I'd like to build a house. For REASONS I am interested in sending the money from USA to my wife here. How did that work? With large transfers does it get declared or flagged or? Is it taxed? What sort of rates? We know very little about taxes in Thailand- nobody in my wife's network has anyone ever had enough money to need to pay taxes.

TLDR : Answer Summary
The post discusses the process and implications of transferring money from the USA to Thailand for the purpose of building a house, highlighting key issues such as tax regulations, limits on transfer amounts, and potential ownership structures. It emphasizes that amounts under 5 million THB typically do not trigger scrutiny from Thai banks. Commenters note various strategies for managing ownership of the property, with some recommending establishing a business entity rather than putting the property in the wife's name, while others advocate for simplicity in financial transactions.

Do not do it.. would you do the same in USA.. build a house pay for it.. but not own it...??
Chris *******
You can send money to your wife there is no tax on that

I transferred from USA through Charles Schwab to my bank account and then I sent it to her

I have also in the past sent direct to my wife

Keep in mind there isn’t anything set in stone, but the Thai government does look at foreign transfers to your account

In that case, you should send everything to your wife’s account

As I did

The people on here telling you to buy it through a company they’re already admitting failure

Everything I have bought here is in my wife’s name proudly seven years married plan on making it the rest of my life

I went into this as a permanent thing

In my mind, put it in a business name is not fully engaging your life partner

Hopefully you’re just as lucky as I am. Good luck.

in appreciate that. I think the are valid reasons to do it, but most of the cats in here are definitely thinking of their future ex wife with these strategies.

Yes mate

I even laugh with her 8 older brothers

I’m not going no where

To be honest with you at this point, I think if I left, they’d kill me because it hurt them, not her

Good luck mate p.m. if you want to chat some more anytime

There are lawyers for things like this let them make a usufruct and have them deal with the paperwork. Dont listen to these facebook professionals just go to a real one (lawyer) and get a usufruct.
Kerry *********
You're right but his question was actually about cash transfers and taxes, not about how to deed the house.

@Kerry ********
in that case he can gift 20million baht tax free if i remember correctly.

I think the safest thing to do is to put land on name of your wife. You put the house on your name. All perfectly legal. On top of that, I will go to a lawyer, and eventually also, loan her the money to buy that land. Stipulate, she cannot sell the land, without complete payback of the loan, and stipulate how you lease the land from her. Run from lawyers, who want to buy with a 100 % Thaï company, the land, where they own the shares.

For tax, and control, bring the money in, amounts, less the 2 million baht. I did it, without problem. There are by the way, more then rumors, that tax rules are going to change again, and even resident, not have to pay from transfers of money earned, the last 2 years. As for now, this is not the case. If money earned before 2024, and with proof, you not pay anything on that.

I haven't met with a lawyer on it yet. I always find it funny when people refer me to western lawyer here since that is one of the protected professions. Why would I trust them to deal straight with me when they are already bucking the system. It's like marrying a lady that you had an affair with.

Anyway, loosely my plan is to try to encumber the land with debt (to me) to prevent some farmer relative from borrowing money against it. Because they don't seem to have the concept of title searches and insurance here I don't know if I can get enough protection in place, but I'll try. I'm not worried about me losing the house. It is for THEM. I'm just worried about them losing it due to lack of financial sophistication. We actually have a business and so I think we might be able to legally have the business own the house- but I've heard maintaining that setup is a bit pricey and I'm relatively poor.

It is very nice, you think about them. My wife is Philippine, but I live here. She is 30 years younger. She cannot own though. But I try to educate her, that after my passing, she not get screwed in Philippines. You right, you cannot trust every lawyer. But if you been around a while, you find someone you can do business with. My mother was judge, so I know. Bit more not to fall for every scam, although this is Thailand.

we my Thai wife and I have built a house in Thailand in 2019 just before Covid. My wife owned the land.Started with cash we brought from NZ the legal amount allowed then just transferred money as required as progress payments in small amounts.No problem and I thought very cheap. My wife did now the builder and we were in Thailand for most of the build.It is a western style house and very pleased with it. I am not worried about I being in her name as we have our own house in NZ.We are in a village and have no problems with here family.
Michael ********
He is only on about sending the money why all the talking about the house. Jack is already on building in Thailand Forum and is aware of all the other things

Do smaller transfers so the tax is not flagged
Greg ******
Living in the village can be very difficult. The in-laws can try your patience.

If I had to do it over again, then I’d live in a bigger city within an hour or so of my wife’s village. That way she can visit anytime.
John **********
If you are living in Canada and spend less than 180 days inside Thailand in the calendar year you send the money there's no tax implications as you will not be a tax resident that year
Cris ******
So i can see all the negative Nancy's are jumping in. Haha. But as for transfers. I would try to stay under 10k USD transfers. If you do, they aren't flagged in the US and I don't believe they are in Thailand. Plus the transfer time goes way up if you do any longer. At least from my experience. Most builder's set up "payment plans" which i would recommend. And makes it easier for small transfers too
Kerry *********
@Cris *****
structuring incoming transfers so that they are small enough to not be reported to anyone has the potential downside of making it harder to transfer your money out of Thailand if you ever need to do so. Generally you can only transfer out as much money as you transferred in.
Cris ******
@Kerry ********
ya. That's why if you only transfer smaller amounts and pay the payments for building. You are never transferring "to much". But if he's building a home the money is sunk into the home anyway.

If you are not a Thai tax resident you can simply remit the funds into Thailand tax free. If you are already tax resident you can gift up to 20 million to your wife. Gifting done say at Christmas time would be traditional and customary. You would be able to use the funds from the 1st Jan. As you have not benefited from the gift in the year it was made the gift would be tax free.

@Pete ******
huh, that is fascinating and sounds ripe for abuse. For clarity- she cannot use the money until the next year? Or it cannot benefit ME?
Pete *******
@Jack ***************
you as the gifter cannot benefit from the gift in the year that the gift was made. You can prove this by showing the wife’s bank account as of 31st Dec with the money there untouched. From the 1st Jan, beginning of the new tax year the funds are free to be used as wished.

@Pete ******
ah, got it. And does this only work with husband wife?
Pete *******
@Jack ***************
suggest you read the gift section of the Revenue Code for more details but you can gift to people who are not immediate family members up to 10 million per year. Go to the Revenue Department website and look up gifting.

If your wife is Thai, DO NOT PUT THE HOUSE IN HER NAME. I REPEAT DO NOT PUT THE HOUSE IN HER NAME. What you need to do is set up a limited company and the limited company owns a house and you’re the main shareholder in the company. Do not use your wife or any other relatives or friends as Thai partners good luck
Andrew *************
@Tony ************
Why, not everyone has a bad experience or relationship, if u believe u can’t trust your wife, why get married.

Been with my partner over 15yrs, bought early in the relationship

My attitude is, we have been together for a while, even if it doesn’t work she deserves something from the relationship, otherwise you’ll be looking over your shoulder for the rest if you’re life

Loosen up.

But I’m guessing you’re a Brit.

Amount less than THB 5,000,000 will not be flagged. For amount of THB 5,000,000 and above, Bank of Thailand will require you to provide documentation of proof of source of funds, letter explaining why you are remitting money into Thailand. Once they are satisfied, they will release the money to your account, else they will send the money back to your account.
Tony *************
@Pete ******
tell that to all the foreigners, who own houses in Thailand 🇹🇭

If buy used, look thoroughly; if condo, same look thoroughly; if want build, map it out with full layout. Bank wise you just transfer.

Found building a house far more cheap than buying a condo. But if condo, despite a few $100,000 more, everything is accessible.
