ORIGINAL POSTER
I have a live-in myanmar maid who helps me care for my Alzheimer affected Thai wife of 80. I thought she was here with a work permit approved by the agency who referred her. I have contacted that Company. Usual store. Not their problem any more. Can someone point me in right direction to get this sorted, as I believe I can be fined if discovered hiring an illegal worker.

TLDR : Answer Summary
The user is seeking help in legalizing the work status of their Myanmar maid who is caring for their Alzheimer-affected Thai wife. Concerns were raised about hiring an illegal worker, with comments suggesting contacting a local agency for advice on securing a legal work permit, considering a visit to the Ministry of Labor for guidance, and understanding the special arrangements available for Burmese domestic workers.

And I close it down. I still say the Ministry of Labor is the place to start the journey to get the information you need. You can ask a Thai friend or nice neighbor to call and translate for you. You do not have to visit in person to get the information. Good luck.

I just saw she is living with you. Did you file a TM30 for her yet? To file a TM30, you'd have to see her passport. What's her current visa?

Since 2014, there was a ban on migration of domestic workers from Myanmar to Thailand, so they could only migrate illegally and get registration (pink card) once here in Thailand. Myanmar has now announced to lift the ban. Your domestic worker has probably a pink card that is going to expire on March 2020, as everyone else. The two options are either to get a new pink card in your name or better go back to Myanmar and come back through MoU, that now should be possible. You can go to an agency. You can get some information at Homenet NGO, she can also check App Golden Dreams or facebook page MissMigration . I also sent you a PM.

Odds are she is legal at the moment, but the government in their wisdom renews most work permits for migrant labourers at the same time every year - March. If she is legal she’ll have a passport with an Non immigrant LA visa stamped into it, as well as a ID card sized work permit. Both will be valid through to March.

if she is doing a good job, help her. Just dump her only brings her into more problems and is not a humane way of dealing with people.

But who am I to judge.

Visit the Ministry of Labor and ask what and how to do, after all that Ministry is the one that hand out work permits for foreigners.

good call...

So you say best option is to kick her out on the street and her problem how to survive is a better option than a visit to the Ministry of Labor and ask as retired person with a care needing wife if it is possible to hire a live in Birmese maid?

This to avoid that his Work Permit get cancelled?

He does not have a work permit.

working illegally and not saying anything isn't exactly a recommendation for hiring someone.........employers hiring illegals can have their own work-permit and visa cancelled for breaching the law.........and ignorance is no excuse.

there's an MOU between Thailand & Myanmar enabling the workers easy access to affordable work-permits and visas. The Agency can't issue a work permit for her, if they do that she becomes their employee. If you need help making her legal she should know an agent to do it for her..........I'd ditch her tbh if she's been working illegally and the agency never said anything. Ditch them too.

What province are you in?

It is their problem, they took a fee to send out an illegal alien to work in Thailand. I'm sure immigration would like to know about this agency.

It should be easy to get her legal yes use and agent is the best way.. By the way. Normally no one will control her...

Hire an agent used by the Burmese to do their visas. Now is the sign up time. They get LA visas under the migrant labour programme. Most of the info will be in thai so just get the agent via the Burmese community grapevine

The right direction to get this sorted is probably gonna be to cut her loose and find someone that's actually allowed to legally be here on the correct visa and work permit.

I got nothing at all, BUT your maid being burmese can look on a burmese language f/b page certainly she's not the first illegal burmese here.

What type of VISA does she have to be here?
