Just a question...

Are there any instances where an expat wants to extend an O Visa with Marriage extension but doesn't have necessary 400,000 baht to put in the bank. He borrows the 400,000 baht to put in the bank, it seasons for two months and then he files and gets his extension. He then withdraws the money from the bank and pays back the lender w/ interest. Does this happen and us it illegal?
Answer summary
The discussion revolves around the feasibility and legality of borrowing money to meet the 400,000 baht requirement for an O Visa marriage extension in Thailand. Responses indicate that while it is possible to borrow funds temporarily to demonstrate financial capability, it may lead to complications in the future. The general consensus suggests that it is not illegal to borrow the money, but maintaining the required balance is crucial to avoid issues with immigration. There are also concerns regarding the handling of marriage extensions and the potential need for financial evidence during the application process.

400,000 for 2 Months prior to application and 3 months after extension. Then the amount cannot go under 200, 000 or you lose your extension and must start over with a new Visa

Simple answer to your question is yes you can do it that way and no, its not illegal. In the case of an extension based on marriage, the amount is to show you can support your wife - its not a security deposit. Do it for your first year then make sure you transfer the required amount into a Thai bank account each month for the next year. I believe the amount is still 40,000 per month but check with your immigration office as its possible that has changed. Next year, supply evidence of those transfers (again check with immigration how they want that to be) and you can apply for the extension without the need for 400k in the bank.

I would guard against using an agent for a marriage based extension - they are much more complicated than a retirement extension and a lot of what is required has to be carried out by yourself/wife in any case. I also don't think most agents will arrange the 400k for a marriage based extension. That amount is usually withdrawn on the same day after a retirement extension is obtained. With a marriage based extension you may be asked to show evidence of the funds being in your account 3 times. Once on application, again when the home visit is carried out and again when you collect your extension. None of that happened to me but I was warned that it could. An agent may be able to get around the ‘seasoning period’ but the funds may have to stay in your account for 8 weeks after application (I was given a 60 day ‘Under Consideration’ stamp) - I doubt an agent would be prepared to facilitate that.

Borrowing money (whether from a bank or family members) for a visa extension is looney tunes: that’s what agents are for.

But agents are not just for people who don’t have the THB 400K or 800K to hand.

Take the example of THB 400k, using an agent. Keep the THB 400K invested overseas, and it’s easy to make 5% on that investment.

5% of THB 400K is THB 20K per year, and you have now covered the agent’s fees!

Yes, it really is that simple.
John ********
John ********
OP
Brigstocke Lexden well I had no idea that's what agents were for. I thought that agents just took care of all the paperwork for knuckleheads who couldn't figure out how to get through this process of applying for a Visa. I had no idea that they actually put money in people's bank accounts for extensions. I'd much rather leave my money invested in the stock market and pay them a small fee than to put that money into the bank here.

That's what agents do. However most of them won't touch a marriage extension, because it goes "under consideration" for 4 weeks and the application gets sent to the Bangkok headquarter, whereas a retirement extension gets issued the same day by the Immigration that handles it. Sorry but you have NO CHANCE that an agent will touch it. You could try the owner of this group, Thai Visa Centre and see what they say

that money lending thing typically is what agents are doing. They put the deposit into your bank account for 10 minutes, and get your extension stamped. However, most agents won't touch a marriage extension. They prefer the retirement extension as it is less complicated. You will need to shop around and ask agents. There are many of these in Pattaya and Bangkok, but also in every touristy town

You pay the agency...agency pays the "fees". I don't really support any thing that involves "overpayments and added fees" . It makes it harder for the people who just do it all on their own, and want to pay nomal fees for services.

John Tidona you can get a work permit on a marriage extension. However only for an employment in professions which are not forbidden for foreigners. So please beware - as the rule of thumb is: you cannot do what a Thai person could also do. And you would need the 400,000 THB in your Thai bank account, at least for the first year. You can get a work permit, however you, as a western foreigner, must earn a minimum of 55,000 THB per month (!) and pay taxes, in order to get a work permit from the Labour Department. You can continue the annual marriage extensions based on 12-months of transfers into your account of a monthly minimum income of 55,000 THB, but only if this money is earned inside Thailand

Potpong_Life I don't believe you have to keep the money in the bank for 4 months after you get your marriage extension that's the first thing. The other thing is how do you know how much it would cost? Who is the lender? What are they charging? I think that would be different with everyone.

John Tidona you have to leave it in there permanently and when you renew your marriage visa it every 12 months it has to be there . And if she give you the arse your not entitled to the marriage visa
Potpon******
Potpon******
John Tidona well let’s be honest there is the legitimate way of getting a loan…then there is the grey area of getting a loan

Both use different interest rates…

Most likely you want a quick flip to not have to payback an exorbitant amount of money in interest on a short term loan…especially if you’re living the skint life already

Deposit: 400,000 baht in a Thai bank account, seasoned for at least 2 months before you file. Unlike retirement, no "3 months after" holding period is published for marriage. But each bank can make their own decision on this so it’s not unified at all

Good luck

Carmena Sandiego He can get a work permit, and this seems to be his plan, however he, as a western foreigner, must earn a minimum of 55,000 THB per month (!) and pay taxes, in order to get a work permit from the Labour Department.

He cannot work inside Thailand on a 40,000 THB salary as a western foreigner.

He can continue the annual marriage extensions based on 12-months of transfers into his account on a monthly minimum income of 55,000 THB, but only if this money is earned inside Thailand.

Greg Alexander that’s a common incorrect misunderstanding. You can get a work permit at any salary.

But for a visa extension, you must have the minimum salary. Another exemption is that if you work as a teacher, there is no minimum, meaning that you can still get your annual extension with a lower teacher‘s salary.
John ********

OP
Greg Alexander so here's my deal Greg I'm curious to see what you have to say but I do believe that different provinces treat these things differently. I currently have an OA Visa which expires in the beginning of January. I'm leaving Thailand the middle of November to go back to the United States take care of medical things and I will then cancel my OA Visa and apply for a new O Visa. And I'm married so I was going to go for the marriage extension so that I only have to put the 400,000 baht in the bank. But now I'm seeing from all these folks that a Visa agent in Thailand will put the money up for you and you just pay him a fee. I make well over the 65,000 baht monthly requirement so if I continue to have my Social security deposited directly into my Thai bank account and say at the beginning of 2028 when it comes time to extend my marriage visa will I always be able to use the income method or at some point will I have to still have 400,000 baht in the bank again?
John ********
John ********
OP
Carmena Sandiego when you apply for a Visa such as the o or the OA yes you can do that but it's the extension that's the issue most of these immigration offices require money in the Bank.
Greg ***********
Greg ***********
John Tidona for a 1-year marriage extension, it is either a minimum of 400,000 THB in your Thai bank account, or an affidavit of income from your embassy in Bangkok over monthly minimum of 40,000 THB

@John *******
agents don't normally deal with marriage extensions. They can't be approved at the immigration office. They have to be sent to the district office for approval, and the agents only have connections with the local officers. Also many immigration offices don't accept proof of foreign bank transfers for marriage extensions, so you would need to ask your immigration office if that's even an option to begin with.
John ********
John ********
OP
Kenneth Walker what province do you live? Different offices will treat it differently. I live in Saraburi province and I know that that's not the case here. Plus you know I'm an American so I cannot get an affidavit from my embassy for my income even if it's Social Security. I used my income to apply for my original Visa but for the extension it's a whole other story here. I've also heard that after the first extension in the beginning of your year three that you can use the 65,000 baht per month with the paper trail from your bank but I'm not sure if that goes in all provinces.
Greg ***********
Greg ***********
Kenneth Walker Please do not compare the marriage extension to a retirement extension, as the rules are different. . . . . he can only use the 40,000 THB income if his embassy still issues an affidavit of income. If not, then he can only use 12-months of consecutive transfers of 40,000 THB into his bank account if that money is earned inside Thailand

sorry but you are wrong. If he entered on a 90-day Non-O Marriage Visa, and even if he converted a tourist visa to the Non-Imm-O MARRIAGE Visa inside Thailand, the 400,000 THB deposit do not need to have come from abroad. No such proof needed. Only for the conversion of a tourist visa to a 90-days Non-Imm-O RETIREMENT visa inside Thailand, one must prove that the money came from abroad

it will depend on your immigration office, many won't allow you to use the 40k per month method unless it's either from income earned inside Thailand or via an income certificate issued by your embassy in Thailand
