In the work permit, it includes validation day, but no matter what, if u left the company, your work permit will be automatically canceled on the day u left!

Which is why you keep your work permit WITH YOU, not leave it at the office with your employer. It's YOUR work permit not theirs.

The WP is a personal item, you went to the Ministry of Labor to sign and collect it. You go to the office to cancel it. But I understand that many like to hand it over to their employer and let him do it for them. But it should not be normal. You can not get in overstay, as your work permit only allows you to work inside Thailand. Overstay your Visa or Extension of Stay has nothing to do with the Work Permit, Visa or Extension of Stay is organized at another office called Immigration.

Nothing automatic indeed. Normally it is the employer who has to cancel the WP and consecutively the work visa. And he does it when he wants and you don't know when he does it! So suddenly you can be in overstay without knowing.

Eventually I had it canceled and it was not easy!

You have to cancel the work permit at the Ministry of Labor, it does not go automatically when you close the door behind you when leaving your employer.

It can be an issue if the company terminates your employment and has your WP. If they don't let you know when they cancel it, you can end up in overstay. Normally you have only 24 hours to leave. You can extend by 7 days but you need to know what day it is cancelled.

Your work permit is to let you work in Thailand, nothing more. If he is on an Extension of Stay based on working, he needs to cancel this Extension of Stay. If he is on the actual Visa than there is no problem and he can keep on using this Visa. The Work Permit is a personal booklet and should be with the employee, not with your employer.
