Overstay for 1 year, if I want to go back do I have to sit jail?
Answer summary
If you overstay your visa in Thailand for one year, you are typically required to pay a fine of up to 20,000 baht and face a ban on re-entry for three years. If you are caught by immigration authorities while still in the country, you may be detained and face additional penalties. However, if you voluntarily report at the airport when leaving, you can often avoid jail time but will still incur the fine and ban. Communication with Thai authorities could vary based on circumstances.

2 of my friends from San Francisco visited my birth country, Taiwan and since landing, one of them had to cross the red lights all the time, given the fact the traffic in Taipei is only slightly better than Bangkok !

You can just pay the judge, police, immigration and lawyer to sort it. Cost will be about 600-800k baht. No Blacklist, Will have to leave Thailand, get a new passport and fly back in and will return like you never entered, I know a few who have done it. Also with longer overstays.

Book your tickets, go straight to the airport. You will be deported right away with a red stamp and also will have to biometrics. You wouldn’t be allowed to enter Thailand for 10 years. Even if you change your passport with a different name or whatever, the biometrics will identity you right away if you try to enter Thailand again through land, air or sea and will be deported 100%. So leave Thailand as I instructed and forget about coming back again. It will not happen.

If they stop you at the street you will be arrested and go to IDC deportation center in BKK after seeing the court.

Ok as someone who stupidly over stayed their visa by 6 months twenty years I'm in a certain position to answer this though twenty years ago is alot different than the present the thais are rightly so being much more stricter on entry and abuses of the visa system the days of border runs as long gone.i won't go into why I ended up overstating it's a long story but anyway I managed to sort money out got a plane flight home went to the immigration and paid the
*****
baht fine they told me at immigration that because I'd paid the fine and got a ticket out o wouldn't have problem coming back and that was true as I came back in 2009 2010 and 2015 no problem I now have a new passport and have since been back 2023 2024 and am here at present for 3 months no problem. Now in your case did you go to the airport with ticket out and pay the fine because that makes a big difference in that case I'd go to the thai embassy and get a visa and check if you are ok to go though that's not 100% guaranteed they might still refuse entry at immigrations definitely don't try to turn up hoping to get a visa on arrival that's not going to happen.now if you were pick up by the police and had overstayed you would be taken to the immigration centre and stay there until you got money for a ticket out pay the fine and would be deported and probably banned for 10 years.if you do manage to get back to Thailand expect for at least the next 10 years extra scrutiny of plans outward ticket and funds and for goodness sake don't even overstay by one day.well if you do get back into the country enjoy but break a single law even a traffic law.i have to admit your chances for the next 10 years are 50 50 Thailand is not playing about anymore.and you will have some explaining about how you survived and what you were doing in that one year of overstay

I’m a retired human rights, attorney, and I have a peripheral awareness of the Thai immigration laws as well as overstay penalties. I personally do not know of any law “requiring“ jail time for an overstay up to a year. Certainly, Thailand or any court system for that manner can do virtually anything that wants to anybody at once, but there’s no upside to wasting time and money incarcerated you or anyone else for an overstay.

Any overstay of more than 90 days and up to one year simply requires a one year prohibition from returning to Thailand. After that one year away from Thailand, you can return just like anyone else - at the discretion of the immigration office at your point of entry, of course. Keep in mind, virtually any immigration officer anywhere can arbitrarily choose to BLOCK anyone seeking energy into the country. I don’t have an even if they have a preapproved visa. It usually doesn’t happen, but keep in mind It’s all up to them.

My non-legal person advice, of course, is not to overstay, and simply comply in a reasonable way with a visa requirements. Once you have committed an overpay of more than 90 days and up to one year, you prohibited from entering Thailand again for one year from the day you left. After that, you’re free too enter and obtain a visa on arrival or apply for a longer visa before you come. Personally, I would probably get a new passport before entering again - just to say “courtesy“ to the consciousness of the immigration officer(s) you first made upon arrival. It might avoid some headaches or controversy for you and them.

If you can pay the fine and the ticket "home", you do not go to jail.

HOWEVER:

If you can not pay the fine, you get imprisoned for punishment, about 1 day per 500THB fine.

If you can not pay the flight, regardless if you paid the fine or not, you get into IDC, immigration detention center. Until someone pays your flight.

There are some people imprisoned since roughly 10 years, because no one pays their flight out of the country.

Your embassy, your country might help, astonishingly most countries, for example Sweden, do not care about their citizens sitting in IDC.

Chris Cunniffe completely incorrect, have you ever being in this situation before - I never said prison - it the detention centre unless you really upset them and they bring you in front of a district judge on other charges criminal or cival charges, which is a different thing all together but similar system.

In thailand admission of guilt - weather accepting to pay the fine or what ever admits your guilt- with immigration bkk at the center you go and pay your fine to the girl on the desk - then your given a paper and told to report to the ground basement floor to where the cells are to - to present a paper to the duty officer down there.

Up to him - he can lock you up for an hour or days - I was lucky I got 2 hours because I had broke the Immirgrarion laws and purged my guilt and paid the fine back then it was 100b a day up to a limit - today it’s 20,000 - I was then let go with my new passport updated - I was not arrested on over stay or being deported back then - I got a new passport and I had to go to the bkk centre where they give you stamp in your passport - so I went voluntarily - I was not pulled in and arrested or facing deportation - but then again that was up to them

I got put in a cell for 2 hours to reflect.

Even in a police matter in a civil case In district courts - if one party in front of the judge admits they are wrong and offers compensation - they have admitted guilt and it still goes on their record as an offense.

The judge will ask the other party weather they accept the compensation offered or not.

I accepted before and then the judge asked how long I wanted him locked up - I replied I didn’t want them locked up but the judge said they admitted guilt and must go to the cells that is Thai custom - I was told the minimum was 15 minute so I said ok to this - the judge then said I can go to the district court cell in the basement and take mug shots of who assaulted me if I like but I declined to offer.

This is Thai custom and nothing to do with tourism.

If you purge your guilt you admit guilt and they will lock you up for a period of time for you reflect on your crime.

If you piss off the jailer who has a lot of power - you will stay longer and I know people who have done this and being kept there for weeks even thought they had the moneys to fly etc.

This is Thai custom - ask any lawyer and they will confirm this as fact.
Chris **********
Chris **********
Eddy Roote thank you for sharing this story and my sympathy. At the same time, you were detained for two hours.. That's manageable. Point is you are allowed to leave the country. How long did you overstay?

Also, regarding 'admission of guilt', you can't deny overstaying if they look at your entry stamp 🤨

Possibly - you need the follow the visa rules, why would you think your are exempt from visa policies when 99% of other people follow them with no issues? Having said that, some situations are complicated, as technically I am on an overstay of around 21 months at the moment. But only because because I am NOT allowed to leave Thailand due to a pending appeal of a long running court case. After multiple attempts to get the passport back from the police/then the court to try and keep the visa situation above board my passport was eventually given back to me for 24 hours around the middle of last year, on the hope that I could go to immigration and sort something out but that was unsuccessful. They wouldn’t stamp it (always was going to be a massive long shot) and handed it back then I had to give it back to the court. So I could well face some big problems around this - it is a known catch 22 as on the one hand I can not leave, as I need to comply the correct process with regards the situation with the court case, but in doing so I am forced into a position of overstaying. I didn’t even know of a problem until I got to the border at Satun to leave Thailand (and then come directly back in again 5 minutes later with a new stamp) and was told I couldn’t leave, I needed to head straight to the police station in Bophut on answer some questions about an incident a few weeks prior to this.

I was terrified l thought l would be least given a chance to explain. Pay 15,000baht 1000 a day l paid without complaint. After paying l asked where l had to report. The gentleman in uniform to whom l had paid the money looked at asked which gate my plane was leaving from. When told he grinned and said that direction do not be late. Robert G Viset you're telling someone that you don't know, that they're arrogant? Maybe that's you, because if you cared to do a bit of research, you will find out that words and phrases quite often don't translate exactly from one language to another and allowances should be made for that. It doesn't matter what you use to translate either, Google might translate something slightly different to another translator - I've done it myself. Then, instead of arrogantly criticising someone that speaks a different language to yourself, also takes into account that the other person might not have had as good an education as yourself... that's called being humble.

Colin BoylandI’m not God, neither are you, so, we don’t know all the possible bad life situations that exist on planet earth and not to mention in outer space. So you’re making assumptions based on your narrow and limited viewpoint you’ve experienced so far in life. I’m not doing that anymore. That’s the old me before God showed me how ignorant any one of us each is, hoping to trump God’s grand scheme of Plan for humanity. You must have heard of the elephant 🐘 story, I hope you have cause it’s a common and frequently cited example in personal and professional development and growth arena. If not you seriously have missed out an important life lesson and you’re here pointing fingers while you haven’t even learned enough yourself.
Colin *********
Colin *********
Lynn Nah maybe had a "very bad life situation", but what situations would prevent a person (or someone that could represent them if they were incapacitated) from applying for a suitable extension of stay? In the case of a serious medical situation, someone would assist in some way 🤔 maybe they got lost in the jungle 🤔

The OP is talking about returning to Thailand, so they obviously found their way out of Thailand without being detected by Immigration, so it does sound very suspicious regarding their last stay.
Lynn *****

people get into diffulicies - mental health - family’s or relationships breaking up - parental issues - lack of money many things sone that may be out of their control but the is a huge amount of dirigibles here on over stay

I know some elderly gents 3 years over stay who want to die in Thailand and other who cannot afford to keep 800,000 in the banks - a lot don’t even have this

We cannot judge these people they have their reasons but the laws are getting tighter and tighter now
