TLDR : Answer Summary
The user inquired about switching from a marriage visa (NON-O) to a DTV visa in Thailand. Responses indicate that to apply for a DTV visa, one must first cancel the existing marriage visa and leave the country. It's essential to note that the NON-O visa will be canceled before applying for the DTV visa, and having two visa types at the same time is not allowed. As long as the necessary documents are provided, approval for the DTV visa is possible.

Guys, after leaving Thailand yesterday (Sunday, the 12th), the border officer warned me that my Non-O visa would be canceled, even though the end date in my passport was the 18th. In my case, it was fine since I plan to return from HMC with a DTV. However, please note that your Non-O visa will be canceled first. It’s not possible to simply 'switch' from a Non-O visa to a DTV.

You need to cancel the marriage visa, leave the country, then apply via eVisa website and then wait X weeks for approval

Yea. Couple of pals doing it. They spend about 6 months Thailand and 6 months UK with Thai wives and family. The DTV is easier and cheaper than yearly Spouse visa

if you can go for the workcation category then maybe. but i would not switch from a solid and sophisticated marriage visa to a sketchy soft power dtv where no one knows what’s happening down the road.

After canceling your non-o visa, you can apply for the DTV visa, not allowed to stay in the country while holding two visa types at the same time. If you have all the required documents, you can get the DTV visa.

Do you have a non O visa, or yearly extension? Where did you get the visa? Not enough details to advise you

I didn’t have visa problems ever since but now my wife wants to divorce so im researching if i can get DTV visa while having non O, like switch to DTV but im not sure if its possible, i asked the immigration here but they don’t know for sure, probably it depends of embassies.. so i asked here if someone hd this experience before..

Anonymous participant okay,so you aren't on a visa, you're on an extension. The moment you stamp out of Thailand the extension is cancelled unless you have either a multiple or single re-entry permit. So, in your case you can certainly apply for the DTV. On a side note the DTV is granted by the MFA outside of Thailand, and immigration deals with matters inside Thailand. Never expect the MFA to know about immigration policy, or immigration to know about MFA visa policy. Finally you must leave Thailand for a nearby country to apply and wait for approval before returning, you cannot get a DTV inside Thailand.

so i should not get multi entry permit and when i leave Thailand i will lose the marriage visa(extension) and then i can apply for DTV?

And if i get rejected i will be stuck? 🙈

Anonymous participant you will need to get off the marriage visa somehow sometime if you're getting divorced. Assuming you can't get the DTV approval and you hold a passport that qualifies for a 60 day free visa exempt entry stamp, you just present your passport when you return to Thailand. Alternatively you can immediately apply for the DTV again if they reject it for some correctable reason.
