Hi I would appreciate some advice for a friend. She is from the Philippines married to a Thai man and just about to get divorced. She will have custody of her son. She is an English teacher and would like to know what she has to do about a visa. Meaning a gaudion visa and requirements. Thank you in advance.

okay, she has two choices and before I start I'm NOT calling it a "guardian visa/extension" ๐Ÿ˜ฎ

She can go to the immigration office, cancel the extension based on marriage to a thai the day she signs the divorce decree at the Amphur and immediately apply for a NEW extension based on employment with the correct documentation from her employer

She can go to the immigration office, cancel the extension based on marriage to a thai the day she signs the divorce decree at the Amphur and immediately apply for a new extension based on raising a half thai child by showing she has 400K baht in a thai bank account in her name only OR has a salary inside the country of 40K baht a month from her job here.

Those appear to be the two options she has..

However if she needs time to get stuff together she MIGHT be able to cancel the extension based on marriage and apply for the 60 day covid extension (that could buy her two months to figure out what extension she wants to go for and get the funds and documents together)

All depends on how she has organized her stay.

Option 1: She is in Thailand using the Non Immigrant B visa obtained from the Embassy before she made her way into Thailand and is on the initial 90 days.

Option 2: She is in Thailand using the Extension of Stay based on employment and has a work permit.

Option 3: She is in Thailand using the Extension of Stay based on marriage with a Thai National and has a work permit to work as teacher.

For option 1, no action needed, can apply for an Extension of Stay based on employment.

Option 2. No action needed.

Option 3: She has to cancel this Extension of Stay and apply for a new Extension of Stay based on employment.
