30 violates Thai law, and suggest that travelers seek alternatives, such as booking a licensed hotel that will comply with these regulations. There are also options for registering directly with immigration or using a local agent for assistance. Ultimately, the consensus is that if the owner refuses to comply, it is advisable to switch to a legitimate hotel that will provide the necessary documentation.

Leverage the Law:

Send a polite but firm message to the host. Remind them: "Under Section 38 of the Thai Immigration Act, landlords face a fine of up to 2,000 THB for failing to report a foreign guest within 24 hours. It takes less than 5 minutes to complete on the official smartphone app.

"Book a Hotel Night (The Fix): If you absolutely need a TM30 for an immigration extension and your current host refuses, check into a licensed local hotel for your final night. The hotel will automatically upload your details to the immigration system at check-in, overwriting your old location and giving you a valid, legal address record.

File it Yourself (As a Last Resort): You can physically walk into the local immigration office with your rental booking confirmation, your passport, and your host's contact information. Explain to the officer that the landlord refused to file.

Immigration will often call the landlord directly on your phone and threaten them with a fine, forcing them to comply.

I travel a lot and you have to do a tm30 within 24 hours of where ever you stay only way around it ,is if you

got thai partner or friend who books hotel in there name. If hotel you staying dont want do it dont worry its one less paperwork , but it is a problem if your just arrived here cos you have to report within 24 hours on arrival , which that address should really match what you put on the DTAC and TM30 will also be needed if your getting a visa for future , every person is different my Tm30 is registered my brothers, but sometimes i stay hotel they do the TM30 so i also get a copy from them so i can show all the millions of TM30 that i do, its crazy really everytime i go away when i get back i have to do tm30 again at my brothers within 24 hours after traveling around ,i am doing what there visa rules are . But the paper work for TM30s are crazy for each place i stay , i think its funny esp when i give all the copy of all the tm30s with my paperwork for visa , thats how they want it , so thats how i play there game with a big smile at immigration everytime lol if the dates dont match up for the times you stay at hotel , or they wont do tm30 , just tel immigration you could not find resort or hotel so you sleep in car lol

Learning that some countries have laws of convenience while other have laws for strict enforcement will serve people well. A country in the “convenience” mode likes having laws on the books it can fall back on “when the desire or subjective need for enforcement arises”, . That need is most often based on situational circumstances, local interpretation and who the offender is. Those people that come from countries that try and strictly enforce all laws as a required way of life have a difficult time understanding this. I am not condoning anything as right or wrong but having learned to understand what kind of enforcement goes on in the country you choose to live in is helpful.

A lesson here for anyone else entering on a Non-O and needing to open a bank account as soon as possible to transfer the required funds to season for two months to apply for a 12 month extension. Book a legitimate hotel for a few days who will file and give you a copy of your TM30. Ask them before booking to remove any doubt.

The fact is that many non-hotel accommodations don't comply.

I think immigration can issue it if you show evidence of where staying - they send you to another desk.

Many accommodation owners dont follow the law - and expect YOU to pay any fines for their failure to comply.

If the renter is not Thai then it's probably because they should not be renting and don't want Immigration to find out that they are running a business. You can try to register yourself but normally you need documents from the renter.

Message him politely to let him know that booking.com customer service has advised you to go to the tax office in order to collect the documentation on the unit. This should be enough to either get his ass to cooperate, or to cancel your booking with a refund.

He has to issue Tm30 for the period you are staying by law since you are a foreigner. Otherwise it is illegal to host you.

You know, I watch these questions and answers with amazement, you get all kinds of differing replies, and it makes me laugh. It especially makes me laugh when people come here to ask about this kind of thing, when they could quite easily go online to the official website. And when they don't get the answer they want, they simply ask again, until they get the reply they do want. I used to work with someone like that, there was no point in them asking, simply because they'd already made up their minds what the answer was.

Depends what visa you are coming on and hoping to open a bank account with.

I didn't show a tm30 or residence certificate when I opened any of my bank accounts!

They were more interested in ensuring you had an appropriate visa and that you had an certificate to show that your telephone was registered in your name

Sounds like an airbnb rental. Many owners don't ever declare the income, so don't want to do the TM30. You could try a regular hotel for one night, but ask first if they will give you the TM30. By law, they are supposed to.

Thanks for your answers. I am on a Non O marriage visa. The location is Hua Hin and he is adamant he will not give me a TM 30. I booked it on booking.com and leave the UK tomorrow. I've been advised that I could get a residency certificate for a short term stay. I can't cancel now and money has been paid.

It’s against the law as the landlord is required to register you at immigration within 24 hours of arrival.

Please go to the immigration office and tell them that the landlord refuses and most probably the immigration officer will call the landowner of his duty.

Don’t know if you have a long term visa as you can’t open a bank account on a visa exempt entry and most probably not in a tourist visa.

Whether it is against the law or not, a bank will not accept a temporary residence. You need a contract of location.

1) what visa are you on? Even if you are on a tourist visa and have a resident certificate the bank will not approve it. You have to be on a Non B or Non O visa. Not a tourist visa.

If you need it go to a local agent and ask them to register you it may cost about 500 baht but it will be done and then you can chance your arm on getting a bank account which as said will depend heavily on your type of visa etc. Btw if you want I think you can either go to Jomtien immigration or do it online yourself.

The last time I was in Thailand most of the small guesthouses didn’t even ask for ID. I’m wondering if the government departments over there are now data-sharing with their tax office or something. Maybe it’s a tax dodge since I pay in cash. Along with private homes I reckon the government over there only knew where I was for a handful of days out of the 30 I was there.

I've heard of several accommodation owners refusing to register a tenant for TM30 - a friend moved apartments for that reason. Its is their responsibility but its you that gets the fine. You could maybe ask immigration what to do but I doubt they will do anything. What you should do is report this issue to Booking.com and demand a refund as the landlord is acting illegally. You need to find accommodation that will register you.

Not sure on the part of do they have to with a 5 day day but I think they do after just 24 hours. However the bank account part I have had no luck with and I walk in with the certificate, with the DTV, with year long lease, the tm30, and the baht and zero luck yet in that Thai bank account 😂

Yes it is against Thai law. He is renting for less than 30 days, and doesn't have the correct hotel license, breaking the law, and feels if he files a TM30 he will be caught operating illegally.
