Do New Work Permit Regulations in Surat Thani Require Leaving Thailand During Processing?

Hello Again! I have another "unusual" circumstance question.

My daughter is on a teaching work permit, and lives/works on Koh Samui, Surat Thani. She recently got a new job as a manager of a language school :o

The person handling her work permit at the new job says that a new law (only affecting Surat) requires you to go out of the country and STAY away for the entire time you are waiting on the permit to be processed! It is said that the process could take up to one month. Sounds hinky to me.

Any experience/knowledge on this lately?

Is your daughter from South Africa, and are they trying to get her a new Non-B visa from Malaysia? If so, it takes a month to issue a Non-B for South Africans in Malaysia.

Sorry but Koh Samui is part of Thailand and they might think as an different Island the laws are the same as the rest of the country.

But said that, the question is on what visa or extension of stay is your daughter now inside Thailand.

I think nothing stops your daughter for coming back on a 30 days stamp until you have the wp3 and paperwork ready to go to an embassy happy for your new non b Visa (but she wouldnt ne megally working so take this as an in between jobs holiday). To be checked...

Took me a month but only because my new company couldn't be bothered translating all the documents into thai, so I got stranded in Vietnam for a while until they pulled the finger out.

In my experience it took maximum 7 days, but it all depends on the employer, the speed of the copy machine, how many applications are in progress at the same time at the Ministry. To many variables to tell exactly.

The person of her new company want to apply for a Work Permit for a person who is abroad, the application method WP3.

It is logic that the person is abroad during this application

And with the WP3 application approved your daughter can apply for the Non Immigrant B visa to come back into Thailand.

That means as she stops working as teacher for this school the Work Permit and the Extension of Stay has to be cancelled and she has to start from scratch again and has to leave the country for a new visa.

Okay, she had a work permit and is teacher from a school, i try again. Try again: Does your daughter use a visa and leaves every 90 days the country to buy a new visa at the Thai Consulate or does your daughter have a big stamp inside her passport with the text Extension of Stay permitted up to ../../..
