Hi Peeps, need the advice from you guys please.

Me and my husband married for over 20 years. I am Thai citizen that live and married in UK. We got little business in Thailand that will need my husband to stay there for little longer than visitor visa but still need to come back to UK at homebase.

What kind of Visa would u recommend? Thanks
Answer summary
The user, a Thai citizen married to a British national, seeks advice on suitable visa options for her husband to stay in Thailand longer than a tourist visa duration while still being able to return to the UK. Suggestions from the community include the Non-O visa based on marriage, which allows for an initial 90-day stay with the possibility of annual extensions, and consideration of the Thai Elite visa for more flexible travel. Requirements such as maintaining a bank balance for extensions and the implications of working in Thailand without a work permit were also discussed.

No expert, but after the recent change I have had to go back to a Non-Immigrant B which allows stays of up to 3months - option of single entry, and after a few visits apply Multi-entry. Be careful of the definition of business/meetings as opposed to work. I go for business meetings but one factory I visit recently had a bunch of contractors caught out installing equipment which quite obviously counts as work.

Simple - All you need is ID/proof of funds/current location - and an business invitation letter which I get 2 or 3 from the suppliers I am visiting.

With a single you can get an exit stamp which allows another entry within a month.

LovelyNectarine8645 nothing to do with grammar. You should not put yourself first... not: "me and my husband" but: "my husband nand me" (my husband and I)

So what does your husband do in the business that he needs to stay in Thailand longer.

Graeme Drake not sure on the relevance of your question. Perhaps you could explain.

OP
Graeme I own a business in Thailand, but around 90% of it is managed online from the UK. The remaining 10% involves servicing and maintenance, which we pay local Thai workers to handle.

My husband doesn't work when he goes to Thailand, and we are both based in the UK. Our children are half-Thai and hold Thai citizenship, but my husband is the only one in our family who doesn't have Thai citizenship and can only visit on a tourist visa.

I’ve already provided all the information about our situation in my original post. I’m simply trying to find out which visa would be most suitable for him, as it’s quite awkward that he is the only one in our family who needs a tourist visa every time we visit Thailand.

LovelyNectarine8645 the best advice is what John S. gave you,a lot depends how often you want to come, a tourist visa will give your husband sixty days and can be extended for another thirty.you may only do this once a year.

Graeme Drake why does it matter to u?

It sounds like you intend doing this long term? If so, the best way would be for your husband to obtain a 90 Day Non O visa based on marriage to a Thai citizen from the UK. He then needs to apply for a 12 month extension of stay in Thailand each year. He will need to have a bank balance of at least 400,000 baht in a Thai bank account in his name only to be able to apply for the extension and that needs to be there for 2 to 3 months before the application.

Check with your local immigration office in Thailand to find out how to apply and what documents etc. they require – as they all want different things.

The only problem he will have is that he will need to stay in Thailand for 1 to 2 months after he makes the application.

Once he has the extension he needs to get a re-entry permit – either single entry or multi entry before he leaves Thailand. If he leaves without that – his extension of stay will be cancelled and he will need to go through the whole process again.

He can obtain a new extension every year and again, the 400,000 needs to be in his account 2 to 3 months before applying.

Phil Wilson once the extension is obtained is there a limit on the number of times you can leave Thailand?

David Liverpool Not that I know of. I had a Non O extension many years ago and left 8 to 10 times per year - same when I changed to a Multi Entry Non O (no longer available). I was never questioned or warned. The only reason I changed to a Multi was because I couldn't stay long enough to wait for my Non O extension.

How about the Thai Elite Visa. Costs a bit but he can come and go as he pleases.

The visa is the least of the problems. The problem comes if your husband should work in your business as it takes a work permit, which takes a company with a paid up capital of 1 mill. THB when married and 2-4 Thai workers. If he is merely the owner or investor and your family knows the police officer in the area, then he can stay in the shop without a work permit as long as he is not interacting with (Thai) customers.

Jo Clemente, how I am nasty? Thai Police is not flexible on foreigners working in Thailand without a work permit. Being a manager or "looking after" a business is not excepted. I am just sharing my experience for her to avoid running into trouble.

What's a "little longer"?

Will you also be in Thailand?

It's possible to get a 90 day Non-O visa based on marriage before travelling to Thailand. It's also possible to get a 60 day extension based on "visiting Thai family" which would give a total of 150 days

This is good advise - 90 day Non O can apply on line and easy to get.

LovelyNectarine8645 a tourist visa that you apply for before you travel gives you 60 days and you can extend for a further 30. Your choice which way to go

LovelyNectarine8645 that's if you enter without any visa at all. Visas haven't changed

LovelyNectarine8645 only visa exempt changed to 30 days , all visas have not changed so you could apply for tourist visa 60 days and extend 30 days, apply for non O and get 90 days!!

If your husband has to work in your business, you have to deal with Labor Office. A marriage visa should be fine.
