Im considering DTV after all these past years i ad No-B in thailand . Anyone had similar situation that lived and worked in thailand under own company and now switching to DTV?

Im the director of my own company but now i wish to discontinue working - just want to have stable visa

Any suggestion:

- do i need to apply from home country ? Is there any rules?

- do i need to cancel first the Thai work permit or it will be invalid automatically without doing any thing ?

Thank you for relevant answer !
Answer summary
The post discusses the potential transition from a Non-B visa to a Digital Nomad Visa (DTV) in Thailand, particularly for someone who has been a director of their own company but wishes to discontinue work. Users advise that switching is possible but requires some steps such as cancelling the work permit and ensuring the current visa is closed. Generally, the DTV must be applied for outside of Thailand, and the process can involve complexities compared to typical digital nomad applications. It's also suggested to consult a lawyer to handle the technicalities, ensuring compliance with immigration laws.

Close your company, cancel your work permit and extension of stay. Leave Thailand and apply for the DTV

A lot of people are considering the same transition from Non-B to DTV.

From what I've seen:

• You generally need to apply for DTV while outside Thailand, as DTV is not typically issued from within Thailand.

• Regarding your work permit, I would not assume it becomes invalid automatically. If you're closing down your employment relationship or company role, it's usually best to properly cancel the work permit and make sure your visa status is handled correctly.

• Since you're currently on a Non-B and have a company history in Thailand, your case is a bit different from a typical digital nomad application. I'd make sure your company, work permit, visa, and tax situation are all aligned before making the switch.

Out of curiosity, are you planning to apply through the Workcation route or Soft Power route?

thanks for the comment . Im considering soft power .

My new visa renewal is coming , that’s when im planning to apply for DTV long term… every year visa tax wp audit employee benefits too much accounting company charge … DTV seems so much hassle free

Shammee Akter Sounds like you're at the stage where you're deciding whether the switch actually makes sense.

Out of curiosity, what type of company do you currently have and do you still have an active work permit? Feel free to send me a message if you don't want to share the details publicly.

Are you closing down the company too or resigning as director etc?

plan to resign from Director position. Not closing company though .. Can this justify enough for DTV , or is there any rules against it ! Thanks

Shammee Akter Resigning as Director should be enough. Do you even need to tell them though unless they ask for it?

Yes, you can switch from a business visa to a DTV. We're doing this now, but we're still in the process of getting a DTV visa. It can be more difficult, and the likelihood of refusal is higher in different countries. But I know for sure from friends of mine that they've switched from a non-B visa to a DTV. There are several conditions for the switch:

1) you must be fired and your work permit must be cancelled;

2) the visa must be completely closed. When we consulted on this issue, we were told that there have been cases where someone cancelled their work permit and left Thailand, but the visa remained stuck in the system. If the visa remains active in the system, they won't be able to issue a new visa.

Check with your lawyer about the correct procedure.

Shammee Akter In our case, we cancelled our work permit and visa before they expired. Our lawyer asked us to inform him of our desired departure date in advance so he could prepare everything in advance. On that day, he sent us the necessary documents from the labor office. From that moment on, our visa was considered cancelled, and an overstay began. We had to either leave Thailand that same day or, with these documents, go to the immigration office that same day and apply for a 7-day extension of stay in Thailand for 1,900 baht, which is what we did. As we understand it, the second option is more reliable, as it ensures the visa is cancelled in the system. You must leave Thailand within these 7 days, and then you can apply for a new visa.

For the past years, so every year you signed the STM2 form, in which you acknowledge to understand the terrm and conditions of your stay.

And as director of your own company you ask on Facebook what to do?

As long as your company is active, meaning working in Thailand you can NOT change into a DTV as company director.

The most stable stay is the 1 year Extension of Stay, you apply for each and every year.

Shammee Akter Yep I did read it twice.

Still the same answer which you do not like to read.

Oh well, you can bring a horse to the water but not force it to drink.

Do as you wish and ignore the rules you signed to understand.

Good luck with renewing your visa at immigration.

Be aware that that yearly new stamp is NOT a visa, but you know all as you are the director of the company.
