TLDR : Answer Summary
The conversation discusses the requirements for obtaining a Non-Immigrant O visa to support a half Thai child under school age. It highlights the need to be a registered parent, the importance of the Certificate of Child Legitimation from the Juvenile and Family Court, and mentions that legal representation may be necessary to navigate the process.
The visa for supporting a Thai child (Non-Immigrant O) in the case of unmarried parents requires you to proceed through the Juvenile and Family Court, even if your name is listed as the father on the birth certificate. You must file a petition with the court and then go to your local district office (Amphur) to obtain the Certificate of Child Legitimation (Khor Ror 11). This process may necessitate legal representation and could take around three months. Once the Certificate of Child Legitimation (Khor Ror 11) is acquired, you can submit it along with your application for the Non-Immigrant O (Support Thai Child) visa.
Not for the 90 day Non Imm visa, that can be obtained with your name on the birth certificate. Parental rights through the Family Court process is only needed for the12 months extention of stay.
thank you, I have both the birth certificate and the court paperwork so no issues there. Is the first step obtaining a 90 day Non O visa? And can this be done inside of Thailand swapping from a different visa?

These are the in country general requirements for the 12 month extension, expect the visa requirements to be similar. Are you the registered parent as that is normally the toughest requirement for Immigration?
thanks for the document Graham. What do you mean by the registered parent? I presented to the office to notify of my daughter's birth to obtain her birth certificate with my name on it as person who notified and as the father. Also as my partner and I aren't married I went through the courts to legitimise my daughter. I've obtained citizenship by descent and a passport for her from my home country.
As you were not married at the time of birth and your daughter is under 8 you need to go to the family court to get full parental rights which is required by Immigration to get a 12 month extension. Is that what you mean by "went through the courts to legitimise my daughter" because I thought that was expensive and took some time?
I see another comment mentioning a document "Khor ror 11" which I have, so hopefully that document is the one required. I do also have the official court ruling documents if they are also required.
yes that’s what we did (registration of child legitimisation) when our daughter was about 3months old. It didn't take very long from memory, maybe a month, as first we needed to go to an interview at the juvenile observation and protection centre to have a report completed before then being approved for a court date at the children's court. There is quite a bit in the court ruling but mostly it states "Miss.....is to be recognized as the legitimate child of the petitioner (me the father). The petitioner and the child's mother are to jointly exercise parental power. The court's decision was based on evidence provided by the petitioner and a report, and the mother consented to the requests.
Miss.... is declared the legitimate child of the petitioner.
The petitioner and the child's mother will jointly exercise parental power.
The petitioner's requests were granted with the mother's consent" We used a local lawyer, the cost was about ฿30k-฿40k from memory. After receiving the ruling I was able to use the ruling to open a bank account for my daughter.
too easy, hopefully I don't ever need to get the visa. I'm just preparing a backup plan incase there is any problems in the future with my elite visa before I reach retirement age.
