Will my child be penalized for having a visa-less period during the non-O visa application process?

Hello, today i will go to renew by non-b visa (expiring today) as well as the non-o for my husband and 1 x child (me, husband and child are handled by an agency covered by my company). I also have another child which i need to process myself (not covered) and the agency my company use say i need to wait 16 days to go with him. This will mean he will be 'visa-less' from today until then. Will there be a penalty for this? has anyone else done the non-o for thier kid and can share their experience? TIA!

Children under 15 cannot be fined or banned for overstay, so it shouldn't be an issue. But you should never wait until the last day of your stay to apply for an extension. You can apply up to 30 days early at most offices and 45 days at some offices. All it takes is one missing piece of paperwork or one surprise holiday and you're on overstay.

thanks for the info! Yes we had prepared paperwork much earlier but then a new requirement popped up last minute which delayed it until now. Thanks for your advice 👍

you can apply for an extension when you have 45 days or less left at many immigration offices. No reason to wait until the last day
