Is the Thai Elite Visa suitable for someone working in Singapore while living in Thailand?

Hi hope this question is appropriate for here.

I have recently joined a start-up in Singapore & they are fine with me splitting time between Thailand & Singapore. I am on an Australian passport but want to keep my base in Thailand & would travel between here & Singapore regularly, and don't want the risk of just using VISA exempts or messing around with tourist VISAs etc I also don't want to have to return to Australia if possible.

Looking at VISA options I am thinking the only real option is the Thai Elite VISA. Am I correct on this?

Also a consideration...

Are you planning to get married to a Thai...if so you can get a work permit in Thailand.

Why spend 500,000 Thai baht for a Thai Elite Visa if you plan on marriage in the near future?

You can NOT get a work permit as being married.

You still need an employer or own company, the only benefit is that the Non Immigrant O visa based on being married to a Thai National is not employment prohibited unless you have the work permit.

Here's my opinion:

1. The Thai elite visa is for people who want to holiday here, not to work here.

2. I'm assuming your job allows you to work remotely. Most work related laws were developed in the 1970's, before remote work was common, so working remotely is neither legal, or illegal. However, working without a work permit IS illegal.

If you want to do work remotely in Thailand, on a tourist/ elite visa, my advice is to keep your head down and don't mention it to anyone, and remember you'll be breaking the law (technically).

Or check detail conditions and requirements of Multiple entry Non-B business purpose from Singapore. Though not for someone based on Thailand, but for someone frequently visit Thailand on business.

Elite will be the best Option if you won't work in Thailand.. Finally it might be also cheaper then most other Visa..

I think that the Non Immigrant B visa will be much cheaper as it is only 2.000 Thb at application and after that 1.900 Thb for 1 year Extensions of Stay.

Quickly calculated:

Visa 2.000 Thb

5 years Extension of Stay 1 year at the time at 1.900 Thb

Multiple Re-Entry Permit 3.800 Thb a year

2.000 + 9.500 + 19.000 = 30.500 Thb in 5 years

No, as the Thai Elite Visa is employment prohibited. Your only option is the Non Immigrant B visa and a work permit.

Currently Thai authorities say digital nomads are not breaking the law.

But this is a grey area because they could change their interpretation and enforcement of the law at any time.

you would likely be ok but you have to be aware of the fact that it is interpretation and enforcement that would allow it and that could change with no notice.

The law as written can easily be interpreted that digital nomads are “working” and therefore breaking the law.

You can google search and find various cases of digital nomads being busted only to later be released and told they were not breaking the law.

I have not heard of any digital nomad rather self employed or working for a foreign company being charged and tried for breaking the law. Just a handful of busts of coworking spaces and similar where they were later let go.
