What Are My Options for Securing a New Visa in Thailand After My Retirement Visa Extension Was Denied?

I've been aware of a possible coming problem ever since the new arrangements for assessing income for extension of stay of a "Retirement" Visa were announced in January. I base mine on the 65k/month route, free capital was turned into cowsheds here around 15 years ago..........

So I've been an avid reader here ever since.

Extension time is here, and I have a clean bill of health for the last 10 months (thanks for the heads up here), but a shortfall on the first two months - before the new arrangements were generally known in January. I was hoping for leniency based on the letter shared here dated 26th December, No 0029.173/Wor from Police Lieutenant General Surachet Hakpal.

At Lopburi Immigration yesterday, I was declined an extension. I and my family are well known and well liked there, but it is a very quiet office, we were the only customers present yesterday, and the Lady Captain in charge (always the same lady) seemed not to have met this problem before. But she was keen to find a route through.

Good news was that there was no suggestion of need for Hospital Insurance..........

Her direction is to exit Thailand to a neighbouring country on expiry of the current extension on 12th December. Obtain a new Tourist Visa in that adjacent country. On return to Thailand and time having allowed two further 65k/month compliant months to have passed, visit her again. Where-upon she will convert the Tourist Visa into an in country generated 12 month Visa - presumably, Non O.

My reading here suggests to me that an adjacent Consulate may not issue a Tourist Visa given that I have been clearly in Thailand since June '17 and that if they did, there is a risk of being refused entry at the border crossing on the same grounds.

From where I live, by far the most convenient crossing point is by land to Vientiane. So Vientiane and Savannakhet are preferred consulates. But clearly, success is the overriding consideration.

Plan A, is therefore to go to Savannakhet and see if they will issue the Tourist Visa and see if I can cross by land to Mukdahan.

Plan B, in event of refusal, is to do a 30 day visa exempt crossing.

How do you rate chances of success?

If crossing with 30 day Visa Exempt, obviously I can extend by a month at Lopburi, which is adequate. But can Lopburi issue an in country 1 year Visa stamp off the back of a Visa Exempt crossing?

Any suggestions as to where to go for a better chance of success?

Sorry that's a long post, but I know the sort of questions you are likely to ask.

Attached is the full Visa and stamp trail via a Passport Renewal from original Tourist Visa at Savannakhet in June '17. (I have been in Thailand since January 2014, originally on a Retirement Visa and planning to stay only 6 months. But it transpired that my family here needed my presence, so unplanned Visa and Visa exempt runs followed until I got the system sussed from that June '17 Visa. Old Passport is therefore very full........ But new passport as per the single photo below only.)

TLDR : Answer Summary
The user shares their experience facing challenges in obtaining a renewal for their Retirement Visa due to not meeting the income requirement for the past twelve months. They've been advised to exit Thailand and apply for a Tourist Visa from a neighboring country to later convert it into a NON-O Visa upon return. There are concerns about successfully obtaining the Tourist Visa after long-term residency. The user is weighing options, including crossing into Laos for a Tourist Visa or using a visa exemption for a month, and seeks advice on the likelihood of success and which consulate might be more accommodating.

will your immigration office do a combination method? e.g. 10 monthly transfers plus 2 months cash in the bank?
Tod *********
@Eze *******
to use the combination method you STILL need 12 monthly transfers, it's just they can be less than the 65K baht a month you need for an extension based on retirement, and you make up the difference between them and the 800k baht with banked money

Thank you!

Chris York okay. Best of luck with the conversion and re-application. I don't think you will have anything to worry about.

I think that would be stretching their knowledge considerably - Lopburi seems to be well off the beaten path. So I don't think it is worth asking, given a workable directive as to what to do.

Thank you very much,

.

I'll post a very brief update in a couple of months when all is resolved.

@Chris *****
, you can also apply for that in country 90 day Non-O off a 30 day visa exempt entry stamp too, AND you could extend that by 30 days as well which would give you the two months extra you need to have 12 transfers.

Vientiane will be OK,

I will try for the Tourist Visa, simply because it is what our lady Police Captain asked for.................... No point doing anything differently to requested just to save my aggro..........

@Chris *****
, it is your embassy who stopped providing a service, named the income affidavit. It is not the Thai immigration at fault in this case.
Robert *******
yep, it is not friendly policy, sorry we stop service next month. They could have waited till Immigration offered an alternative. But all to late now.

I agree but find it a shame to hear that although well known, they still gave them no leniency.

Entirely agree. I've followed the whole saga...............

So
@Tod ********
, you'd not envisage having a problem even at Vientiane?
Tod *********
@Amornrat *********
, this person needs to stamp out on a Non-O extension, then go to Vientiane or Savannakhet to get a tourist visa then come back to apply for a new Non-O visa.

Do you think they'll have problems getting a tourist visa from either Vientiane or Savannakhet? I didn't think they would because they were on an extension not living here on tourist visas
Tod *********
the problems that people seem to have is that they're living here on tourist visa and visa exempt entry stamps, you clearly were not.

I think you should be okay, BUT let's ask someone who lugs people up there two times a week.
Tod *********
Other than they won't convert a tourist visa straight to a 12 month extension sounds like that's your viable option.

Makes total sense, I doubt you'd even have a problem at any nearby consulate because you were not living here on back to back visa exempt or tourist visa entries, but on an extension of stay.

And although I didn't save your images I perused them and it seems they DID move the currently active stamps to the new passport.
Tod *********
So to summarize that train wreck, because you did not have 12 full months of 65K baht incoming international transfers you were denied a yearly extension?

They are suggesting you leave the country effectively canceling the extension you're on, get a tourist visa from a thai consulate in a neighboring country, come back on the 60 day stamp, immediately go apply for an in country 90 day Non-O visa based on being over 50 and once you get that they'll issue you a yearly extension of stay because by that time you WILL have 12 months of incoming transfers.

Exactly.

First of all REMOVE the pictures, nobody should be interested in your personal details and those who are interested do very nasty things with those details

Done.

I second that suggestion (y)

So are you married to a Thai national?
Chris ******

No. Hence the 65k per month...............
