My partner got married in Thailand to an English guy 10 years ago.

They have been separated for 5 years.

Is it true that she can now divorce him in one day in Thailand?

TLDR : Answer Summary
Yes, in Thailand, if both parties agree to the divorce, it can typically be finalized in one day at the district office, provided both parties are present along with two witnesses. However, if they do not agree, or one cannot be reached, the process may take longer, often requiring a court hearing and potentially lasting 6 to 8 months. After a divorce, Thai women must wait 310 days to remarry, unless they provide a medical certificate confirming they are not pregnant.

From what I've read a Thai lady once divorced cannot remarry for 305 days after her divorce.

They can remarry during the period of 310 days after a divorce, but they have to show a medical certificate stating that they are not currently pregnant.

If the marriage is registered under the Thai law and both parties voluntarily agree to divorce, it can be done at the district office in one day (couple hours). It requires 2 witnesses.

If one party doesn’t agree to divorce or cannot be contacted, the other party can sue for a divorce based on 3 years separation or other grounds matching the situation. The applicant also have to provide to the Thai court the divorce law of their nationality.

When you file a divorce petition at the court, the court will accept that she legally receives your petition if you send it to her address according to the registration at the district office. It’s an official address of Thais, unless they are removed and put to the central house registration.

Absolutely yes, if they can come to an agreement about the inheritance, property, etc.

If not, they will have to go to court, and the judge will make a decision. It usually takes around 6–8 months.

I divorced in January. We both went to the district office. I had a lawyer. The process took a little over an hour. It was an uncontested divorce. It was final that day.

Consult a lawyer if they both don’t agree and/or can’t go to the office together.
