TLDR : Answer Summary
The user currently holds a 60-day Visa Exempt entry stamp which can be extended for another 30 days by applying at a local immigration office. As a father of a Thai child, the user is eligible to apply for a Non-O visa, even if facing divorce, provided they have proof of parenthood (like a birth certificate) and sufficient funds in a Thai bank account. It's advisable to gather required documents such as the birth certificate, proof of support, and any custody or visitation agreements for the visa application.

Unrelated to your post, i just wanna get this out that there will ALWAYS be one or two smart-donkey(s) who will lecture how relationship work.

Chances are, he/she is in fact just a l0ser who probably had gotten kicked out from few cheap bars in red districts and/or had been scammed and robbed by his/her choice of escort.

Do ignore these kind of pathetic scums and god know why they even be here at all since at best they can only visit Thailand once in a while when Saturn aligns itself with Venus on our solar system yet the audacity to lecture everyone like he/she knows Asian cultures based on Tiktok videos they just watched.

Your old Visa is history, you need to apply new! As you are now not on a tourist Visa in Thailand, you need to change this first (recommend an agent) and then go either family visa or easier if 50+, Non O retirement.

Why would your wife want to divorce you? My thai wife flys off the handle from time to time too but she gets over it, I'm her meal ticket and she knows it. Take her to a local beer bar and point out all the aging whores and ask her it's she really wants to go that route. Common sense will always prevail.

If you were married to the mother when the child was born and you have the required funds in a Thai bank account you could apply for a Non-O visa based on being the father of a Thai child. If you were not married at the time you need to have legal proof of fatherhood

Yes you can convert your visa exemption to Non im O 90 days, and extend this 1 year. The latest you can do it is 15 days before you stamp expires. But better start before that.

Dave Flago In thailand, if the wife divorces, the man is not obligated to care for them or their children anymore.

Derek Smart Your relationship with your wife has ended. This type of relationship can end by agreement. Not such for a child, your relationship with your child, specially in their eyes never ends, how can you stop being the father of a child, you can't. You can chose to ignore the child if you want by blaming the mother, but that doesn't alter your responsibility as a human or parent.

Derek Smart If the children were born while they were married they are obligated to pay child support.

Or he could be a decent man and do it anyway regardless of legal obligation. It's not the kids fault the wife wants a divorce.

Not legal advice but - You can apply for a Non-O visa based on your Thai child. It’s not affected by divorce. You’ll need your child’s birth certificate, proof you support or have custody/visitation, and finances (about 400,000 THB in a Thai bank or steady income).

You need to have custody and children living with you so yes it is affecting by divorce.

Newa Ccount I think that “Thailand0007” is correct. You might need to leave to get your “O” visa, but you should qualify as the parent of a Thai child. Best of luck.

You’re probably overthinking this. I use an agent once a year. It’s so easy. That info can get you qualified there’s probably other options for you as well. The owner of this group is a Visa agent that can help you apply.

Not sure what country you are from but if you got stamped in for 60 days then you will have been stamped in visa exempt not VOA. You have no visa at all. Can you extend this visa yes you can by another 30days. You will need to do to your local immigration office to check what they need to see for the extension. You dont need to wait until your visa exempt runs out you can go typically up to 3 - 4 weeks earlier but again you need to check with your local immigration office, the extension will be added to the end date of your current exemption stamp

You don't have a visa you have a 60 day Visa Exempt entry stamp which can be extended once for a further 30 days. You can still get a Non-O as the father of a Thai child if you want to take that route in the future.

you need to click onto number 7 in the list of Immigration's website for the "change of visa type"

Thailand0007 sorry but your name on the birth certificate on some Immigrations is not accepted as proof of fathership. Many Immigrations want to see a family court order that you are the legal father. The daugther been born during a legal marriage might be helpful, and makes your name on the birth certificate enough of a proof. You could apply for the "change of visa type" from the 60-days visa-exempt entry to the 90-days Non-Imm-O Family Visa based on Support of a Half Thai Child. You would need a minimum of 400,000 THB sitting in your Thai bank account in order to be able to appy for the "change"
