Can I change employers while on a Non-B visa and how does it affect my work permit?

I received my Non-B visa last week, and my work permit is currently being processed. However, due to certain reasons, I need to change to another company. The new company informed me that their processing will take about one month.

I would like to ask:

Is it possible to stop the work permit process with my present company?

If so, can I remain in Thailand with the current Non-B visa for one month while waiting for the new company's documents, even without a valid work permit during that time?

Can I transfer the Non-B visa from my current company to the new company within Thailand?

Please share the information.

TLDR : Answer Summary
The user has recently obtained a Non-B visa and is in the process of securing a work permit. They are considering changing companies and have questions regarding the implications for their visa and work permit status during this transition. Key points discussed include the possibility of cancelling the current work permit, the validity of remaining in Thailand without a permit while waiting for a new company's documents, and the process for transferring the Non-B visa to the new employer. The consensus is that while the user can stay in Thailand until the expiration of their Non-B visa, they may need to leave the country to obtain a new visa associated with the new employer.

Hi,

So if you are changing companies your non-b technically can be transferred. However, you will have to cancel the non-b first and work permit from your previous employer and whatever date immigration gives you after the old non-b is cancelled, which is typically not a full month, and then transfer to the new non-b. If your new company does not gather all the paperwork needed to transfer to a new non-b before your expiration date of the old cancelled non-b from your previous employer. Then you will have to leave Thailand and re-enter. Which is currently what I have to do since my company could not get all the documents in time to transfer my non-b.

they are on the original 90 day nonb NOT an extension. It cannot be extended to another employer. They must start over.

Oh got it. I thought she had a Non-b visa already. As this visa can be transferred, to a new Non-b if her new employer finishes all new paperwork in time so that it can be transferred before the expiration date.

If I cancel my current Non-B visa and leave Thailand, and then apply for a new Non-B visa with a different company after one month from outside the country, will there be any problems? Will I be able to get the new Non-B visa without issues?

you can't cancel a visa BUT if you leave the country without a re-entry permit the visa becomes void. You shouldn't have a problem applying for a new Non-B visa outside of Thailand assuming the new company provides the documentation required

If you are on an actual visa rather than an extension of stay you can stay until that visa expires. But that doesn't mean you can use that visa to obtain a work permit with a new company, you will need a new visa for the new company which you will most likely have to leave Thailand for

Because you're still on the initial 90-day non-B visa stamp, you can stay until that stamp ends even if you're not working. It's only an extension that would be effected by not working.

But you'll likely need to leave Thailand to get a new non-B visa as your current permission to stay was based on a specific employer so you won't be able to apply for an extension based on a different employer from the visa you have.
