What are my options after being blamed for a motorcycle accident in Thailand, especially when the rental contract specified insurance that doesn't exist?

So i got into a car crash im a foreigner i was driving a rental bike ( sober and have valid thai motorcycle licence). I got into a crash with a suv. I was blamed fault and the police made

Me sign admitting fault (wouldnt let me go hospital until i signed i know dont sign). It ends up that the bike did not have the insurance that the bike rental specified in the contract (basically the rental contract was a straight up lie) and the actual coverage is just the po ro bor coverage.

Now apparently i owe for the bike and also the car as the collision is “my fault”. My question is there any recourse against the rental owner for the fake wording of the rental contract it doesnt feel fair to me. Also the car i hit is fully insured but yet they demanding i pay they entire cost of repairs not their deductible.

Anyone have any advice?
Summary so far
A foreigner involved in a motorcycle accident in Thailand, where he was blamed for the crash and pressured to sign an admission of fault. Despite a rental agreement claiming insurance, the bike was only covered under basic government insurance (po ro bor), not sufficient for repairs. Many comments highlight the challenges faced by expats in Thailand regarding legal matters, with suggestions for getting local legal representation, details about the liability laws favoring locals, and the advice largely leaning towards negotiating or paying off the claims due to the complexity of the system.

In my experience it's impossible to insure motorbike for a rental purpose in Thailand.

Does the contract mention an insurance ? Or does it mention the value of the motorbike ?

In a classic process, police let you go to the hospital first and organize an interview later.

Also does the suv have his own 1st class insurance ?

In your case look if it's valuable to get a lawyer to fight for your right

What insurance was “specified” in the contract? Because the compulsory insurance is insurance. It just doesn’t cover vehicle repair costs.

No rental bikes genuinly do not have insurance, what little it does have does is not covered in accident. Buy the bike or go have it repaired on your own, u let them repair it, it will be more. There really is no fighting it. Been renting bikes there for 5 yrs. Same if u get travelers insurance, very rare for any travel insurance to cover hospital bill if you wreck on bike even if your a passenger. Good luck!

In Thailand, it almost doesn’t matter who technically has the right of way. As a foreigner, you’re often starting at a disadvantage, and good luck expecting the system to automatically side with you. I honestly haven’t heard many stories where the law has clearly worked in a foreigner’s favour. Everyone who’s lived here long enough has heard stories about CCTV footage suddenly being unavailable, evidence conveniently disappearing, or cases being handled in questionable ways.

What’s even more surprising is how little concern there seems to be about the country’s international reputation when it comes to these things. Thai police officers probably wouldn’t have the easiest time transferring their professional reputation to law enforcement in many other countries. 😂 It’s a running joke internationally, and unfortunately, Thailand’s justice system has done little to shake that perception.

1. Deal directly with the other vehicles insurance company, not through the person who owns the vehicle.

2. Did the insurance company show up at the scene of the accident? In Thailand the police can say it’s your fault, but the actual financial decision rests with the insurer, not the police.

3. As far as the rental contract, if it says it’s insured, I would talk to a Thai lawyer.

Lastly, TBH I struggle with your “they wouldn’t let me go to the hospital until signed admitting fault” claim. Maybe a language barrier issue.

I had similar experience. Not my fault and they wanted me to pay. It was just in the beginning when I moved to Thailand. I had to pay 10k baht for maybe 3k in damage but my own bike was costing me a total of 20k baht to fix.

I later explained to some Thai people and they said the next time I had to call them and they will help me out.

So if you have some Thai friends, let them help you out.

If that doesn’t help film everything, and say you will publish this online. Good luck!

Appointed Lawyers are on kick backs.

Pay the bill whatever it costs, get on with your holiday and try and enjoy it..

If the motorbike was taxed you should be able to get some compensation for medical treatment from the hospital your rental dealer should be able to help you with this but highly unlikely they will..

And the best part of all of this is = if the bike rental or police has your passport you are going nowhere until this is all paid up.

Thais will always stick together in 90% of the cases. You either get a lawyer and fight with cctv and likely find out the other driver didn't have a licence or insurance and was at fault, which will cost, or you pay what they ask for. Both the driver and the officer will get their cut and you will be free to go. That's just how it happens, sadly. And yes you signed admitting responsibility so kinda have no choice now, unless you fight that too which will cost a whole lot more!

Well the Thai system is different from France and most of accidents cases are dealt at the police station with agreement between parties.

I never heard of a rented motorbike with full insurance, maybe the big bikes but I never rented one.

I have been living in Thailand for 8 years, own a car, several scooters and a Versys 650.

I was also involved in several accidents which two of them considered my fault when only one of them was and even there open to debate. Finished in court.

Your only possibility here it's to go to court. You will have lawyer, maybe local, who would be probably happy to do it.

And I can tell you by experience that it will not bring you anything, and certainly not saving money.

Things are the way they are and you have just to accept it.

Thailand is a wonderful country with its own rules and habits.

So far I know. Scooter rental contracts have (almost) always only the compulsory insurance and not a full first class insurance.

So even you read insurance included in the contract it’s most likely the basic government insurance.

And yes, you will be financially responsible then for all the damages and not much you can do about it.

You could bring the rental company to court if you think that you are right but you have to count for a very lengthy process (can take years) and you most likely can’t leave the country meanwhile.

Robin Finucane who cares because you and I both know the foreigner didn't cause the accident but the police want him to pay for it. I was in a car stopped because there was an accident maybe 20 cars ahead of me and a guy didn't see all the stopped cars and plowed into me and another 3 cars before going off the road. I was standing there with all the people. I called the owner of the car and told him what just happened he asked me to take the phone to a police. The police told him I caused every accident there and I was going to be arrested. Haha stupid but the guy on the phone owner of the car I'm in was Thai Mafia and sent a guy and we all drank whisky together. Sang som. It's very tiring that the foreigner is always called guilty and expected to pay no matter what. Another time I came up on an accident where there was a dead woman pinned to the dash and a young child stuck between her and the dash but still alive they were beating on the car and screaming. I reached in slid to seat back and they freed the child. Then as the cops came a Thai lawyer told me to leave as the people were already saying I caused the accident. So yes walk away. Thais are fed up with Israeli and Russian tourists but don't try to tell me that foreigners alike suffer from bs scams from police.

So many different theories here. Will be interesting to hear the outcome. Remember Por Ror Bor is third party ins. It does not cover the bike damage, only covers basic medical/hospital expenses for bodily injury or death. "Legal right under Thai tort law to subrogate—meaning they can pay for their own repairs first and then sue or aggressively demand recovery of those repair costs from the party at fault (you)". If she signed a document admitting fault, it will not be easy to get out of paying. I wish her luck.

Leave Thailand as soon as you can if you have a passport. If the SUV was driven my a Thai. Don’t waste your energy.
THENA******
**The forced signature:** Police can't legally force you to sign, and a statement signed under duress (kept from the hospital) can be challenged later with a Thai lawyer. Get your hospital records showing when you were treated. If there's any CCTV or dashcam footage nearby, get it now, before it's overwritten.**The rental shop:** This is your strongest angle. Since October 2025, car and motorcycle rentals are "controlled contract" businesses under the Consumer Protection Board (OCPB), so a contract promising insurance that doesn't exist is exactly what they police. File a complaint via the OCPB 1166 hotline, the OCPB Connect app, or ocpb.go.th. Get a Thai speaker to help. At minimum, the fake insurance is grounds to refuse paying for the bike, or pay much less.**The SUV:** They can't collect twice. If their insurance pays, the insurer may come after you for it, but the owner can't also demand full cash. Owners push cash to protect their no-claim bonus. That's a negotiating position, not an entitlement. Demand itemized garage quotes. Por Ror Bor only covers injuries, not the car.**Next steps:**1. Get the police report and a copy of what you signed.2. Pay nothing more without documents.3. File the OCPB complaint.4. Have a Thai lawyer send one letter to the shop and the SUV owner. It's cheap and changes the tone fast.
David ***********
David ***********
You did what you felt pressured into doing at the time that’s understandable, what’s not understandable is the handling of the situation by the rental company. Pure sham. I hope you win, in court. Civil courts in Thai would be on your side, find a lawyer. 🙏🧡

Regarding the SUV just tell the owner you do not have the money, the insurance will pay, they can only sue you but it will take times and the can't hold you in attempt. Regarding the shop go to police and make a fraud report, and tell the shop you won't pay and you will let the court decide. But you will take care that everyone will know that the shop does not have any 3. Party insurance. And let the contract be checked by a native speaker

They have no helmet and driving with alcohol, marijuana , Krathom and drugs. They don’t test it. They blame always to foreigner and they tried to get all the money and ask you to pay 300K, plus for motorcycle damages and hospitals. Sometimes they uturn without glancing, no taillights, overspending, driving against the traffic, turning with incoming traffic , parking in the busy road.

Rick McPherson my girlfriend has been hit 3 times in less than 2 years and thankfully our insurance was good each time. As it happens my car was stationary waiting at a red light. The police called us both into the station and pulled up the CCTV. This is Thailand. It is quite normal for any foreigner to be blamed for anything and everything if involved in anything involving a Thai. Yes, signing something in Thai without being able to understand it, get legal representation or get a translation is perfectly acceptable and normal. Of course the bike complany lied to you. It's Thailand! On your last point, you will of course have to pay for the bike, the car, the hospital fees and perhaps a donation to the Tea Money fund for doing such a great job might be a good idea. This may require a lawyer which is big $$$. It no country do you pay the other person's excess, especially if you are clearly at fault.Seeing as insurance is involved, deal only with the insurer, not the owner of the car. Here you may be able to negotiate the amount and liability. Keep pictures of everything.Don't just blindly agree to a new bike, unless it's totally bent up, it can be fixed. Get quotes Good luck

It will not be easy, you really should not have signed and instead called a Thai person to come and help you talk with the cops. It always helps and you'd be surprised how much more flexible they become. As for legal recourse against the rental company, you will definitely need a good lawyer. I've never had such a case but I did once hit a pedestrian while driving a motorcycle I owned, which was not insured. The moron stepped right out into the road without looking and was trying to blame me. I said it was the woman's fault for not looking. Honestly, I would have just paid her hospital fees because I'm nice, but she decided she wanted to milk it and demanded 80,000 for loss of earnings because apparently she's a "pretty" that promotes products at malls or whatnot and because of a few minor scratches on her face she would not be able to work for a month. Anyway she was taking the piss, she was kinda old and definitely not hot, there's no way she's making 80k a month so I chose to fight in court. Fortunately I have a very good lawyer, who decided to milk the fact that my son was riding with me and both of us were hurt. She managed to find CCTV of the accident which proved this woman stepped right off the pavement without looking. In the end the judge decided she had to pay me lol. Then she said all she can afford is 1,000 per month (despite apparently earning 80k lol). But as I said, I'm nice, so I declined her money, in just asked she pay my legal fees and that's it (about 8k). Hopefully she learned her lesson. Anyway, the point is foreigners can in fact win. And my day in court was quite exciting lol. But you do need other Thais people on your side.

You need to read the contract with the shop carefully.

You may be able to get them to foot bill if they state insurance is included for liability and damages (very rare). This may require a lawyer which is big $$$.

It no country do you pay the other person's excess, especially if you are clearly at fault.

Seeing as insurance is involved, deal only with the insurer, not the owner of the car. Here you may be able to negotiate the amount and liability. Keep pictures of everything.

Don't just blindly agree to a new bike, unless it's totally bent up, it can be fixed. Get quotes

Good luck

Roman **********
Roman **********
Ian Brooker Contrary to popular belief, I have found the Thai legal system fair and objective. It's slow and cumbersome sure. If they state liability insurance in the contract, that's hard to argue out of and certainly not Por Ror Bor.

It might not cover the car, but it gives an out not to pay for the bike.

Jomayha Susjs Don't pay the car owner in one go. Negotiate for monthly installments if possible. Say, if the total cost for the car repair is 100,000 baht, negotiate to pay 20,000 baht a month to their insurer, for instance. Speak politely with the police but do not incline to do everything or pay in full at once if they tell you to do so. By the way, why did they blame that you were at fault?
Lynn ***********
Lynn ***********
Jomayha Susjs There must be cameras around, that could have recorded the incidents. If you get to see the video clip of the accident, at least you can make good understanding of the entire situation, such as why the car obstructed the traffic, did it blink signal before stopping or was the stop due to the sudden stop of the traffic in front of that car, etc. In my understanding, when someone hit the car in front of them, it does not mean that the car is always right. If its sudden stop causes traffic obstruction, it could be at fault also. Motorbikes that are unable to stop in time because the car in the front stops suddenly and unexpectedly without signalling should not be blamed really. The difficulty would be that you have to gather evidence, which perhaps only lawyers can help. A preliminary consult with a lawyer may cost Bt.5,000.

You shouldn’t sign anything, ever. Especially if it’s not written in your language.

It wouldn’t surprise me at all if the motorcycle shop was owned by the cop, his wife, family or neighbor.

Second, as far as I know, there are zero insurance companies in Thailand that insure rental motorcycles.

No matter what policy the shops may have purchased (and the majority “self insure”), as soon as the insurance company discovers the bike is for hire, all claims are denied.

Jomayha Susjs tell the police that your not paying anything and you’ll go to court if required. You have proof of the lies that the hire company told, in writing, to prove that you were unaware of the bike not being insured. As for the the person you hit, if he’s insured, he will be claiming on his insurance regardless of what he says, if he has an excess payment in his insurance, find out what that is and you could possibly tell him you’ll pay the excess fee. Anything else that he charges you for “repairs” will be just for him as, as I have already said, he’ll be using the insurance to pay for the repairs. Only problem you have now is that when the insurance pay, as it was your fault, you will be contacted by the insurance firm and expected to reimburse their costs for the repairs.
