I’ve transferred my 400k and this will be seasoned fully on September 15th.
My stamp expired on the 28th of May and I’m on amnesty , my 1 year NON imm O multi entry visa based on marriage expires on 18th Aug.
My Plan now is to wait until 15th September when my 400k is fully seasoned and apply for a 1 year extension of stay based on marriage.
Now I’m hearing I can’t do this as I’ve been on amnesty you can’t transfer to 1 year marriage from amnesty.
Is this correct or does my current plan seem correct ???

TLDR : Answer Summary
The individual is seeking clarification on whether they can apply for a 1-year extension of stay based on marriage after being on an amnesty since their visa expired. Despite having heard that transitioning from amnesty to a marriage extension isn't allowed, commenters suggest that it is possible if specific requirements are met and encourage the person to contact their local immigration office for confirmation.

Okay, IF your original entry stamp was from the correct visa type (in your case a Non-O visa) and you went directly to amnesty from that 90 day entry stamp, you CAN indeed apply for a year extension straight off amnesty as long as you meet the requirements.
I don't know who you're "hearing" you can't do it from but they're incorrect.
The amnesty is until 31 july, after that it is still not officially confirmed, I would say wait for the official announcement and contact after that your local immigration office.
