Hi

I hope you are well.

I am from the UK and I work remotely for a recruitment firm, I want to apply for a DTV Visa but I also want to vlog my fitness journey while I am in Thailand. I will not receive any income from Thai companies but I will be including Thai companies in my videos i.e. Virgin Active Bangkok for example. Is this ok?

Just to be clear again I will NOT receive any income from Thai businesses for my vlogs, all my income will be foreign and from outside of Thailand.
Answer summary
The questioner, a UK national, wishes to apply for a DTV Visa while vlogging about their fitness journey in Thailand. They clarified that no income would be received from Thai businesses. Responses from the community suggest that vlogging may be legally considered as working, even without receiving income from Thai companies. Some users caution that any activities involving Thai companies, regardless of income, could lead to legal issues or potential deportation. There are mixed views on the likelihood of enforcement, but generally, engaging in such activities without proper permits can pose risks. Overall, caution is advised, especially in how Thai companies are mentioned in the vlogs.

You're going to have more issue on site with your recording than with immigration. Eg, if you vlog at virgin active, people at the gym may complain and the employees may ask you to stop for privacy and ip

A LOT of laws that haven’t been enforced are now being enforced. A video you make could be used against you and land you in jail then deported 3 years from now. Changes in Thailand come like the tides.

I read some rules on this. Immigration can chuck the book if you use Thai content for a paid vlog. It's unlikely but possible. I know because I have to be really careful what I draw, as an iconography and folklore artist, I have to keep it Bri'ish. Of course it's wise to be careful on negative talk. I follow a lot of UK Thai vloggers who don't.

Do not mention any thai companies. And working with any thai compamy income or not will put you at risk for legal trouble and deportation

If anything is promotional whether you receive payments or not is illegal. However it's not really enforced. But if you use your real name they might find it during application process. If you haven't started already it's probably fine. But in Thailand even doing any sort of work for free is also illegal.

Legally, vlogging would be considered working within Thailand especially when you consider that the legal definition of work is “exerting energy or using

knowledge whether or not in consideration of wages or other benefits”.

Legally, even people doing volunteer work require a work permit. The real chances of you actually getting in legal trouble for filming yourself working out is fairly low but it is something that can be used against you if need be.

Income is irrelevant to whether you are seen as working or not.
