TLDR : Answer Summary
The cost of divorcing a Thai wife can vary significantly, often depending on the circumstances of the separation and whether an agreement can be reached amicably. Comments from the community suggest that administrative fees can be as low as 100 baht if both parties agree and the process follows a straightforward path without disputes. However, others humorously claim that the emotional costs and potential financial losses (like splitting assets acquired during marriage) can be far greater. Many commenters advise that if no assets are shared, the divorce could effectively be 'free' as long as you have the necessary documents and witnesses. It's also suggested to seek legal advice, particularly if assets or children are involved.

was looking into that, in case of my ex returned to the house, and advice given in a local farang group was, to walk away, lawyers would skim you out more money, and drag the affair out, I was told that a farang bought a house nearby, he was not even allowed to inside the house when visiting TH from USA, FULL OF RELATIVES having fun - an uncontested divorce could quickly turn into a contested divorce and then your is in for one hell of a rollercoaster ride, they said

I had a friend come back to settle up. He died within a month of returning. I talked to a Thai woman, telling her the story. She said it’s not unusual. Before he died, he asked the little lady if she had ever loved him. At that point he should have kept his mouth shut before losing his last shred of dignity.

Half of marital possessions yes, but not half of what you had OUTSIDE of the marriage. That's the law.

Anyone who gets stung badly is their own fault.

Sort it first, and as i said earlier, if they won't agree, don't marry them, and definitely don't by them a house or land. Otherwise you WILL get stung badly.

As a Thai wife of foreigner, your income during a period of being married should be devided
*****
with your wife included properties. If you both have Kids, and the Kids will stay with your wife, you should pay her for talking care of Kids monthly by agreement with her (how much should be enough to raise your Kids). But this is by civil law, there is another way = hire the lawyer and make agreement with her before going to divorce.

that is wishful thinking. 50 /50 split? In the west there are laws setting out marital assets distribution. Here there are no protection for any foreigner. As for any child from the marriage... child support should be arranged. Unfortunately the mother will insist that said coverage will also include her other children. So good luck even with a lawyer... it is a much steeper hill to climb over here than in the West.

No, you are wrong.

Like in your home country, think with your big head, and not your small one, and cover yourself. If they don't agree at the very beginning, you shouldn't be marrying her in the first place.

But trouble is, people leave their brain at the airport on arrival.

Same old same old, 'My girl is different' 'She would never rip me off'. Yeah ok, up to you.

People should watch a Youtube channel called Thai Talk With Dan.

He's not a genius himself, but shows everyone how naive and green people who arrive here with their dicks out are.

You'd think with the internet, people would be a little less stupid, but no.

It's simple.... Think first.

What you have outside the marriage stays yours. Everything inside the marriage is shared equally BY LAW!!

Safer still, sign a usufruct which entitles you to live in the marital home for 30 YEARS!!!

If she wouldn't sign that, then don't buy them a house.

Technically, she could still sell the house, but no one would buy it as you are the leaseholder, and they couldn't take the house until the usufruct ends (up to 30 years).

If I own a condo before we get married the condo stays with me right?
Like
Reply

@Lucas ******
Yes my friend, it does.

Thai law itself isn't the problem. It's fishy corrupt lawyers, etc that can be the problem.

But your condo is safe. Also, as long as you prove you had big money before you married, they can't touch that either. All you had outside the marriage is still yours. Her lawyer would try it on (like divorce lawyers do), and pressure you into paying out, but its not the law.

So these people on here who say you would lose everything, haven't got a clue. They are just saying it to try and ruin a life or two.

If it was a house in her name, you could of still got a usufruct (30 year lease) on that marital home, she couldn't evict you. And no one would buy that property if she tried to sell it. The only way for her to sell, is if you would sign your name off the chanote. Which you wouldn't do, or you'd be homeless.

An American had his account emptied. He thought 'thats ok, my pension comes in on Wednesday'. But before he could get to the bank, she had that as well. So he was pot-less.

But nothing happens here, he will never get it back. The banks do nothing, because they see it as one of theirs taking what's due from a farang.

When I was going through the divorce, literally every old lady in government offices we had to sign the paperwork tried to persuade my ex wife that “falangs should pay” 😂 If not the contract, they really could change her mind I guess so F that chances

Nothing, if he just leaves... Thats what i would do in that situation. You can only keep giving so much, and when she wants more, then fk her off.

Best way is to not get married in the first place.

Don't buy them a house, or land, or if you do, get a loan to buy. Then if it goes tits up...she can pay the loan, or lose the house.

He might be the nicest husband in the world, but can't afford anymore houses for her parents, cars for her uncles, motorbike for her 'brother', vet for the sick buffalo (Do they still use the sick buffalo scam?) 🤣🤣🤣.

Anyway, i bet she never paid a single baht into the relationship. So he can't afford her anymore..

I'd just pack up my shit and move out. And move on. He's paid out all his marriage, she gets the house, the land, probably the car, he gets his freedom... that's priceless.

To my knowledge, there is no legal obligation involving informal relationships. If you are happy to give or share anything, you are free to do so. The other party has no legal power to demand anything. There is an exception though if the girl/boy is under 18 because it is a crime to take a minor away from parents regardless of the minor's consent. In this case, you might need to cut a deal with the family before the authority learns about it because it is punishable by imprisonment. Some poor families might even trick people into doing that for a six figure compensation. Others might be willing to end this unfortunate circumstance by getting them married to avoid gossip.

If your able to come to an agreement with your wife without going through the courts / lawyers etc, its simply a trip to the Amphur with relevant documents, marriage certificate etc and it can be done same day, mine cost about 100baht 8 years ago.

is correct. It cost me 100฿, all in. We had a prenup, stating what we brought to the marriage we kept after divorce. I purchased no fixed assets during the marriage. We went to the Amphur, signed the paperwork, and went our separate ways.

but then Thailand kicks you out the next day as you dont have a valid marriage visa anymore right ?

no. I had sole custody of our Thai daughter after the divorce. So the family visa applies (400K instead of 800K). I’m out of Thailand now, but had that visa and extension of stay for many years. And could reapply for it tomorrow if we decided to return to Thailand.

There are alternatives without Thai family anyway. Retirement visas for over 50s, in my case.

Take what you can (material objects and cash) , go see a lawyer and get it finalised. Dont stress or waste your time fighting it in court. You could end up dead.

she took my car I bought and paid for and moved out while I was back in the States, last July. And of course suggested I put the car in her name to get it for lower price
