How can I manage tax obligations while on a NON-O volunteer visa in Thailand with foreign income?

Hello everyone,

I am on a non-o volunteer visa with a foundation. My income for this is coming from Germany. And as I am working in Thailand, Germany does not require me to pay taxes. However, for my work permit renewal next year I need to show prove of tax payment. Therefore I was thinking I might pay taxes here in Thailand. Does anybody have any information on this? Or possibly an accounting/tax consultant office that knows about more complex processes such is mine?

Any help would be greatly appreciated

Simple answer, claim you're a German tax resident and pay tax there, ignore the Thai side, it's highly unlikely to be an issue. If you don't move that money to Thailand in the same year, you aren't required to pay tax on it here anyways. (they aren't gonna know where the money originated anyways)

Complicated answer, living more than 180days in Thailand, you would likely be classed as a tax resident, if you're bringing money into the country and working here you should probably be paying tax on it here. How that affects your visa, I have no idea. If you want to pay tax in Thailand, talk to an accountant at a firm which also has visa lawyers.

Are you referring to the double taxation treaty? If so I think you may be misunderstanding it.

As I am a German volunter/worker transferred to Thailand, according to German law, I am to pay taxes in my country of residence / work (=Thailand)

I don't understand your usage here. If you are a volunteer in Thailand you don't earn money, even though you do need a work permit. If you work for a German organisation that pays you to volunteer in Thailand then you pay tax in Germany. But if you are in fact working in Thailand and earning money (albeit you are on a volunteer visa, which I didn't think allowed paid work) due to the work you are doing here then you should pay tax in Thailand.

I think you need to make your situation more clear if you want help.

Also have you actually changed your country of residence? I've been resident in Thailand for 6 years but for tax purposes my residence remains the UK and I must pay tax in the UK on all UK income. I'm sure it's the same in Germany

If your income is Germany source income and paid to you in Germany then it's taxable in Germany regardless of your tax residency status there. This concept applies pretty much worldwide.

And if your income is still German sourced then it's still taxable in Germany regardless of your residency status there.

but you can't work in Thailand on a volunteer visa, you can only volunteer. So if you are working in Thailand and being paid to work here (albeit you actually receive your pay in Germany) then it sounds like you are on the wrong visa type.

Umm, I'm confused. Volunteering means you are not being paid. Also, where you are volunteering gives you all the paperwork for extensions, and work permit.

If you are doing work in Thailand, then yes you file and pay taxes, no matter where the pay comes from. Go to your local revenue office and get a tax ID number. File your taxes on , I believe, form 91, or if your situation warrants it, then form 92. When you go to your local revenue office and file your return, you get a receipt. That is what you need for your work permit renewal.
