PAYING TAX UNDER SOFT POWER FOR ONLINE WORK

Hi guys, I have the DTV under muay thai, and i work online. I’ve been in Thailand since November and started working in April. I’ve been doing some research on where to pay my tax but it’s seems so unbelievably difficult and I can’t seem to find a straight answer.

I know if I am in thailand for more than 180 I become a tax resident, so if that is the case can any of you please tell me how i pay my tax here because if that’s the case most of you should be paying tax here as well?

I also heard the UK and thailand have an agreement so if you pay tax in one country you don’t need to pay it in the other, again i’ve seen “grey areas” about this as well.

If you are the same as me and paying tax here or in the UK please let me know what you’re doing and what i should do. Thank you 🙏🏻
Answer summary
The user, a holder of a DTV visa under the Soft Power scheme, faces confusion about tax residency and obligations while living in Thailand. After spending over 180 days in Thailand and working online, they seek clarity on whether they need to pay taxes in Thailand and how to handle dual taxation agreements between Thailand and the UK. Various responses highlight that, despite being a tax resident after 180 days, taxation might depend on specific income sources and agreements between countries. There is significant debate within the comments about the legality of remote work on a Soft Power DTV and how tax residency should be handled.

If it cause unease or not is not the point. There are some tax laws that can effect "tourists" staying over 180 days a year in the country.

Most likely they never have to pay tax, just like a lot of Thai never pay tax.

The fact is you cannot be sure, the moment the PM thinks he should enforce tax law for foreigners he can do so.

I needed Thai tax residency to not pay some things in my home country.

It is quite hard to obtain but I did it.

Go to your local tax office and ask.

If they say you don’t need to pay tax, ask for something in writing to that effect.

Y’all take this a little too seriously — even some of these replies. Plenty of people work online from their condo or villa without shouting about it.

Tax liability depends on the country’s residency rules, but the global system isn’t as perfectly connected as people imagine. Authorities generally focus on major tax evasion, not someone earning £50k while doing a cooking course in flip-flops.

180 days or more in the country, with or without any visa means you are tax resident.

Pay your taxes in your passport country. That is the easiest. Even though you become a Thai tax resident after 180 days, you are not working inside Thailand. As such Thailand knows all money you are bringing into Thailand you are spending here. All Thailand is seriously concerned about is that taxes have been paid, to avoid anti-money laundering concerns. Any difference in dual tax treaty percentages are so small Thailand isn't concerned. Thailand is a profitable country,

This common statement about Soft Power not allowed to work remotely is simply not accurate as a general statement. The official Thai MFA information clearly lists DTV Workcation for digital nomads, remote workers and freelancers, while Thai Soft Power is a separate DTV purpose, including Thai culinary training and Muay Thai.

If anyone is claiming that a DTV holder under Soft Power can not work remotely for a foreign company or foreign clients while in Thailand, please provide the official regulation confirming this.

Better yet, anyone can verify this directly with the Thai authorities instead of relying on comments in Facebook groups:

Department of Consular Affairs, Ministry of Foreign Affairs of Thailand

You can also contact the relevant Thai Embassy/Consulate directly and ask for a written clarification.

Please verify information with the Thai authorities before presenting it as a fact.

For Labour Act it does not matter where the money is coming from, outside or inside Thailand.

Even when you not get paid for the job it still is prohibited.

You might be right that they are not really interested in some foreigners doing a remote job, that is why they not enforce it actively.

And for tax laws completely different rules are in place, 180 days or more making you tax resident, and the depending on your exact situation and relevant DTA you might have to pay tax or not.

What do you mean with retirees not checked?
Alex *********
Alex *********
@Luit ****************
So why don't they check pension income, retirement payments, or retirees who stay in Thailand? For what? It's the same as DTV income — it's not from Thailand.

Thai government officials will be interested only in two cases:

Anyone doing work or business locally without a work permit and the specific visa.

Or

When anyone sends money into a Thai bank account and stays here for more than 181 days per year, becoming a tax resident in Thailand.
Luit *****************
Luit *****************
@Alex ********
Why should Ministry of Labour not have anything to do with Labour Act when it is about remote work?

In the law there is no exception made for remote work.

And what makes you think Thai Immigration should check everyone?

The CAN check if they suspect somebody is working illegally, but as I said before working remotely is already for many years, long time before DTV and LTR not a real priority to enforce.

But with LTR for remote working and DTV workcation, now there are also completely legal possibilities to have a remote job.

For all other visa, including other LTR and DTV visa just nothing did change and they might just keep tolerating the remote job like before.
Alex *********
Alex *********

sorry but your information far from reality.

Labor Department nothing to do with DTV till any DTV or old retirement pensioner try to make some local work or business without cancel incorrect visa and apply for correct visa like Non B in order to get Work Permit to work or doing business legally in Thailand and work permit don't require if income outside of Thailand, if you not agree so I believe Thai immigration must check everyone who has no work permit and having work or income outside of Thailand so basically it's nonsense.
Luit *****************
Luit *****************
@Alex ********
You clearly don't understand who is responsible for what.

MFA is responsible for issuance of visa, they cannot give you permission to work.

Ministry of Labour is responsible foer everyone doing work in Thailand, also tourists.

It is up to them if they decide to enforce the laboutr laws or not.

You never heard me tell they will enforce the law for DTV or any other tourist doing a remote job.

They normally will tolerate, so als long as you keep low profile you will not get any problems doing a remote job, but that is not making it legally allowed like on DTV workcation and LTR for remote workers from outside.

Because DTV is a tourist visa it is simple to prove it

When you submit TDAC Thailand form you put there what reason ? Tourist Holiday and this reason used for any DTV visa does not matter what was the reason to get a visa in the first place.

So don't make any DTV from this special. DTV same as free visa or tourist visa, just with different requirements to apply and extend, and with a longer period of visa for multiple re-entries not for permanent stay from day to day, remember what happens with every tourist who stays too long too often.

DTV is one visa

Not two separate visas

Even depends can do freelance job for forigner companies

Proof please by government officials if it's not

Hundreds of applicants was mandatory under soft power to proof freelance remote work before get DTV - Thai Embassy in London, Ho Chi Minh Thai Embassy is mandatory to get approved DTV under soft power need clear proof of income - generally accepted as freelance remote work, even in London many people must sign up for documents that they proof remote work as freelance and they work online and do Thai soft power activities

@Alex ********
MFA has requirements for 3 types of DTV visa, and exacty those requirements decide about an exception on Labour Act.

I never have seen an embassy ask for proof of remote work, simply because it is not a requirement.

They might ask you to show active or passive income, but that is a different thing.

@Bob *********
As you can see from the post, they basically do not want to accept self-employment, freelancers, digital nomads, company owners, or small/solo entrepreneurs. Almost all of these cases fall under the Workcation category.

What they want to see is essentially:

• Employment with a Co., Ltd.

• Tax return certificates for the last 2 years

• All relevant salary slips / payslips

• Confirmation from the employer that the employee is allowed to work remotely from Thailand

But in practice, this creates a serious problem.

For many Russian companies, officially allowing an employee to work remotely from Thailand can create additional tax, legal, and compliance obligations for the company.

As a result, many real people who would genuinely qualify for the Workcation purpose simply cannot provide this exact set of documents.

This means that, under these requirements, the Workcation category may not realistically fit a large number of freelancers, self-employed people, entrepreneurs, and digital nomads.

But same time hundreds of ads agents offering 100% guaranteed approvals for very expensive costs just with passport and photo only in Moscow Thai embassy , it's very strange in general.

@Nongnuch *******
nah, actually I didn't say any of that.

I gave one example, the retirement non-O and the requirement to have nearly a million in the bank OR a regular income of money from overseas, regardless of whether they're actually retired or not. **And that's for just a 1 year approval!

You skipped right over that and gave 3 other random examples

As for the medical recovery: IF a person was making regular income (via online social media, remote work, passive income via stocks or investments or literally any other means of regular income that they get, EVEN while in a hospital bed, that they then *wouldn't* qualify for the visa and would be deported for it? 😂

The trailing spouse visa is not relevant because that is LITERALLY permitting a stay based SOLELY on the other person having a long stay visa and work permit. That is not them wanting to come and survive independently in a country with "no income" .... It's literally in the title: a dependant 🙄 And there is absolutely a minimum amount, as a foreigner making 30,000 baht a month I wouldn't be able to have a trailing spouse visa because Thailand would not consider that a sufficient amount for 2 people to live off of ...

Finally, as for the soft power being approved for 5 years for a 7 month course, you do realize (like anything else) a visa CAN be subjectively approved for a much smaller amount of time, like when someone's passport expires the DTV visas only go to that date. So it is entirely within the discretion of Thailand to approve the visa for only that specific amount of time ( 7 months, 1 year etc) and yet they've DEVELOPED a 5-year visa for that exact reason of coming in and doing a short term course.

Again, your argument lacks logic. It might not be your fault but your willingness to die on a hill you can't defend is giving me secondhand embarrassment for you
Nongnuch ********
Nongnuch ********
@Chelsea *******
😆This is starting to get more and more funny. 😄

There are 3 types of DTV.

Take a long and CLOSE LOOK at the MFA publication! Put on your reading glasses in case you can't read it.

So, you are implying that on a medical DTV (the DTV3) you can rest & recreate in a hospital bed and still allowed to work remotely?

Or on the spousal dependent DTV, the wife is allowed to work remotely? Are you really saying that? You are VERY wrong

Or are you really implying that when your Soft Power DTV2 seven-months Muay Tai Training course is finished, you can still remain in Thailand and work remotely? That would be illegal.

😆This is starting to get funny. 😄

Is the sponsored child of a DTV holder (it is also on a DTV!) allowed to work?

I prefer to follow the MfA and the Immigration's take on this matter. Some people on Soft Power DTV2 types will sooner or later find out that they can't work remotely on the DTV2.
Chelsea ********
Chelsea ********
@Nongnuch *******
no yeah you keep saying that and then doubling down on it with zero proof or clarification, and an inability to logically explain how/why 5 year DTV visas for soft power are being approved daily, without much of any required minimum savings, and yet you believe they're also banned from having any income at all 😅

It's cool though, some people aren't actually fit to comprehend the thinking part of their ideas. It's like when little kids say "I know the answer but I'm not gonna tell you!"

It's a cute way for them to protect their ego, rather than admitting their thoughts are made up of nothing and their words are just a product of their nonsensical thoughts.

Chelsea ********
Chelsea ********
@Nongnuch *******
so why are soft power DTVs being approved for 5 years?

The problem is that your opinion lacks solid logic.

As a country, why would they want a bunch of foreigners here and by their own devices have them here for multiple years NOT working at all.

Surely that's a recipe for homelessness? 😅

The best example I have to counter you, is to look at a retirement NON-O visa which absolutely prohibits working AND YET has an option to override the 800,000 kept in the bank by proving a monthly income of at least 65,000/mo.

Some people get this through their pension, but some people, especially at the young(ish) age of 55 can and do still work remotely and gain a monthly income and they're approved for the NON-O, based on retirement, prohibiting work, and yet *are* required to be able to show a regular monthly "income"
Nongnuch ********
Nongnuch ********
@Chelsea *******
This is your opinion. In my opinion the prohibited employment is regarding work for foreign AND Thai clients, unless it is the DTV1. The "hobby course" on a DTV2 is only for 6-9 months. This means they are misusing the visa during the rest of 4 years and half. Had they enlisted for the workation DTV, their remote work would leave them fully elegible for the full 5-year period
Chelsea ********
Chelsea ********
@Nongnuch *******
employment prohibited, in this case means work/employment IN Thailand is prohibited. It does not mean they "can't" work their own remote job

Just curious, if someone was here for 5 years and had NO income coming in the entire 5 years, how would Thailand expect them to live and survive for that amount of time doing a hobby course? Really asking

You can argue that Bob does not tell about the real life situation in which it is tolerated to have a remote job.

But ypu have to understand that this kind of tolerated situation can always change from one day to another day, as soon as politics decide law should be enforced.

Look what is happening with the nominee construction at the moment.

For years nobody had a problem with that, even land office registered land of that companies without any questions, and now it is suddenly enforced, and people that got advise from their lawyers to use the construction are now seen as criminals.

So when you want to do remote work, just realise it is not legal unless it is officially allowed.

is correct, the law does not allow foreigners to work in Thailand without a work permit or a visa that makes an exception.

DTV softpower not makes such an exception, not explicitly nor inplicit by requiring a remote job.

In practice already for many years, all Thai authorities tolerate remote jobs as long as no Thai are involved, even embassies already advised so.

So you are the one spreading misinformation, not Bob.

Remote work in Thailand is not legally allowed, just like prostitution is not allowed in Thailand.

That it happens and not is enforced just does not make it legal.
