Answer summary
A user from the UK, residing in Thailand with their Thai wife, seeks guidance on maintaining her UK residency while living abroad. They are concerned about her 2-year residency condition and have received various suggestions. Most recommend contacting the UK embassy or UK Visa Immigration (UKVI) for specific guidance, especially since residency permits are transitioning to digital formats. It's crucial to avoid applying for new visas, as that could jeopardize her Indefinite Leave to Remain (ILR) status. Users emphasized the need to ensure her travel documentation is up to date, linking her Thai passport to the new UKVI system and obtaining a shared code for her immigration status when traveling.

She is definitely needs to go back to uk before two years absence from the country, otherwise you will have to restart all over again.

And if you are marriage long enough 8 years I think you can apply for British citizenship but need to be in Uk at least 3 years with her residency.

Just travel back to the uk quickly before the two years is up,(you lose the ILR)

Book a direct flight not via a transit country in case of any problems.

The Evisa is not mandatory yet.

Do strongly advise for Thai passport holders to fly on a direct flight to their destination as if their is a problem in the transit country it’s not the place to get stuck.

China or Middle East etc.

She will be fine, just get the tickets and flight back. All will be ok prior to 2 years restriction, the only hurdle is she will be ineligible for British passport due to the length staying away for over 6 months.

She obviously doesn't have a UK passport so you should create an account on the government website and link her Thai passport to this .The chip in her passport will contain her status when travel

Dis you google her?

She needs to generate via the evisa system, a share code to show both the check in staff at the airport and the UK immigration at the border.

Tongjun she will need something more than a foreign passport and no proof of entry clearance for the UK at airline check in or she won’t be getting on the plane

The cards have been replaced with online e visas. You need to register an account with UKVI.

The British embassy will not help you as it's not their role and it has nothing to do with Thai Embassy's either.

You need to make contact the issuing authority who I believe is the "UK Visa Immigration" (UKVI).

Whatever you do , whoever you consult, do not apply for any visa or entry permit for her as this would invalidate her hard-earned ILR and she would have to start all over again in the UK. Please don't.

I knew someone followed the advise from a UK consulate and applied for a visit visa and lost the ILR. Consulate Staff are not necessarily competent and there is no accountability for their advise over the phone. From real life experience.

Why would someone apply for a visit visa when they already have ILR,

Thanks

If your in Thailand I would contact the uk embassy as we had to also go to a company in Liverpool which deals with photos and paper work for the government

It’s not a digital card it’s has to set to her passport then when she travels she needs a code from the government website I know as had to do for my wife

She needs to go back to the UK before her residence permit has expired. She will no longer to consider as the UK residence Permit.

I have done this for my Thai wife .You need to do what James and mark have stated .Set an account and this will be linked to the chip on her passport. So you don’t have to show anything to immigration when you travel to uk

I hope she’s registered with UKVI’s online e-visa system since BRPs are no longer valid. If this is the first time she’s been away from the UK, you don’t need to do anything. Just show the UK Border Agency officer the shared code (online registration) as they can check her immigration status online if registered.

But if they found out you’re doing that repeatedly every 2 years, just not to lose the ILR status in the UK, Border Force officer might strip off her ILR status and issue the entry visa then she has to go through spouse visa process till she gets the ILR back again as the whole process.

Many countries have this rules, if you not live there your not allowed to stay as resident.

Of course it’s UK embassy you need to visit and get the correct information.

I found out a few weeks ago that if my son (9) Swedish/thai not will be living in Sweden between age 18-22 then he looses his Swedish nationality.

I’m sure we will have him at a university at that time so I face the same question what to do 🧐

You can contact the Home Office and get them to extend (certainly, it used to be possible), but usually they want some reason why you've been out of the country for an extended period as (stating the obvious) the purpose of a residence certificate is that you reside in that country.

Google “evisa uk “ and it should show you the government website to apply for the evisa which replaces the BRP. Everything being online is claimed to simplify everything , I disagree . Alternatively , if you still have the passport with “no time limit “ stamp , show that as well as current passport .
Mark *********
Mark *********
I would get back before it all runs out i know how hard it is to get the ilr
Mark *********
Mark *********
You have to go online and get a digital card now what you have to show at airport and then link it to her pasport it replaces the old brp card

If you log in it will show status on there
Ian ********
Ian ********
Mark Leisure I thought that the chip on passport contains the information ie no need to get the share code for travel
