I tried to ask before, but I don't think I was direct enough about my ignorance or clear enough on my goals- so sorry for posting again but... here goes:

Finished my 1 year ed visa, returned to USA to do some work, wrapping that up and eager to return and get married. What visa do I use? I assume I go back as a tourist and then while there as a tourist work on transitioning to marriage... is that correct?

You can go Visa Exempt good for 45 days, soon to be reduced back to 30 days. Or get an E-Visa or a Multiple Entry E-Visa, good for 60 Days. On any of these you can get a 30 days extension.

Do understand that any "village" wedding ceremony is not an official marriage for visa purposes, you'll need to register with your local Amphur, as legal marriage in Thailand consists of two parties registering their union with a local Amphur (Thai district office, similar to a county office). It is a process that can take several days to complete.

common sense dictates you get an English & Thai language prenuptial agreement with a lawyer, mate.

It's a good idea to set up a will, too -- especially if you have children or others in your home country you'd like to be beneficiaries.

If you're not married already have no choice. You cannot get a non-O marriage visa unless you are married. Your only option is to go to Thailand and get married then apply to convert to non-O visa. You won't have a lot of time though because you have to have 14-21 days left on your stay to apply for the non-O visa in Thailand.
