Has anyone ever changed self business while already having a DTV ? I have a self business in my home country, but I live almost yearly in Thailand and I pay too much taxes (in my country), I wan’t to open an US LLC. Do I have to declare it ? Will I have any issue ?
Answer summary
The discussion revolves around whether an individual with a DTV (Thai long-term visa) who wants to close a self-owned business in their home country and open a US LLC needs to declare this change to Thai authorities. The consensus suggests that since the DTV is valid for five years as long as the visa holder remains engaged in work, formally declaring the change in business is not necessary in Thailand, especially if the business activities do not occur within Thai jurisdiction. However, the necessity of reporting foreign income for tax purposes in the individual’s home country remains a critical issue.

posting a comment to tell me that I’m trying to avoid paying taxes, to then admit that you didn’t declare anything in Thailand for 16 years with your full government name 😂. Congratulations.

Doesn't matter you can owe Thai taxes on day 1

Failing to get a TTN if you want one is entirely a skill issue.

you can’t even be in the county on a SETV long enough to even be considered you might get it done but that’ll be up to your country of citizenship good luck but taxes if you pay can be very high here depending on your income

You are only tax liable to thailand if you stay within the country for 180 days continuously on dtv

Foreign owned LLC use pass through taxation. That means that you declare profits and losses on your tax returns in your home country

LikableTiger4101 really? You asked whether you have to declare it. The answer is yes, on your home country tax returns

LikableTiger4101 that's not true. Firstly you don't pay tax after 180 days, that just makes you tax resident for that year, you pay tax in the first 3 months of the following year if your required to do so. 180 days by itself is pretty meaningless, the Thai Revenue Department will issue a Tax Residence Certificate but they will only do that after you've filed a tax return and you need a new one each year. Whether or not you need to file a tax return depends on bringing in more than 120k baht of assessable income in the year

you don’t choose to pay thai taxes or not. If you stay here for more than 180 days you have too, so yes, it’s enough

@Sefton *******
sure but would he not need to file a Thai tax return every year to obtain a Thai tax residency certificate for that year? I don't think just being inside Thailand for 180 days or more per annum is enough?

I dont see that paying Thailand the taxes is avoiding it. Hes clearly saying he lives almost all year in Thailand and will then be Thai tax liable.

Perfectly valid tax optimisation strategy. Leave the worldwide tax regime for a remittance based regime.

I see that now. But given the purpose of the change is to avoid tax when it won't I don't really see the point

he asking if he has to declare his change of employer.

I personally dont think so, its a 5 year visa and as long as you are still in work it should remain valid.
