What provisions exist for accessing the bank account of a retirement visa holder in Thailand after their death?

Question for those with the retirement visa and holding the required 800,000 THB in a Thai bank, what provisions are there upon the event of the death of the retirement visa holder/bank account holder?

How does the next of kin or legal heir claim access to the account or funds within?

Also, I know a DTV holder is not able to open a bank account officially (but I hear it can be done with an agent) but can the DTV holder open a bank account at the same bank as the retirement visa holder if related?

Or a joint one perhaps?

Thanks in advance.
Answer summary
This discussion centers on the options and requirements for accessing the bank accounts of retirement visa holders in Thailand after their death. Key points include the necessity of drafting a Thai will for heirs to gain access to funds, the complicated legal process involved, including court approvals, and the potential risks when using ATM cards after a holder's death. It also touches on related issues such as the ability of DTV holders to open bank accounts and the possible legal ramifications of not having a will.

You will need a separate will in Thailand under thai regulations for all your Thai assets, with a will it's hard, without a will its probably nie on impossible. My Thai wife was a widower to a Thai man with a will, and still it was very hard for her

Something else to keep in mind (and others may correct me here), but as I understand it, you need a will in each jurisdiction in which you have assets, ie, a will drawn up and recognised in Australia will have no legal bearing on assets in Thailand, even if they are specified in that will.

Mark Robinson yeah that's how it is for the US as well. I don't have any belongings in the US anymore but I do have a bit of money but that money is in a joint account with my son. It's a joint account that requires only one signature so either of us can empty the account out without the other signature. I've given my son instructions on how to divide the money up among those in the US so that I don't need a US will. It will make things a lot easier for the kids not having to go through court or probate or whatever you call it.

I did a fair bit of research and was informed that, as a Canadian citizen, an English holographic will, dated and signed by two witnesses (including their printed names, passport numbers and countries of origin) is also acceptable in Thailand. If this is incorrect, please advise, thank you.

OP
From all the answers I got here in this post, and then my own research yesterday, it seems a will in Thai and drawn up by Thai lawyers is the best way to speed up the process for your heirs. While an English will might be acceptable, it could help reduce stress and costs for them in what would already be a stressful time.

A friend passed I was his executer of his Thai will in short it was a nightmare handling his estate everything was left to a thai family however that did not help in any way ! To get the money out of his Thai bank you have to get a lawyer who then has to go to the law courts for a judge to sign a document in order that the bank releases the funds to the estate it takes many months and is costly . Because of all the hassle I no longer keep a large amount of money in my Thai bank I use an agent the 800k is now in my home country earning interest which is enough to pay my agents fees I’ve been doing this for the past 6 years with no issues note the 800k cannot be held in a joint account so even if your married to a thai she would have to go through the courts the only other option which is a possible criminal action is having the deceased card number and withdrawing money from an ATM over a period of time

Whilst living in Thailand, I had the 800K/Baht seasoned in a FCD account at the Bangkok Bank.

In the mean time, I made a will and the Bangkok Bank received a copy of my will stating that in the event of my death the funds (FCD and current account) would be inherited by my daughter.

Completely legal and accepted by the Bangkok Bank.

yes but your daughter will have to employ a thai lawyer who then goes to the courts to get a judge to sign a release document in order for the funds to be released to your daughter and all this costs money of course if your daughter was in possession of your card and password that could be an alternative way but does have its own risks

Robert Johnstone Big mistake if account was only in one person’s name as would be necessary for retirement visa. Under this scenario once the owner dies, nobody is legally allowed to withdraw the money (not even a spouse) until adjudicated by the court via a will or next of ken. This is a common misconception that causes Thai partners left behind a big problem after the foreigner partner/spouse dies.

Robert Johnstone I had an FCD and Current account with the Bangkok Bank since 2002 until 2024 and never had a problem with them.

In 2024, I left Thailand and a week before I left I went to the Bangkok Bank to collect the FCD and close the current account.

This was done in 30 minutes from Korat and I got all my money back and transfered to my account in Belgium.

The ONLY PEOPLE who had their account freezed were people who didn't comply with the regulations (tax ID) and the money was released INTEGRALLY after they complied with the current regulations.

Stop "bad mouthing" about the Bangkok Bank and publish the FACTS!!!

By the way, I guess you know already the "Digital Act" in Thailand and the consequences of publishing negative (untrue) advertising?

Nongnuch ********

Aarif Meghani . . . . While it is also possible to draft a handwritten will, this is associated with considerable uncertainty in Thailand. It is better to draft a will strictly according to the letter of law according to the Thai Civil Code.

You can have a Thai Last Will set up at a lawyer’s office, or download a Thai will template from the internet (check out samuiforsale dot com).

"Thai Last Will" in this case means that it is drafted and designed according to the provisions of the Thai Civil Code. This will therefore will be recognized in Thailand.

I can bequeath only personal belongings and possessions located in Thailand. For any property in my home country, a separate Last Will is required.

Each item in my possession must be individually listed in the Last Will. For example, my bank account containing the +800,000 THB baht deposit which I use for my annual "retirement extension," the car, and all of my personal belongings.

The Last Will template obtained from the “samuiforsale” website came as a WORD .doc template. The text can be modified and edited, the template can be tailored to your own needs and requirements.

I first wrote all sections in my native language. I then sent the half-finished template to an embassy recommended translation office, asking them to translate my text into Thai and add it into the template. That’s what they did.

Then I went to the Amphoe, together with my girlfriend and two witnesses (she being named as the “beneficiary” and the "executor" in my Last Will).

On the Amphoe, each page was read out aloud, signed by the witnesses, my girlfriend and me, and got stamped by the Amphur. They did so with every single page. My Last Will consisted of 16 pages.

The head of the office, who did the reading, praised the Thai text as being excellent.

We submitted THREE copies, all of which were stamped and signed by the Amphur.

One of these copies remained, sealed inside an envelope, on the Amphur. We took back home the other two copies.

One copy is intended to be mailed to my country’s embassy in Bangkok in the event of my death, in an addressed envelope, as it states my sincere wish that my remains should not be transferred to my home country, that instead, my girlfriend as my executor can order my remains to be locally cremated inside Thailand.

Should I pass away in my home country, my girlfriend can empty my bank account, as the debit card and bankbook will remain with her during my stay in Germany. Nobody will hinder her. When there are no further account transactions for a period of one year, the account will be automatically closed.

If I pass away in Thailand, the situation is more complicated. The police will order my account frozen. Anyways, before this happens and if my girlfriend starts withdrawing money, she'll be committing fraud and an offense.

The Thai Last Will always has to be approved by a Thai court first. This process can take up to six months (!)

It should also be mentioned that any court executor could approach the heir and demand a bribe. You hear stories like this every now and then!
Aarif *********
Aarif *********
OP
Nongnuch Kamdee thank you for the very detailed breakdown.

That point about withdrawal of the funds from a dead person’s account as potential fraud is an important one to note.
Nongnuch ********
Nongnuch ********
Aarif Meghani yes, sure it is. If you pass away in Thailand, police will make sure your account and assets get frozen. Your heir cannot use the debit card to withdraw anything from that moment on. If the heir withdrew money using the card before the police went into action, it is looked upon as being an offense.
Nongnuch ********
Nongnuch ********
Aarif Meghani "Some have suggested leaving their heirs the ATM card" . . . . . I can only WARN any heir against doing so, it will have sharp legal repercussions because using your debit card after you have deceased, i.e. before your Last Will has been court approved, is equal to committing fraud.
Nongnuch ********
Nongnuch ********
Aarif Meghani without a will, your belongings and money deposits fall to the Thai government
Aarif *********
Aarif *********
OP
Nongnuch Kamdee OK I see what you mean.

The last will is “enough” by what actions you can personally take, but it still needs to go through a court after the death.

But without a will, then it might take longer or not even happen.

Is that right?
Aarif *********
Aarif *********
OP
Ossie Cassidy thank you for your input, this is the point I’m trying to clarify.

The death would be reported first to the police and then to the embassy via the police.

But if the bank gets notified then suddenly the funds become inaccessible to your heirs.

What we’ve learned from people’s input is that a will drawn up in Thailand is the best way to make sure the heirs are put through minimal stress to access the funds.

Some have suggested leaving their heirs the ATM card, which on the surface seems easy enough, but there is the possibility of that being considered as fraud if withdrawals are made after the registered death date on the death certificate.
Nongnuch ********
Nongnuch ********
Aarif Meghani no, this is not enough. The Last Will, after your demise, first must be opened and acknowldeged by a court. This can take up to 6 months. The bank will only accept a court order, the Last Will alone is not enough
Aarif *********
Aarif *********
OP
Nongnuch Kamdee but a will drawn up by a lawyer in Thai and submitted to the bank, and the heirs, would be enough?

Kool Breez Thank you. Yes, it does seem that's the best way to go. Appreciate your input.

Aarif Meghani just hire an attorney. It is not that expensive. When you pass away everything you own goes into probate. A legal will is accepted by the probate judge for property disbursement. If no will then direct relatives make claims, and the judge decides.

OP
Stuart Chiverton That's a good idea, so long as it is still legally acceptable.

Would it have to be bilingual in order to be valid, or just witnessed?

And I guess officially notarised or something?

Can answer your first question and that is write a Will. That allows your legal heir to access the funds.

OP
Sebastian Barrow Thank you.

That makes sense.

Is that a straightforward procedure in Thailand, and does it matter if the heir is living (or has to be physically present) in Thailand?

Also, any idea of the cost of drafting one?

Aarif Meghani we are having our living well and end of life well done currently. It is straight forward and easy. We are designating that our family in America gets to take care of our banking and our car and stuff if my husband and I both pass at the same time and they will get a copy of that and then the Thai log just says that they have all access accessibility to everything.

Aarif Meghani it is recommended that the appointed heir also gets appointed as the "executor" of the Thai Last Will, and the executor of your cremation or burial in Thailand. It is an advantage that bundles the important roles in one and the same person.

Aarif Meghani There are templates that you can download online for about 15 USD. You complete this then get the required witnesses to sign and some Amphurs allow you to register the will with then or you can use a court but this is not 100% necessary.

Graham Seal You were wrong in the part where you wrote "and some Amphurs allow you to register the will with then or you can use a court but this is not 100% necessary." . . . . . . . . . You definitely NEED the Amphur sign and stamp the Thai Last Will, or it will NOT BE VALID. It MUST BE signed and stamped on the Amphur, or a Thai Court will never approve it . . . . . .Only a handwritten Last Will would be valid by itself, but I do not recommend it.

Graham Seal Last time I checked the templates were available for $20,oo US Dollar

Aarif Meghani it is not a difficult process and it is preferable if the heir lives in Thailand. I have had to write two Wills. One for over here for my wife and son to be beneficiaries and one for UK for relations there.

Ours cost around 12kTHB but no doubt others will come up with other amounts depending who you use.
