How feasible is it to open a business with a Thai person, and then get an approved business visa within 6 months? I have been here since February. The best case scenario would be tom come back in August and do the same tourist visa process. Then my understanding is I can start the 4 month cycle over at the beginning of the calendar year? Whatever the case is, I am hoping to have the business sponsor me and be able to work here after. Thank you for any guidance. I am well aware of the risks of doing business here. It will be a relatively small investment.

TLDR : Answer Summary
Opening a business in Thailand with a Thai partner involves several requirements. You need two Thai directors who must be genuine investors in the company, and your business will require a minimum capital of 2 million baht and four full-time Thai employees to support a work permit application. Engaging legal assistance is advisable for navigating the complex process, which can cost around 150,000 to 200,000 baht. Additionally, foreigners cannot hold more than 49% ownership in the business, so partnering wisely is crucial. If executed correctly, it may be feasible to obtain a business visa within six months.

So you Wil give thai person 51% if you go one and one.

If you do with two thai. You keep 49%. One get 26% one get 25%. This way you don't lose your shirt. Yet a lawyer as you will need. Everyone else will give you other advice.

I'd say find two thai silent partners. Like I sadi that way you keep the leverage

no you have the greater percentage. You hold 49%. The 2nd person gets 26%. 3rd gets 25%. This is how it works.. 49 is higher than 26%. That's the leverage. That's the loophole. Straight up. A foreineger cannot hold higher than 49%

You gotta tell us if you are American or not. If so things will be much eaiser. But talk to a visa agency, they will find "creative" ways for you to open a business.

There are lawyers and they will sort out everything for you, they will charge you around 150k baht to 200k baht.

They will arrange all the paper works for you , you won't have to worry about finding directors or finding 4 employers to get work permit. They will arrange everything for you and you will have a right to start business in Thailand.

Now things what you will need in real if you are really interested in starting business is a place where you want to sell your service , product etc.

Let's say an example of portable coffee cafe will cost you 75k baht and a shop or place will cost you 6k baht to 16k baht depends on the place and then equipments for serving customers like furniture & crockery etc so let's say 15k baht.

So just keep in mind that any small business will cost you minimum 100k to 150k baht.

So the conclusion is almost like this.

● Lawyer service : 150k baht to 200k baht. ( this will include all the things foreigner needs in order to open a company, work and stay in thailand.

● Shop or place for rent : 6k baht to 16k baht ( mostly owner charge first 3 or 4 months rent in advanced)

● The business model cost : 100 k to 150k baht. ( any small food cart, portable coffee shop ,printing & photocopy centre, small fruits store or small phone accessories store, or laptop & phone repairing service etc).

Note : The business model depends on your idea as how much you wanna spend to start business with. It's all upto you whether it's an ecommerce business or a physical business.

You will get the estimate of it by your own calculation according to your idea that from how much income you wanna start the specific business.

You will have to pay tax as well and this service is also provided by lawyers, they will cost you 1000 baht to 3000 baht depends on the price of the accountant provided by the lawyer or you can do it later by yourself as well once you get used to taxation in Thailand.

not everyone understands lac or lakh however you want to spell it, you might want to correct it into 150k 200k etc as you did spend a lot of time in the comment that is definitely useful.

yeah you are right. I edited my post. Thanks for helping me to better deliver my words.

You need 2 Thai directors, not just one. They also have to actually be investors in the company, not just nominees which is illegal.

The company will have to have at least 4 full time Thai employees before it qualifies to sponsor a foreigner for a work permit, and the business must also have 2 million baht in registered capital. To me that doesn't seem like a small investment, but I guess some people have a lot of money.

whilst most of your answer is correct and well presented factually, unfortunately you are mistaken with regards to the directorship. You only require one or more directors which can be Thai or Foreign.

With regards to the authors question as long as the necessary business and employees are in place it is completely feasible to obtain a Visa and work permit within his timescales as long as the company is operating legitimately and has purpose

Apologies for having to correct the above

Should the author wish any further information I suggest he contacts the following

I guess everyone that says 2 is for dilution. I didn't realize that.

yes, it would always be advisable when you have a foreign interest to always register yourself as a Director however, where you do not and you are an employee that would also entitle you to Social Security and medical benefits however, my recommendation would always be to secure your investment and control with registering the overseas party as a Director

only one is required but would you really put all your eggs in one basket, they can't just be nominees with zero power any longer

@John *********
yes, as far as I know. If its 2 million baht capital then 1 thai partner is required but if its 4 million baht capital then 2 thai partners are required.

Interesting, thank you. That does eliminate it as a quick and easy option. This is absolutely doable within 12-18 months though. What do you recommend before then?
