Can I apply for an investment visa in Thailand with jointly owned condos?

I have a question about the investment visa that I cannot figure out the answer to online, so would appreciate anyone that has knowledge.

My wife and I have THB14M invested in 3 condos that are in joint names. We currently live in Hong Kong.

Can one or both of us apply for the investment visa, or should we have put all the properties in one name, and the other person applies for the dependant visa that can hang off the person who gets the investment visa?

I'm pretty sure you can't use preexisting investments to obtain an investment visa. Normally the investment has to be approved in advance and condos purchased from the developer as part of the investment process.

If you meet the criteria, maybe you can. You need to buy a pre-approved property by BOI and the purchase has to be done through a specific channel. Also, the purchase itself has to be approved by BOI before you complete the procedure. If I remember right, the price of the purchased property has to be more than 10M baht per property. You need to contact BOI directly for details.
