DENIED ENTRY AND SENT BACK WITH DTV VISA.

Date: 13/8

Location: Phuket

Initial Flag at Queue: Lack of return ticket booked. I have entered Thailand between 5-7 times in the last year and was never asked for this previously.

Final Reason for Denial: Direct Quote from the IO 'Foreigners coming with a 5 Year Visa for a 6 month or 1 year schedule is nonsense' He used that EXACT word.

Posting anonymously for obvious reasons but I do feel it's important to share that I am currently sat locked in a deportation room with two other women waiting to be sent back despite having a valid DTV visa. I just skimmed the group and saw a similar post. This is a real threat in Phuket and the immigration officer was all too happy to tell me he deported someone yesterday for the exact same reason. It's not fear mongering because it is happening. Just during my time being pulled aside, several other tourists were sent back for visiting twice within three months on visa exempt. There was also a girl with the workcation option that was pulled aside too.The airline agent also told me people were deported back to Barcelona for taking a picture while in the immigration line earlier today.

I was initially questioned about a return ticket, pulled aside and made to fill out a declaration paper. I was then asked about my occupation and online business and the IOs were focused on my business until I mentioned Muay Thai because my documentation was for soft power. They completely pivoted and began asking for all of my soft power documents and financials. I understand enough Thai to know they were adamant that five year visas should not be given for courses and this visa was incorrect. Ultimately, I was denied entry because my initial application was made with a six month course and in their words was 'expired' based on the receipt day in my documentation. I spoke to several IOs and tried calmly explaining my travels and passport history to show that I hadn't been in the country for the summer months and was in contact with my gym who would be happy to oblige their request of sending updated receipts and paperwork. They refused and said once the date of a receipt of payment reaches the duration of the course the visa is no longer valid. I don't know if they even checked the dates of my arrival because plenty of people apply in advance. They had zero interest in considering someone might continue Muay Thai without a receipt and repeatedly said 'My boss will not allow this.'

The conversation got increasingly murky when they told the woman helping me book a return flight that I needed to cancel my visa and request a correct one. They told me the DTV was not for Muay Thai. Again, they ignored the fact there was nothing inherently wrong with the visa for it to be cancelled. Furthermore, I waited to switch from an METV to DTV and know that visas cannot be cancelled. There are several posts in this group about not being able to have two active visas as well. I asked several times how I could resolve this and was repeatedly told I needed to return to my last stop.

I was also not allowed to get my checked luggage or personal items from my partner and had them downstairs in an airline office with electronics and valuables that my partner had been carrying for me.

After accepting that I was being denied entry, I was lead into a room and presented with a legal document that required my signature claiming I was denied entry due to 'having no appropriate means of living on entering the Kingdom.' This was factually untrue and when I pressed back the woman tried to tell me it was just a general statement. I said I wasn't going to sign a document that acknowledged something different happening than what actually occurred. When I questioned about having the right to appeal this in 48 hours, I was told I could do that but if I took this to the minister and was denied, I would be blacklisted. This is factually untrue based on my research. If you lose an appeal the original blacklisting or deportation order remains.

After this, I did speak with an immigration officer who I hadn't seen before. I was honest and explained I want to be thorough to lessen my chances of this happening again. She said the IO would still have the right to refuse my entry but if I reentered with updated Soft Power information then perhaps the issues could be resolved. She did say I would need to be interviewed again.

I have a flight booked out but I'm now locked in a deportation room with two women that have been in here for two days and leaving tomorrow. I can knock for food or water. There is no hot water but there is a shower. I plan on traveling elsewhere for a bit while I process this experience and I hope to come back at a later date but honestly, this has really shocked me. I hadn't checked this group recently as I've never had an issue but I wish I had.

Please always have a return ticket booked and do not let any of your documentation lapse or you will be denied entry.
Answer summary
A member shares their distressing experience of being denied entry to Thailand despite holding a valid DTV visa. The immigration officer cited a lack of a return ticket and inconsistencies in visa categorization, leading to a swift deportation process. The post highlights the arbitrary nature of visa checks, where they focused on documentation related to soft power courses, and emphasizes the importance of having a return ticket and up-to-date documentation to avoid similar incidents. This serves as a cautionary tale for expats and travelers to be diligent about immigration requirements.

I have not experienced any issues doing exactly what you described. Immigration didn't hesitate over it.

I get a direct deposit from Social Security each month into Bangkok Bank over 100k. I've been doing the income method for the last 5 years. No issue

As long as you have over 65K baht/mo showing as international transfers (The labeling of the inbound transfers matters!), anything above the 65K floor is fine. Just do NOT let it get below 65K/mo. Not even once.

I just let my agent take care of the renewals, just because I hate dealing with the frustration of gathering it all together. It's worth it to me, to not have to deal with the hassle of it...

Micheal Millsaps I lost out on a renewal 2 years ago because my “monthly” deposit was delayed by a bank holiday + weekend and arrived on the 2nd of the following month instead of the 30th.

Total refusal by the clerk to look at the obvious statement showing the obvious fact. Even the bank transfer receipt showing it was initiated on the 28th!

So yeah, stick with the full 800k deposit all year.

(That was my initial plan but it dipped mid-year for a few weeks when I paid for a renovation prematurely when the contractor needed to order materials. I should have been valid for all three bank account criteria otherwise, but the officer was having a bad day and would lose face by reconsidering the evidence. )

Dan Morrison I'm glad to be rid of the 800K. Why in the world, would you schedule the transfers so close to the change of the month? 🤨Make it the 10th, 15th, or 20th... No problem. Doesn't seem like rocket science...

did you apply for the Dependant Non-Imm-O Visa before your flew to Thailand? If YES, then everything is fine, you do not need to prove any deposit in your account nor any income, for the application to the 1-year extension of stay. However if you entered on a tourist visa, you will encounter the problem that you cannot apply for any extension based on being a dependant of a foreigner who is on a 1-Year Non-Imm-O/A Longstay Visa. You must apply for the Non-Imm-O Dependant Visa in your home country

I hold 1.2 M thb. Never drop under 800k. Pease of mind. No notaries. No consulate. Just bring your bank book and a statement from your bank. One day, when I say good bye to Thailand, it will be my saving money to bring home.

They want you to make a spreadsheet showing the 65K per months in deposits so if you send 70K a month to satisfy the 65K+ income requirement and and another 20,30,40K occasionally for other expenses here, I'd just not include them on the spreadsheet.

They want to know where the 65K comes from (pension, passive income etc.) and they want supporting documents to show that. As long as you have one (or two) proofs of source of income that matches the deposits you should be fine. if they ask about the other transfers just tell them it's for other expenses and you're not including it in your application documents because you've already satisfied the income requirements and showed where it's coming from.

I'm guilty of both. but as it's in use I usually have it well above the cut-off limit so it's easy for them to scan as > 1M. But yeah it's 21 pages instead of 3. not my problem. I do have a secondary "household" account I should be using, but the payment app always defaults to my deposit account. I should change that I guess..

Can you deposit more some months or does it have to be the same each month? Also it took us about 2 weeks to open the account, it's impossible to get 12 months worth of deposits in before the year is up. Can we double up one month or we can't use the 12 month method for this first extension?
Curt **********

@Lisa *****
Absolutely not. I transferred more than 100K each month for a year, over 65K every month except for February where my second transfer of the month arrived three days late into March and they declined to renew my retirement renewal because only 50K had arrived by the end of February so I had to go ten months on other visas until I had 65K each and every month.

It was like a scene from Spinal Tap talking to immigration. "But this one goes up to eleven". Why don't you just make ten louder?" But this one ins one more'.

I asked why. They said "To make sure you have enough money to live here"

I told them I had a six figure balance in my account and the 70K showed up three days later. "But the transfer wasn't credited in February". I told them there was a bank delay. I had enough to live on, no need to worry about me, I'm not living on red beans and rice. I'd transferred double the amount they required over the past twelve months. "But you didn't have 65K show up in February...

Your deposits can vary month to month but no month can fall below 65k. You start doing the 65k deposits when you apply for your extension based on 800k so, 12 months later when it is time to do your next extension application, you will already have 12 monthly 65k deposits to make the switch. Don'y forget to maintain the 800k for the first 3 months then never fall below 400k for the rest of the year too.

nope. There's no averaging. You need a minimum of 65k baht transferred from overseas each month for the full 12 months immediately prior to applying for the extension of stay, else you have to use the 800k baht method. For that you need a minimum of 800k baht in your thai bank for 2 months before you apply, you have to leave it there for 3 months after getting the extension and can't drop below 400k baht at any point in the year.

But I'm curious as to what visa you originally entered Thailand on, if you entered on a 90 day Non-O visa then that plus the initial 12 month extension provides plenty of time to get 12 months of transfers prior to applying for the 2nd one using the monthly transfer method. If you originally entered on the Non-OA visa you can actually get almost 2 years out of it by leaving Thailand and re-entering just before the validity of the visa expires as long as you have insurance cover for that 2nd year, again plenty of time to get your monthly transfers sorted

if you and your daughter are both on Non-O visas as his dependants rather than being on retirement or anything else then you are dependant on him, there are no financial implications for either of you. You just go to immigration and apply for an extension, which gets aligned with your husbands permission to stay date. For example, if your husband is permitted to stay until the 31 December this year and you go for an extension of stay tommorow your extension would only run until the 31 December this year
