TLDR : Answer Summary
To start the Thai 2 million investor visa process for a restaurant, begin by consulting a lawyer experienced in Thai immigration and business laws, as the guidelines might involve specific capital requirements, including needing to adhere to the non-B visa criteria. Open a Thai bank account and transfer the necessary funds. Following this, visit the local company registration office (AMPHO) for the necessary paperwork and requirements. It's advised to look for a trustworthy Thai business partner due to legal ownership structures. If uncertain about navigating the process, consider involving a reputable lawyer and possibly local accountants for better guidance.

Can you honestly recommend someone start a restaurant in Thailand in the current economic climate, generally speaking?
Starting your own restaurant business is good but be careful when choosing your lawyer..... etc, now they know you have THB2,000,000 for investment, they might cheat on you, should not say in public about your investment amount.
you’re welcome. Good luck! Remember you need a Thai business partner (51% shareholders). Ideally someone you can trust.
Figure out where you want a restaurant and find a local accountant.
You do not need 2M Tb to start a business, that is the business value.

While normally I advocate doing things on your own here, I tried setting up a company myself a couple years ago and got stuck. Find a legitimate lawyer, not one of those half baked Thai agencies.
However, if you want to try doing it yourself and you're in Bangkok, go to the Ministry of Commerce (here's the link) and ask them about setting up a business. They are very friendly and there are a few people who speak English. The 11th floor deals specifically with foreigner owned business in Thailand and will give you all the paperwork you need.
51% thai 49% you and 2M capital not take more time 4 thai worker 1 farang do you have your business here?

Open an account in a Thai Bank. Transfer money from overseas in your account, Go to (AMPHO) company registration office they will give you a requirement /details paper, ask your embassy for a good lawyer for company registration process, if you have Thai wife or GF she can do it for you you no need lawyer. Company registration will cost you maximum 35,000 baht.

Are you actually asking about setting up a 2 mil company to obtain a non b visa?
sir my wife is thai she know very well and i know very well first u go to your embassy after that need advocate...sir when u start ur business then give me job i can do any job computer billings air ticket hotel booking i can do any work
I wouldn't contact just ANY lawyer. If you want a lawyer, I recommend contacting your embassy, and asking them for a list of lawyers. A lot of lawyers are simply visa agents or visa consultants, and may not know what they are doing.
1. It has to be a local lawyer. And from the same province of the business.
2. Not a big firm
3. He/she is doing litigation too (not just consulting).
4. Consider a small business instead of a company. It keeps you below the radar. Personally I would choose to spend 500k for 5 years easy vip visa than this business visa based on investment.
5. To extend your business its always possible. It looks to me a real mistake to spend 3 million THB on business in a rental basis (as you are in the hands of the owner - he will up the rentals whenever he think you can pay). Start small and if you feel successful buy your own place and do the investment in your own property (real estate prices now are extremely cheap).
(*) I write it on behalf of 6 years experience running my own restaurant and bar.
If you want to keep it under the radar, so be it, but I do not feel comfortable at all advising people to break or bend the laws, especially in this environment and to abuse the SMART visa program to run a bar.
I'm not advising you to go to lawyer for doing something illegal. Staying below the radar was the most important advise that I gave you for free. If you doesn't understand what is the meaning then you better don't open any business. Thailand is not Europe, its totally different. Staying below the radar means not catching no one eyes as lots of people will come to you (government people and others, especially in this crisis when people have no money).
I already wished you luck, but you better look the statistics on number of restaurants that are survived the first year or two, especially when the property is rented.
say anything about the SMART visa? 500k for 5 years is Elite. And you can invest/own a business on Elite. You can't *work* on it, you would need to hire employees to do the actual work. But you can certainly own a bar on it.
using the SMART visa program to open a restaurant IS illegal. That is not sound advice.

I recommend contacting your local chamber of commerce. Contact the Joint Chamber of Commerce of Thailand, they can put you in touch with your local Chamber of Commerce and support you.
