TLDR : Answer Summary
The DTV visa requires applicants to be remote workers or freelancers, not just business owners. To qualify, you should be able to provide documentation that supports your ability to work remotely from Thailand without having clients in the country. Having a payroll of $3500 from a retail business in the USA may not be sufficient on its own; having a contract and proof of legitimacy might also be necessary. It is advisable to contact the nearest Thai embassy for specific guidance.

I got it with my business but had to provide a contact we had with a client as proof were legitimate and have income.

It might be different if you don't have clients, not sure.
