TLDR : Answer Summary
You cannot apply for your first Extension of Stay (EOS) based on a Non-O visa until at least 45 days are left on your current visa. In Pattaya and surrounding areas, you typically have to wait 60 days post-entry to apply, and it is advised to ensure that funds (for the 800k requirement) are seasoned for two full months.

Nowhere in Thailand can you get it after only 40 days, meaning you would have 50 days left. The earliest offices allow is 45 days and that's only a few offices. Most offices are 30 days or less remaining on your stamp, so that would be 60 days after you received your stamp.
